關于單位長時間加班不付加班費問題可不可以告公司?

最近廠(chang)里安排每隔一天就加班一次(ci),加到(dao)晚上9點,第2天遲點上班不付加班工資,如(ru)果我(wo)匿名舉報(bao)該(gai)公司(si),是否有法律依據?相關部(bu)門能否責令該(gai)公司(si)整改,禁止加班,否則予以處罰?

勞(lao)(lao)(lao)動(dong)法(fa)中規定(ding)用人(ren)單位需加(jia)(jia)班(ban)(ban)的(de)(de)(de)(de),均應(ying)與工(gong)(gong)(gong)會和勞(lao)(lao)(lao)動(dong)者(zhe)(zhe)(zhe)協商(shang)后才可加(jia)(jia)班(ban)(ban),而且(qie)每日(ri)加(jia)(jia)班(ban)(ban)一(yi)(yi)般不(bu)得超(chao)過一(yi)(yi)小時,因(yin)特殊原因(yin)的(de)(de)(de)(de),則(ze)應(ying)在(zai)(zai)保(bao)障勞(lao)(lao)(lao)動(dong)者(zhe)(zhe)(zhe)身體健(jian)康的(de)(de)(de)(de)條件下(xia)延長工(gong)(gong)(gong)作時間每日(ri)不(bu)得超(chao)過三(san)小時,每月加(jia)(jia)班(ban)(ban)累計不(bu)得超(chao)過三(san)十(shi)六(liu)小時。根據《中華(hua)人(ren)民共和國勞(lao)(lao)(lao)動(dong)法(fa)》第(di)四(si)十(shi)四(si)條規定(ding):安(an)(an)排(pai)勞(lao)(lao)(lao)動(dong)者(zhe)(zhe)(zhe)在(zai)(zai)法(fa)定(ding)標(biao)準工(gong)(gong)(gong)作時間以外加(jia)(jia)班(ban)(ban)的(de)(de)(de)(de),應(ying)按照不(bu)低(di)于(yu)(yu)勞(lao)(lao)(lao)動(dong)者(zhe)(zhe)(zhe)本人(ren)小時工(gong)(gong)(gong)資(zi)的(de)(de)(de)(de)150%支付(fu)加(jia)(jia)班(ban)(ban)工(gong)(gong)(gong)資(zi);安(an)(an)排(pai)勞(lao)(lao)(lao)動(dong)者(zhe)(zhe)(zhe)在(zai)(zai)休(xiu)息日(ri)加(jia)(jia)班(ban)(ban)的(de)(de)(de)(de),應(ying)首先安(an)(an)排(pai)其補(bu)休(xiu),不(bu)能(neng)安(an)(an)排(pai)補(bu)休(xiu)的(de)(de)(de)(de),按照不(bu)低(di)于(yu)(yu)勞(lao)(lao)(lao)動(dong)者(zhe)(zhe)(zhe)本人(ren)日(ri)或(huo)小時工(gong)(gong)(gong)資(zi)的(de)(de)(de)(de)200%支付(fu)加(jia)(jia)班(ban)(ban)工(gong)(gong)(gong)資(zi);安(an)(an)排(pai)勞(lao)(lao)(lao)動(dong)者(zhe)(zhe)(zhe)在(zai)(zai)法(fa)定(ding)休(xiu)假(jia)日(ri)加(jia)(jia)班(ban)(ban)的(de)(de)(de)(de),應(ying)按照不(bu)低(di)于(yu)(yu)勞(lao)(lao)(lao)動(dong)者(zhe)(zhe)(zhe)本人(ren)日(ri)或(huo)小時工(gong)(gong)(gong)資(zi)的(de)(de)(de)(de)300%支付(fu)加(jia)(jia)班(ban)(ban)工(gong)(gong)(gong)資(zi)。你(ni)可以根據勞(lao)(lao)(lao)動(dong)法(fa)保(bao)障你(ni)的(de)(de)(de)(de)權利(li)不(bu)受害(hai)。
