答 《勞(lao)(lao)動(dong)(dong)法》第二(er)十五條中(zhong)規定勞(lao)(lao)動(dong)(dong)者有(you)下列情形之一的,用(yong)(yong)人單(dan)位(wei)(wei)可以解(jie)除勞(lao)(lao)動(dong)(dong)合同(tong):(一)在試用(yong)(yong)期(qi)間被證明不符(fu)合錄用(yong)(yong)條件的;(二(er))嚴重(zhong)違反(fan)勞(lao)(lao)動(dong)(dong)紀律或者用(yong)(yong)人單(dan)位(wei)(wei)規章制度的;(三)嚴重(zhong)失(shi)職,營私(si)舞弊,對用(yong)(yong)人單(dan)位(wei)(wei)利益造成重(zhong)大損害的;(四(si))被依法追究刑事責任的。
