用人單位不安排職工休年假的應支付給職工額外工資嗎?

我們單位滿(man)一年(nian)的職(zhi)工(gong)有(you)年(nian)休(xiu)(xiu),但是(shi)用人單位有(you)時不安排員工(gong)年(nian)休(xiu)(xiu),或(huo)者給(gei)予(yu)員工(gong)的年(nian)休(xiu)(xiu)時間比法定標準低,那請(qing)問年(nian)休(xiu)(xiu)未休(xiu)(xiu)的幾天,單位應該支(zhi)付給(gei)職(zhi)工(gong)額外工(gong)資(zi)嗎(ma)?

《企業職(zhi)工(gong)(gong)帶薪年(nian)休(xiu)(xiu)(xiu)假(jia)實施辦法(fa)(fa)》第十條規定:“用(yong)人單位(wei)經(jing)職(zhi)工(gong)(gong)同意不安(an)(an)排(pai)年(nian)休(xiu)(xiu)(xiu)假(jia)或者(zhe)安(an)(an)排(pai)職(zhi)工(gong)(gong)年(nian)休(xiu)(xiu)(xiu)假(jia)天(tian)數少于應休(xiu)(xiu)(xiu)年(nian)休(xiu)(xiu)(xiu)假(jia)天(tian)數,應當在本年(nian)度內對職(zhi)工(gong)(gong)應休(xiu)(xiu)(xiu)未休(xiu)(xiu)(xiu)年(nian)休(xiu)(xiu)(xiu)假(jia)天(tian)數,按(an)照其日工(gong)(gong)資收入的(de)(de)300%支付(fu)未休(xiu)(xiu)(xiu)年(nian)休(xiu)(xiu)(xiu)假(jia)工(gong)(gong)資報酬,其中包含用(yong)人單位(wei)支付(fu)職(zhi)工(gong)(gong)正(zheng)常工(gong)(gong)作(zuo)期間(jian)的(de)(de)工(gong)(gong)資收入。”因此,單位(wei)不安(an)(an)排(pai)年(nian)休(xiu)(xiu)(xiu)或者(zhe)安(an)(an)排(pai)休(xiu)(xiu)(xiu)的(de)(de)年(nian)休(xiu)(xiu)(xiu)假(jia)比法(fa)(fa)定標準低(di)的(de)(de),應該要支付(fu)額外工(gong)(gong)資,即3倍工(gong)(gong)資。
