試用期間,用人單位能隨便辭退員工嗎?

答 勞(lao)(lao)(lao)動(dong)(dong)合同(tong)中,對(dui)試(shi)(shi)用(yong)(yong)期解(jie)約的(de)(de)規(gui)定(ding)有(you)限制,企業對(dui)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)不能說辭就辭。勞(lao)(lao)(lao)動(dong)(dong)法規(gui)定(ding),試(shi)(shi)用(yong)(yong)期用(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)(wei)(wei)可(ke)解(jie)除勞(lao)(lao)(lao)動(dong)(dong)合同(tong)的(de)(de)情(qing)形(xing)只有(you)以下幾種: 1、在試(shi)(shi)用(yong)(yong)期間被(bei)證明不符合錄用(yong)(yong)條(tiao)件的(de)(de); 2、嚴(yan)重(zhong)(zhong)違反用(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)(wei)(wei)的(de)(de)規(gui)章制度(du)的(de)(de);嚴(yan)重(zhong)(zhong)失職,營私舞(wu)弊,給(gei)用(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)(wei)(wei)造(zao)成重(zhong)(zhong)大損害的(de)(de); 3、勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)同(tong)時(shi)與其他用(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)(wei)(wei)建立(li)勞(lao)(lao)(lao)動(dong)(dong)關系,對(dui)完(wan)成本單(dan)位(wei)(wei)(wei)(wei)(wei)的(de)(de)工(gong)作(zuo)(zuo)任務(wu)造(zao)成嚴(yan)重(zhong)(zhong)影(ying)響,或(huo)(huo)者(zhe)(zhe)(zhe)經用(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)(wei)(wei)提(ti)出,拒不改正的(de)(de); 4、因(yin)《勞(lao)(lao)(lao)動(dong)(dong)合同(tong)法》第二十六條(tiao)第一款第一項規(gui)定(ding)的(de)(de)情(qing)形(xing)致使勞(lao)(lao)(lao)動(dong)(dong)合同(tong)無效的(de)(de);被(bei)依法追(zhui)究刑事責任的(de)(de); 5、勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)患病或(huo)(huo)者(zhe)(zhe)(zhe)非因(yin)工(gong)負傷,在規(gui)定(ding)的(de)(de)醫療期滿后不能從事原工(gong)作(zuo)(zuo),也不能從事由用(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)(wei)(wei)另(ling)行(xing)安(an)排的(de)(de)工(gong)作(zuo)(zuo)的(de)(de);勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)不能勝任工(gong)作(zuo)(zuo),經過培訓或(huo)(huo)者(zhe)(zhe)(zhe)調整工(gong)作(zuo)(zuo)崗(gang)位(wei)(wei)(wei)(wei)(wei),仍不能勝任工(gong)作(zuo)(zuo)的(de)(de)。
