公司規定試用期內不繳納五險一金,是否合法?
問 最近剛(gang)進(jin)入濟南的一家(jia)公司(si)(si)上班,公司(si)(si)規定試用期(qi)內(nei)部繳納五險一金,成為正式(shi)員工才給繳納,這樣合(he)法嗎?
答 依據(ju)《社(she)會(hui)保(bao)險(xian)(xian)法》第五(wu)十八(ba)條“用(yong)人單(dan)位(wei)(wei)應當自用(yong)工(gong)(gong)(gong)之日(ri)起三十日(ri)內為其(qi)職(zhi)工(gong)(gong)(gong)向社(she)會(hui)保(bao)險(xian)(xian)經辦機構申請(qing)辦理社(she)會(hui)保(bao)險(xian)(xian)登記(ji)”,社(she)會(hui)保(bao)險(xian)(xian)即五(wu)險(xian)(xian)一金的(de)(de)(de)繳納本身和(he)試用(yong)期沒有(you)關聯。實務中用(yong)人單(dan)位(wei)(wei)基于(yu)成本的(de)(de)(de)考(kao)量作(zuo)出類似的(de)(de)(de)規(gui)定(ding),本身具有(you)違(wei)法性,可能(neng)會(hui)引(yin)發兩方面的(de)(de)(de)法律后果:(1)職(zhi)工(gong)(gong)(gong)以用(yong)人單(dan)位(wei)(wei)規(gui)章(zhang)制(zhi)度(du)違(wei)法、損害(hai)自身利(li)益為由(you)提(ti)出解除勞動合(he)同,并要(yao)求單(dan)位(wei)(wei)支付經濟(ji)補償金;(2)屬(shu)于(yu)違(wei)反《社(she)會(hui)保(bao)險(xian)(xian)法》的(de)(de)(de)規(gui)定(ding),一旦勞動監察(cha)或者社(she)保(bao)稽(ji)核部門(men)審(shen)查,需要(yao)承(cheng)擔一定(ding)的(de)(de)(de)行政責任。
