病(bing)假工(gong)(gong)資(zi)(zi)的(de)基數(shu)(shu)(shu)按(an)照以下三個(ge)原則(ze)確(que)定(ding)(ding)(ding)(ding)(ding)(ding)(ding): (1)勞動(dong)(dong)(dong)合(he)同(tong)有約定(ding)(ding)(ding)(ding)(ding)(ding)(ding)的(de),按(an)不(bu)低(di)于勞動(dong)(dong)(dong)合(he)同(tong)約定(ding)(ding)(ding)(ding)(ding)(ding)(ding)的(de)勞動(dong)(dong)(dong)者本(ben)人所在崗位(wei)(職(zhi)(zhi)位(wei))相(xiang)對(dui)應的(de)工(gong)(gong)資(zi)(zi)標(biao)準(zhun)確(que)定(ding)(ding)(ding)(ding)(ding)(ding)(ding)。集體(ti)合(he)同(tong)(工(gong)(gong)資(zi)(zi)集體(ti)協(xie)(xie)(xie)(xie)議)確(que)定(ding)(ding)(ding)(ding)(ding)(ding)(ding)的(de)標(biao)準(zhun)高于勞動(dong)(dong)(dong)合(he)同(tong)約定(ding)(ding)(ding)(ding)(ding)(ding)(ding)標(biao)準(zhun)的(de),按(an)集體(ti)合(he)同(tong)(工(gong)(gong)資(zi)(zi)集體(ti)協(xie)(xie)(xie)(xie)議)標(biao)準(zhun)確(que)定(ding)(ding)(ding)(ding)(ding)(ding)(ding)。(2)勞動(dong)(dong)(dong)合(he)同(tong)、集體(ti)合(he)同(tong)均(jun)未(wei)約定(ding)(ding)(ding)(ding)(ding)(ding)(ding)的(de),可由用人單位(wei)與(yu)職(zhi)(zhi)工(gong)(gong)代表通過工(gong)(gong)資(zi)(zi)集體(ti)協(xie)(xie)(xie)(xie)商確(que)定(ding)(ding)(ding)(ding)(ding)(ding)(ding),協(xie)(xie)(xie)(xie)商結果應簽訂工(gong)(gong)資(zi)(zi)集體(ti)協(xie)(xie)(xie)(xie)議。(3)用人單位(wei)與(yu)勞動(dong)(dong)(dong)者無任何約定(ding)(ding)(ding)(ding)(ding)(ding)(ding)的(de),假期(qi)工(gong)(gong)資(zi)(zi)的(de)計(ji)算基數(shu)(shu)(shu)統一按(an)勞動(dong)(dong)(dong)者本(ben)人所在崗位(wei)(職(zhi)(zhi)位(wei))正(zheng)常出(chu)勤的(de)月工(gong)(gong)資(zi)(zi)的(de)70%確(que)定(ding)(ding)(ding)(ding)(ding)(ding)(ding)。此外,按(an)以上(shang)三個(ge)原則(ze)計(ji)算的(de)假期(qi)工(gong)(gong)資(zi)(zi)基數(shu)(shu)(shu)均(jun)不(bu)得低(di)于本(ben)市規定(ding)(ding)(ding)(ding)(ding)(ding)(ding)的(de)最低(di)工(gong)(gong)資(zi)(zi)標(biao)準(zhun)。
