公司以未完成銷售額為由拒付工資合法嗎?

問 上個月(yue),我(wo)一直(zhi)很(hen)努力的工作,但是還是沒(mei)有完成銷(xiao)售額,公司領(ling)導很(hen)生氣,以(yi)未完成銷(xiao)售額為由(you)拒絕發給我(wo)工資,公司這么(me)做(zuo)合法嗎?
答 《勞(lao)動合同(tong)(tong)法》第20條規定:“勞(lao)動者(zhe)(zhe)在試用(yong)期的(de)工(gong)(gong)資(zi)不(bu)得低(di)于(yu)本單(dan)位(wei)相同(tong)(tong)崗位(wei) 最低(di)檔(dang)工(gong)(gong)資(zi)或者(zhe)(zhe)勞(lao)動合同(tong)(tong)約定工(gong)(gong)資(zi)的(de)百(bai)分(fen)之八十,并不(bu)得低(di)于(yu)用(yong)人單(dan)位(wei)所在地的(de)最 低(di)工(gong)(gong)資(zi)標(biao)準。”你雖然(ran)未完成銷售額,但是(shi)已(yi)經付出努力和常常勞(lao)動,公司付給你的(de)工(gong)(gong)資(zi)也(ye)不(bu)得低(di)于(yu)所在地的(de)最低(di)工(gong)(gong)資(zi)標(biao)準,拒付工(gong)(gong)資(zi)是(shi)不(bu)合理(li)的(de)。
