病假工(gong)(gong)資(zi)的(de)(de)(de)(de)(de)基(ji)數(shu)按(an)(an)照以下三個原(yuan)則(ze)確(que)定(ding)(ding): (1)勞(lao)動(dong)合(he)(he)同(tong)(tong)有約定(ding)(ding)的(de)(de)(de)(de)(de),按(an)(an)不(bu)(bu)低于勞(lao)動(dong)合(he)(he)同(tong)(tong)約定(ding)(ding)的(de)(de)(de)(de)(de)勞(lao)動(dong)者本人所在(zai)崗位(職位)相(xiang)對應(ying)的(de)(de)(de)(de)(de)工(gong)(gong)資(zi)標(biao)(biao)準確(que)定(ding)(ding)。集(ji)體(ti)合(he)(he)同(tong)(tong)(工(gong)(gong)資(zi)集(ji)體(ti)協(xie)(xie)議)確(que)定(ding)(ding)的(de)(de)(de)(de)(de)標(biao)(biao)準高于勞(lao)動(dong)合(he)(he)同(tong)(tong)約定(ding)(ding)標(biao)(biao)準的(de)(de)(de)(de)(de),按(an)(an)集(ji)體(ti)合(he)(he)同(tong)(tong)(工(gong)(gong)資(zi)集(ji)體(ti)協(xie)(xie)議)標(biao)(biao)準確(que)定(ding)(ding)。(2)勞(lao)動(dong)合(he)(he)同(tong)(tong)、集(ji)體(ti)合(he)(he)同(tong)(tong)均(jun)未約定(ding)(ding)的(de)(de)(de)(de)(de),可由用(yong)人單位與(yu)職工(gong)(gong)代表(biao)通過工(gong)(gong)資(zi)集(ji)體(ti)協(xie)(xie)商確(que)定(ding)(ding),協(xie)(xie)商結(jie)果應(ying)簽訂工(gong)(gong)資(zi)集(ji)體(ti)協(xie)(xie)議。(3)用(yong)人單位與(yu)勞(lao)動(dong)者無(wu)任何約定(ding)(ding)的(de)(de)(de)(de)(de),假期(qi)工(gong)(gong)資(zi)的(de)(de)(de)(de)(de)計算基(ji)數(shu)統一按(an)(an)勞(lao)動(dong)者本人所在(zai)崗位(職位)正常(chang)出(chu)勤的(de)(de)(de)(de)(de)月工(gong)(gong)資(zi)的(de)(de)(de)(de)(de)70%確(que)定(ding)(ding)。此外,按(an)(an)以上三個原(yuan)則(ze)計算的(de)(de)(de)(de)(de)假期(qi)工(gong)(gong)資(zi)基(ji)數(shu)均(jun)不(bu)(bu)得低于本市規定(ding)(ding)的(de)(de)(de)(de)(de)最(zui)低工(gong)(gong)資(zi)標(biao)(biao)準。
