用人單位不安排職工休年假的應支付給職工額外工資嗎?
問(wen) 我們(men)單(dan)位滿一(yi)年的職工(gong)(gong)(gong)有(you)(you)年休,但是用(yong)人單(dan)位有(you)(you)時不安(an)排員工(gong)(gong)(gong)年休,或者給予員工(gong)(gong)(gong)的年休時間比法定標準低,那請問年休未休的幾天,單(dan)位應(ying)該支付給職工(gong)(gong)(gong)額外工(gong)(gong)(gong)資嗎(ma)?
答 《企業職(zhi)工帶薪年(nian)(nian)(nian)休(xiu)(xiu)假(jia)(jia)(jia)實施辦法》第十條規定:“用人(ren)單位經(jing)職(zhi)工同意不(bu)安排(pai)年(nian)(nian)(nian)休(xiu)(xiu)假(jia)(jia)(jia)或(huo)者(zhe)安排(pai)職(zhi)工年(nian)(nian)(nian)休(xiu)(xiu)假(jia)(jia)(jia)天(tian)數少于應(ying)(ying)休(xiu)(xiu)年(nian)(nian)(nian)休(xiu)(xiu)假(jia)(jia)(jia)天(tian)數,應(ying)(ying)當在(zai)本年(nian)(nian)(nian)度內對職(zhi)工應(ying)(ying)休(xiu)(xiu)未休(xiu)(xiu)年(nian)(nian)(nian)休(xiu)(xiu)假(jia)(jia)(jia)天(tian)數,按照其(qi)(qi)日工資(zi)收(shou)(shou)入(ru)的(de)300%支付未休(xiu)(xiu)年(nian)(nian)(nian)休(xiu)(xiu)假(jia)(jia)(jia)工資(zi)報(bao)酬,其(qi)(qi)中包含(han)用人(ren)單位支付職(zhi)工正(zheng)常工作期間的(de)工資(zi)收(shou)(shou)入(ru)。”因此,單位不(bu)安排(pai)年(nian)(nian)(nian)休(xiu)(xiu)或(huo)者(zhe)安排(pai)休(xiu)(xiu)的(de)年(nian)(nian)(nian)休(xiu)(xiu)假(jia)(jia)(jia)比法定標準(zhun)低(di)的(de),應(ying)(ying)該要支付額外(wai)工資(zi),即3倍工資(zi)。
