“末位淘汰”制度合法嗎?

我是一名銷售員,現在(zai)正在(zai)濟(ji)南一家(jia)藥械銷售公司工作(zuo),“末位淘汰(tai)”制度(du)合法(fa)嗎?

“末位(wei)(wei)(wei)(wei)淘汰(tai)(tai)”作為一(yi)(yi)項企(qi)事業單(dan)位(wei)(wei)(wei)(wei)內部的(de)考核辦法,作為一(yi)(yi)種(zhong)激勵(li)機制,并不與法相悖。但如果把“末位(wei)(wei)(wei)(wei)淘汰(tai)(tai)”制度用(yong)到聘(pin)用(yong)關(guan)(guan)系(xi)上,凡是“末位(wei)(wei)(wei)(wei)”,不分(fen)青紅皂白(bai)就予以(yi)(yi)淘汰(tai)(tai)的(de)做法是值得(de)質疑的(de)。 這(zhe)里通常有(you)兩種(zhong)情(qing)況: 一(yi)(yi)是雙(shuang)方在勞(lao)動(dong)合(he)(he)同(tong)(tong)中約定(ding)(ding),單(dan)位(wei)(wei)(wei)(wei)可以(yi)(yi)以(yi)(yi)“末位(wei)(wei)(wei)(wei)淘汰(tai)(tai)”來解(jie)聘(pin)職工(gong),當(dang)出(chu)現“末位(wei)(wei)(wei)(wei)”情(qing)形時(shi),按約解(jie)除合(he)(he)同(tong)(tong)關(guan)(guan)系(xi),不存在什么問題(ti)。 二雙(shuang)方并沒有(you)在勞(lao)動(dong)合(he)(he)同(tong)(tong)中約定(ding)(ding)這(zhe)一(yi)(yi)條,單(dan)位(wei)(wei)(wei)(wei)單(dan)方面(mian)以(yi)(yi)“末位(wei)(wei)(wei)(wei)淘汰(tai)(tai)”為由解(jie)除合(he)(he)同(tong)(tong)關(guan)(guan)系(xi),就于法不符(fu)。 根(gen)據《勞(lao)動(dong)合(he)(he)同(tong)(tong)法》規定(ding)(ding),勞(lao)動(dong)者(zhe)不能(neng)勝任(ren)工(gong)作,單(dan)位(wei)(wei)(wei)(wei)首(shou)先要給予培訓或者(zhe)調(diao)整工(gong)作崗(gang)位(wei)(wei)(wei)(wei),勞(lao)動(dong)者(zhe)仍不能(neng)勝任(ren)工(gong)作的(de),單(dan)位(wei)(wei)(wei)(wei)才(cai)可以(yi)(yi)解(jie)除勞(lao)動(dong)合(he)(he)同(tong)(tong),還要給予經濟補(bu)償。這(zhe)一(yi)(yi)規定(ding)(ding)就給予了職工(gong)一(yi)(yi)個(ge)培訓和調(diao)整工(gong)作崗(gang)位(wei)(wei)(wei)(wei)的(de)過(guo)程。
