被迫主動辭職,單位需要支付經濟補償嗎?

我想(xiang)咨詢一下,如(ru)果(guo)勞動(dong)者被迫主動(dong)辭(ci)職(zhi),用人單位需要支(zhi)付經濟(ji)補償嗎?

根據《中華人(ren)民(min)共和國勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)法》第(di)三十八條的(de)規(gui)定(ding),用人(ren)單位未及時(shi)足額支付勞(lao)(lao)動(dong)(dong)(dong)報酬(chou)的(de),勞(lao)(lao)動(dong)(dong)(dong)者可以解除(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)。第(di)四十六條規(gui)定(ding),勞(lao)(lao)動(dong)(dong)(dong)者依照《中華人(ren)民(min)共和國勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)法》第(di)三十八條規(gui)定(ding)解除(chu)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)的(de),用人(ren)單位應當向(xiang)勞(lao)(lao)動(dong)(dong)(dong)者支付經濟補償。
