最低工資標準能包含加班費嗎?

問(wen) 我(wo)是一(yi)名試用期(qi)員工(gong)(gong),現在山東省一(yi)家私企工(gong)(gong)作,公(gong)司(si)發給試用期(qi)員工(gong)(gong)的工(gong)(gong)資是最低工(gong)(gong)資標準(zhun)(zhun),端午節期(qi)間我(wo)一(yi)直都在公(gong)司(si)加班,最低工(gong)(gong)資標準(zhun)(zhun)能包含加班費嗎?

勞(lao)動和社會(hui)保障部頒布的(de)《最(zui)低(di)工(gong)(gong)資(zi)(zi)規定(ding)》第(di)十二條(tiao)規定(ding): 在勞(lao)動者提供正常勞(lao)動的(de)情況下(xia),用人單(dan)位應支付(fu)給勞(lao)動者的(de)工(gong)(gong)資(zi)(zi)在剔除(chu)下(xia)列(lie)各項以后(hou),不得低(di)于當地最(zui)低(di)工(gong)(gong)資(zi)(zi)標準: (一)延長工(gong)(gong)作時間工(gong)(gong)資(zi)(zi); (二)中(zhong)班(ban)、夜班(ban)、高(gao)溫、低(di)溫、井下(xia)、有(you)毒(du)有(you)害等特殊工(gong)(gong)作環(huan)境(jing)、條(tiao)件下(xia)的(de)津貼(tie); (三)法(fa)律、法(fa)規和國家(jia)規定(ding)的(de)勞(lao)動者福利待(dai)遇等。 所以你(ni)的(de)工(gong)(gong)資(zi)(zi)不應包含加班(ban)費。
