試用期間,用人單位能隨便辭退員工嗎?

勞動(dong)(dong)合(he)同(tong)中(zhong),對(dui)試(shi)用期(qi)解約的(de)規定有限(xian)制,企業對(dui)勞動(dong)(dong)者(zhe)(zhe)不(bu)能說(shuo)辭就辭。勞動(dong)(dong)法規定,試(shi)用期(qi)用人(ren)(ren)(ren)單(dan)(dan)(dan)位(wei)可(ke)解除勞動(dong)(dong)合(he)同(tong)的(de)情(qing)形(xing)只(zhi)有以下(xia)幾種: 1、在(zai)試(shi)用期(qi)間被證(zheng)明不(bu)符合(he)錄用條(tiao)件的(de); 2、嚴重(zhong)(zhong)違反用人(ren)(ren)(ren)單(dan)(dan)(dan)位(wei)的(de)規章制度的(de);嚴重(zhong)(zhong)失職,營(ying)私舞弊,給(gei)用人(ren)(ren)(ren)單(dan)(dan)(dan)位(wei)造成重(zhong)(zhong)大(da)損害的(de); 3、勞動(dong)(dong)者(zhe)(zhe)同(tong)時與其他(ta)用人(ren)(ren)(ren)單(dan)(dan)(dan)位(wei)建(jian)立勞動(dong)(dong)關系,對(dui)完(wan)成本(ben)單(dan)(dan)(dan)位(wei)的(de)工(gong)(gong)作任(ren)(ren)務造成嚴重(zhong)(zhong)影響,或者(zhe)(zhe)經用人(ren)(ren)(ren)單(dan)(dan)(dan)位(wei)提出,拒不(bu)改正的(de); 4、因(yin)《勞動(dong)(dong)合(he)同(tong)法》第二十六條(tiao)第一款第一項規定的(de)情(qing)形(xing)致(zhi)使勞動(dong)(dong)合(he)同(tong)無效的(de);被依法追究刑事責(ze)任(ren)(ren)的(de); 5、勞動(dong)(dong)者(zhe)(zhe)患(huan)病或者(zhe)(zhe)非因(yin)工(gong)(gong)負傷,在(zai)規定的(de)醫療期(qi)滿后不(bu)能從事原工(gong)(gong)作,也不(bu)能從事由用人(ren)(ren)(ren)單(dan)(dan)(dan)位(wei)另(ling)行安排的(de)工(gong)(gong)作的(de);勞動(dong)(dong)者(zhe)(zhe)不(bu)能勝任(ren)(ren)工(gong)(gong)作,經過培訓或者(zhe)(zhe)調整工(gong)(gong)作崗(gang)位(wei),仍不(bu)能勝任(ren)(ren)工(gong)(gong)作的(de)。
