用人單位不安排職工休年假的應支付給職工額外工資嗎?

我(wo)們單(dan)位(wei)滿一年(nian)(nian)(nian)的職工(gong)有(you)年(nian)(nian)(nian)休(xiu),但是用人(ren)單(dan)位(wei)有(you)時(shi)不安排員(yuan)工(gong)年(nian)(nian)(nian)休(xiu),或者(zhe)給(gei)予員(yuan)工(gong)的年(nian)(nian)(nian)休(xiu)時(shi)間比(bi)法定標準低,那請(qing)問年(nian)(nian)(nian)休(xiu)未休(xiu)的幾天,單(dan)位(wei)應該支付(fu)給(gei)職工(gong)額外(wai)工(gong)資嗎?

《企業職(zhi)工(gong)(gong)(gong)帶薪年(nian)(nian)休(xiu)假實施辦法》第十條規定(ding):“用人單位經職(zhi)工(gong)(gong)(gong)同(tong)意(yi)不安(an)排年(nian)(nian)休(xiu)假或者安(an)排職(zhi)工(gong)(gong)(gong)年(nian)(nian)休(xiu)假天數少于應休(xiu)年(nian)(nian)休(xiu)假天數,應當在(zai)本年(nian)(nian)度內對職(zhi)工(gong)(gong)(gong)應休(xiu)未休(xiu)年(nian)(nian)休(xiu)假天數,按照其(qi)(qi)日工(gong)(gong)(gong)資(zi)收(shou)入的(de)300%支付未休(xiu)年(nian)(nian)休(xiu)假工(gong)(gong)(gong)資(zi)報酬,其(qi)(qi)中(zhong)包含用人單位支付職(zhi)工(gong)(gong)(gong)正(zheng)常工(gong)(gong)(gong)作期間的(de)工(gong)(gong)(gong)資(zi)收(shou)入。”因此,單位不安(an)排年(nian)(nian)休(xiu)或者安(an)排休(xiu)的(de)年(nian)(nian)休(xiu)假比法定(ding)標準低的(de),應該要支付額(e)外工(gong)(gong)(gong)資(zi),即3倍工(gong)(gong)(gong)資(zi)。
