“末位淘汰”制度合法嗎?

我是一名銷(xiao)售(shou)員,現在(zai)(zai)正在(zai)(zai)濟南一家藥械銷(xiao)售(shou)公司(si)工(gong)作,“末位淘汰”制度(du)合法嗎?

“末位(wei)(wei)(wei)(wei)淘汰”作為一項(xiang)企事業單(dan)(dan)位(wei)(wei)(wei)(wei)內部的(de)(de)考核辦法,作為一種(zhong)激勵機制(zhi),并(bing)不(bu)與法相悖(bei)。但(dan)如(ru)果把(ba)“末位(wei)(wei)(wei)(wei)淘汰”制(zhi)度用到聘用關(guan)系(xi)上(shang),凡是(shi)“末位(wei)(wei)(wei)(wei)”,不(bu)分青(qing)紅皂白就予(yu)以淘汰的(de)(de)做法是(shi)值得質疑的(de)(de)。 這(zhe)里通常有(you)兩種(zhong)情(qing)況: 一是(shi)雙(shuang)方(fang)在(zai)勞動合(he)(he)同(tong)(tong)中約定,單(dan)(dan)位(wei)(wei)(wei)(wei)可以以“末位(wei)(wei)(wei)(wei)淘汰”來解聘職(zhi)工,當出現“末位(wei)(wei)(wei)(wei)”情(qing)形時(shi),按約解除(chu)合(he)(he)同(tong)(tong)關(guan)系(xi),不(bu)存(cun)在(zai)什么問題。 二雙(shuang)方(fang)并(bing)沒有(you)在(zai)勞動合(he)(he)同(tong)(tong)中約定這(zhe)一條,單(dan)(dan)位(wei)(wei)(wei)(wei)單(dan)(dan)方(fang)面以“末位(wei)(wei)(wei)(wei)淘汰”為由解除(chu)合(he)(he)同(tong)(tong)關(guan)系(xi),就于法不(bu)符(fu)。 根(gen)據《勞動合(he)(he)同(tong)(tong)法》規(gui)(gui)定,勞動者不(bu)能(neng)勝(sheng)任工作,單(dan)(dan)位(wei)(wei)(wei)(wei)首先要(yao)(yao)給予(yu)培(pei)(pei)訓或(huo)者調整工作崗(gang)位(wei)(wei)(wei)(wei),勞動者仍不(bu)能(neng)勝(sheng)任工作的(de)(de),單(dan)(dan)位(wei)(wei)(wei)(wei)才可以解除(chu)勞動合(he)(he)同(tong)(tong),還(huan)要(yao)(yao)給予(yu)經(jing)濟補償。這(zhe)一規(gui)(gui)定就給予(yu)了(le)職(zhi)工一個培(pei)(pei)訓和(he)調整工作崗(gang)位(wei)(wei)(wei)(wei)的(de)(de)過程。
