標準工作時間以外的加班應該給多少工資?

答 《工(gong)(gong)(gong)(gong)(gong)資(zi)支(zhi)(zhi)付(fu)暫行(xing)規定》規定,用(yong)人單位(wei)依法安(an)排(pai)勞動(dong)者在標(biao)準(zhun)工(gong)(gong)(gong)(gong)(gong)作(zuo)時(shi)間以(yi)外(wai)工(gong)(gong)(gong)(gong)(gong)作(zuo)的,應(ying)(ying)當按照下列標(biao)準(zhun)支(zhi)(zhi)付(fu)勞動(dong)者加班(ban)工(gong)(gong)(gong)(gong)(gong)資(zi): (1)在日標(biao)準(zhun)工(gong)(gong)(gong)(gong)(gong)作(zuo)時(shi)間以(yi)外(wai)延長(chang)工(gong)(gong)(gong)(gong)(gong)作(zuo)時(shi)間的,按照不低于小時(shi)工(gong)(gong)(gong)(gong)(gong)資(zi)基數的150%支(zhi)(zhi)付(fu)加班(ban)工(gong)(gong)(gong)(gong)(gong)資(zi); (2)在休息日工(gong)(gong)(gong)(gong)(gong)作(zuo)的,應(ying)(ying)當安(an)排(pai)其同等時(shi)間的補休,不能安(an)排(pai)補休的,按照不低于日或(huo)者小時(shi)工(gong)(gong)(gong)(gong)(gong)資(zi)基數的200%支(zhi)(zhi)付(fu)加班(ban)工(gong)(gong)(gong)(gong)(gong)資(zi); (3)在法定休假日工(gong)(gong)(gong)(gong)(gong)作(zuo)的,應(ying)(ying)當按照不低于日或(huo)者小時(shi)工(gong)(gong)(gong)(gong)(gong)資(zi)基數的300%支(zhi)(zhi)付(fu)加班(ban)工(gong)(gong)(gong)(gong)(gong)資(zi)。
