最低工資標準可以包含加班費嗎?
問 我(wo)現在(zai)(zai)是試用期(qi)員(yuan)工(gong),公司給的工(gong)資(zi)(zi)是最低(di)工(gong)資(zi)(zi)標準(zhun)(zhun),清明節要加班(ban),我(wo)下個月還在(zai)(zai)試用期(qi)內,想了解一下最低(di)工(gong)資(zi)(zi)標準(zhun)(zhun)可以(yi)包含加班(ban)費嗎?
答 職工(gong)(gong)(gong)的最(zui)(zui)低(di)工(gong)(gong)(gong)資(zi)(zi)標準(zhun)不應包(bao)含加(jia)班費。 勞(lao)(lao)動(dong)(dong)(dong)和(he)社會(hui)保障部(bu)頒布的《最(zui)(zui)低(di)工(gong)(gong)(gong)資(zi)(zi)規定(ding)》規定(ding):在勞(lao)(lao)動(dong)(dong)(dong)者(zhe)提供正常(chang)勞(lao)(lao)動(dong)(dong)(dong)的情況下,用人單位應支付(fu)給勞(lao)(lao)動(dong)(dong)(dong)者(zhe)的工(gong)(gong)(gong)資(zi)(zi),要(yao)剔除延長(chang)工(gong)(gong)(gong)作(zuo)時間(jian)工(gong)(gong)(gong)資(zi)(zi)以后(hou),不得低(di)于(yu)當地最(zui)(zui)低(di)工(gong)(gong)(gong)資(zi)(zi)標準(zhun);據此,延長(chang)工(gong)(gong)(gong)作(zuo)時間(jian)工(gong)(gong)(gong)資(zi)(zi)(即加(jia)班費)不能作(zuo)為最(zui)(zui)低(di)工(gong)(gong)(gong)資(zi)(zi)的組成部(bu)分。
