關于單位長時間加班不付加班費問題可不可以告公司?

最近廠(chang)里安排每隔一天(tian)就加(jia)班一次,加(jia)到晚上(shang)9點(dian),第2天(tian)遲點(dian)上(shang)班不(bu)付加(jia)班工資(zi),如果我匿(ni)名(ming)舉報(bao)該公(gong)司,是否(fou)有法律依據(ju)?相關部門能否(fou)責(ze)令(ling)該公(gong)司整改,禁止加(jia)班,否(fou)則予以處罰?

勞(lao)動(dong)法(fa)中規(gui)定(ding)用人單位需加班(ban)(ban)的(de),均應(ying)(ying)與工(gong)(gong)會(hui)和勞(lao)動(dong)者(zhe)協商后才可加班(ban)(ban),而且每(mei)日(ri)加班(ban)(ban)一般不(bu)(bu)得(de)(de)超(chao)過(guo)(guo)一小(xiao)(xiao)時(shi)(shi),因特殊原因的(de),則應(ying)(ying)在(zai)(zai)保(bao)障勞(lao)動(dong)者(zhe)身體健(jian)康的(de)條(tiao)件下延長工(gong)(gong)作(zuo)時(shi)(shi)間(jian)每(mei)日(ri)不(bu)(bu)得(de)(de)超(chao)過(guo)(guo)三(san)小(xiao)(xiao)時(shi)(shi),每(mei)月加班(ban)(ban)累計不(bu)(bu)得(de)(de)超(chao)過(guo)(guo)三(san)十(shi)六小(xiao)(xiao)時(shi)(shi)。根據《中華人民共(gong)和國勞(lao)動(dong)法(fa)》第四十(shi)四條(tiao)規(gui)定(ding):安排勞(lao)動(dong)者(zhe)在(zai)(zai)法(fa)定(ding)標準工(gong)(gong)作(zuo)時(shi)(shi)間(jian)以外加班(ban)(ban)的(de),應(ying)(ying)按(an)照(zhao)(zhao)不(bu)(bu)低(di)于(yu)(yu)勞(lao)動(dong)者(zhe)本人小(xiao)(xiao)時(shi)(shi)工(gong)(gong)資(zi)的(de)150%支付加班(ban)(ban)工(gong)(gong)資(zi);安排勞(lao)動(dong)者(zhe)在(zai)(zai)休息日(ri)加班(ban)(ban)的(de),應(ying)(ying)首先安排其(qi)補休,不(bu)(bu)能安排補休的(de),按(an)照(zhao)(zhao)不(bu)(bu)低(di)于(yu)(yu)勞(lao)動(dong)者(zhe)本人日(ri)或(huo)小(xiao)(xiao)時(shi)(shi)工(gong)(gong)資(zi)的(de)200%支付加班(ban)(ban)工(gong)(gong)資(zi);安排勞(lao)動(dong)者(zhe)在(zai)(zai)法(fa)定(ding)休假日(ri)加班(ban)(ban)的(de),應(ying)(ying)按(an)照(zhao)(zhao)不(bu)(bu)低(di)于(yu)(yu)勞(lao)動(dong)者(zhe)本人日(ri)或(huo)小(xiao)(xiao)時(shi)(shi)工(gong)(gong)資(zi)的(de)300%支付加班(ban)(ban)工(gong)(gong)資(zi)。你可以根據勞(lao)動(dong)法(fa)保(bao)障你的(de)權利(li)不(bu)(bu)受害。
