加班工資年底一起結算可以嗎?

問 我清明節和五一(yi)都加(jia)(jia)班(ban)了,公司一(yi)直沒給發(fa)加(jia)(jia)班(ban)費,據(ju)說加(jia)(jia)班(ban)費都是年(nian)(nian)底發(fa)放的,加(jia)(jia)班(ban)工資年(nian)(nian)底一(yi)起結算可以嗎?
答 加班工(gong)(gong)資(zi)年底結算是不合法(fa)的。根據《勞(lao)動(dong)法(fa)》規(gui)定(ding),工(gong)(gong)資(zi)應(ying)以(yi)貨(huo)幣形式按月支付(fu)給勞(lao)動(dong)者(zhe)(zhe)本人,不得克扣或無故拖欠勞(lao)動(dong)者(zhe)(zhe)工(gong)(gong)資(zi)。工(gong)(gong)資(zi)包括計時工(gong)(gong)資(zi)、計件(jian)工(gong)(gong)資(zi)、獎金、津貼(tie)和補貼(tie)、延長工(gong)(gong)作時間的工(gong)(gong)資(zi)報(bao)酬及(ji)特殊情況下的工(gong)(gong)資(zi)等。 所以(yi),加班工(gong)(gong)資(zi)應(ying)按月支付(fu)給勞(lao)動(dong)者(zhe)(zhe)本人。
