公司以未完成銷售額為由拒付工資合法嗎?

上個月,我一直很(hen)努力的工(gong)(gong)作,但是還是沒有完成(cheng)銷售額,公(gong)司領導(dao)很(hen)生(sheng)氣,以未(wei)完成(cheng)銷售額為(wei)由拒絕發給我工(gong)(gong)資,公(gong)司這么(me)做合法嗎(ma)?

《勞(lao)動合(he)同法》第20條規(gui)定:“勞(lao)動者在試用期(qi)的(de)(de)工(gong)(gong)資不(bu)得低(di)于(yu)本單(dan)位(wei)相同崗(gang)位(wei) 最低(di)檔工(gong)(gong)資或者勞(lao)動合(he)同約定工(gong)(gong)資的(de)(de)百分(fen)之八十,并不(bu)得低(di)于(yu)用人單(dan)位(wei)所(suo)在地(di)的(de)(de)最 低(di)工(gong)(gong)資標(biao)準(zhun)。”你雖然未完成銷(xiao)售額,但(dan)是已(yi)經付出努力和常常勞(lao)動,公(gong)司(si)付給你的(de)(de)工(gong)(gong)資也(ye)不(bu)得低(di)于(yu)所(suo)在地(di)的(de)(de)最低(di)工(gong)(gong)資標(biao)準(zhun),拒(ju)付工(gong)(gong)資是不(bu)合(he)理的(de)(de)。
