公司規定試用期內不繳納五險一金,是否合法?

最(zui)近剛進入(ru)濟南的一家公司上班(ban),公司規(gui)定(ding)試用(yong)期內部(bu)繳納五險一金,成(cheng)為正式員(yuan)工才(cai)給繳納,這(zhe)樣合法嗎?

依據(ju)《社(she)(she)會(hui)(hui)保(bao)險(xian)法》第五十八條“用(yong)(yong)人單(dan)(dan)(dan)位(wei)應當自用(yong)(yong)工之日(ri)起三十日(ri)內為其(qi)職工向(xiang)社(she)(she)會(hui)(hui)保(bao)險(xian)經辦(ban)機構(gou)申請辦(ban)理社(she)(she)會(hui)(hui)保(bao)險(xian)登(deng)記”,社(she)(she)會(hui)(hui)保(bao)險(xian)即五險(xian)一金(jin)(jin)的(de)繳納本身(shen)和試(shi)用(yong)(yong)期沒(mei)有(you)(you)關聯。實(shi)務中用(yong)(yong)人單(dan)(dan)(dan)位(wei)基于(yu)(yu)成(cheng)本的(de)考(kao)量作(zuo)出類似的(de)規(gui)定(ding),本身(shen)具(ju)有(you)(you)違(wei)法性,可能會(hui)(hui)引發兩方(fang)面(mian)的(de)法律后果:(1)職工以用(yong)(yong)人單(dan)(dan)(dan)位(wei)規(gui)章制度(du)違(wei)法、損害自身(shen)利益為由提出解(jie)除勞動(dong)合同(tong),并要求(qiu)單(dan)(dan)(dan)位(wei)支付經濟補(bu)償金(jin)(jin);(2)屬于(yu)(yu)違(wei)反《社(she)(she)會(hui)(hui)保(bao)險(xian)法》的(de)規(gui)定(ding),一旦勞動(dong)監察或者社(she)(she)保(bao)稽核(he)部門審查(cha),需(xu)要承擔一定(ding)的(de)行政責(ze)任(ren)。
