山東省聊城將推農民工實名制工資卡管理

記者從11日召開的全市構建和諧勞動關系工作會議上了解到,為扎實做好構建和諧勞動關系的各項工作,聊城市將著力解決好當前勞動關系的三項重點工作。為及時處理拖欠農民工工資問題,將在建設領域和欠薪多發行業普遍建立用人單位繳納工作保證金制度,在欠薪多發的部分縣(市、區)建立完善欠薪應急周轉金制度。

市(shi)人(ren)社局相關(guan)負責人(ren)表示,今后將(jiang)日常(chang)巡查(cha)和重點檢查(cha)相結合(he),及時(shi)處理(li)(li)(li)(li)拖(tuo)欠(qian)農(nong)(nong)民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)問題(ti)(ti)。積(ji)極開展農(nong)(nong)民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)支(zhi)付、清(qing)理(li)(li)(li)(li)整頓人(ren)力資(zi)源市(shi)場、勞動(dong)(dong)用工(gong)(gong)(gong)(gong)(gong)與(yu)社會保(bao)(bao)險等專(zhuan)項執法(fa)檢查(cha)。進一步擴大勞動(dong)(dong)保(bao)(bao)障(zhang)年檢、日常(chang)巡查(cha)范(fan)圍(wei),及時(shi)受(shou)理(li)(li)(li)(li)勞動(dong)(dong)者投訴舉報(bao),處理(li)(li)(li)(li)好(hao)勞動(dong)(dong)者的利益訴求。妥善(shan)處理(li)(li)(li)(li)拖(tuo)欠(qian)農(nong)(nong)民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)問題(ti)(ti),在建(jian)設領域和欠(qian)薪多發行業普遍建(jian)立用人(ren)單位繳納工(gong)(gong)(gong)(gong)(gong)作保(bao)(bao)證金制度(du),在欠(qian)薪多發的部分(fen)縣(市(shi)、區)建(jian)立完善(shan)欠(qian)薪應急周轉金制度(du),全面推(tui)行農(nong)(nong)民工(gong)(gong)(gong)(gong)(gong)實名制工(gong)(gong)(gong)(gong)(gong)資(zi)卡管理(li)(li)(li)(li),督促企業落實按(an)月足(zu)額支(zhi)付工(gong)(gong)(gong)(gong)(gong)資(zi)的有關(guan)法(fa)律(lv)規定(ding)。建(jian)立勞動(dong)(dong)保(bao)(bao)障(zhang)監察執法(fa)和刑事(shi)司法(fa)聯動(dong)(dong)機制,嚴厲打(da)擊惡意欠(qian)薪行為,切實解決拖(tuo)欠(qian)職(zhi)工(gong)(gong)(gong)(gong)(gong)特別是農(nong)(nong)民工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)問題(ti)(ti)。

其(qi)次,將(jiang)抓好“兩網(wang)(wang)(wang)化(hua)”建設工(gong)作(zuo)(zuo)。強化(hua)措施,通過(guo)調度、考評(ping)等方式,確保(bao)市縣兩級實現“兩網(wang)(wang)(wang)化(hua)”100%全覆蓋。完善“兩網(wang)(wang)(wang)化(hua)”規(gui)范化(hua)建設,積極做好全省聯(lian)網(wang)(wang)(wang)統一受理(li)(li)和(he)查處投訴舉報案(an)件的相關工(gong)作(zuo)(zuo),建立(li)協(xie)管員管理(li)(li)制度、用(yong)工(gong)信息采集制度、網(wang)(wang)(wang)格巡查等相關制度,明確工(gong)作(zuo)(zuo)職(zhi)責,規(gui)范工(gong)作(zuo)(zuo)程序,做好系(xi)統更新維護,為(wei)實現全省統一聯(lian)網(wang)(wang)(wang)的有效銜接打好基礎。

此外(wai),將大力推進(jin)同(tong)工(gong)同(tong)酬(chou)分(fen)配原(yuan)則落實。加(jia)大工(gong)作力度(du),規范勞務派遣經營行為,引導督促用(yong)人單位按照法律(lv)要求(qiu)調整用(yong)工(gong)比例,依法及時(shi)繳納社會(hui)(hui)保(bao)(bao)險,對(dui)只交一項(xiang)工(gong)傷保(bao)(bao)險或侵犯(fan)派遣人員權益的(de)情況要嚴格(ge)(ge)管控和(he)檢(jian)查(cha),維護(hu)好勞務派遣職工(gong)的(de)合(he)法權益。嚴格(ge)(ge)落實機關事業單位未(wei)納入(ru)正式職工(gong)管理(li)人員的(de)有關規定,逐步(bu)提高他們的(de)收入(ru)水平,全(quan)面落實這(zhe)部分(fen)人員參加(jia)社會(hui)(hui)保(bao)(bao)險政策,切實維護(hu)其合(he)法權益。

全面實行勞動合同制度 健全勞(lao)動關系(xi)協調機(ji)制

今后,我市將全面實行(xing)(xing)(xing)(xing)(xing)勞動(dong)(dong)合(he)(he)同制度(du)。繼續加大(da)工(gong)作力度(du),在用工(gong)季節性強(qiang)、職(zhi)工(gong)流(liu)動(dong)(dong)性大(da)的(de)(de)行(xing)(xing)(xing)(xing)(xing)業(ye)推廣(guang)簡易(yi)勞動(dong)(dong)合(he)(he)同示范文本,規范勞動(dong)(dong)合(he)(he)同訂(ding)立、履(lv)行(xing)(xing)(xing)(xing)(xing)、變更、解除、終止等(deng)行(xing)(xing)(xing)(xing)(xing)為,切實提高勞動(dong)(dong)合(he)(he)同簽訂(ding)率和履(lv)行(xing)(xing)(xing)(xing)(xing)質(zhi)量。深入實施農民工(gong)權益保(bao)障3年行(xing)(xing)(xing)(xing)(xing)動(dong)(dong)計劃,確保(bao)在城(cheng)鎮穩定就業(ye)的(de)(de)農民工(gong)勞動(dong)(dong)合(he)(he)同簽訂(ding)率達到85%以上(shang),建筑、餐飲、居民服務等(deng)流(liu)動(dong)(dong)性較強(qiang)的(de)(de)行(xing)(xing)(xing)(xing)(xing)業(ye)農民工(gong)勞動(dong)(dong)合(he)(he)同簽訂(ding)率達到55%以上(shang)。

大力推進集(ji)體(ti)合(he)(he)同制(zhi)度。著力提升集(ji)體(ti)協(xie)商質量,增(zeng)強集(ji)體(ti)合(he)(he)同實(shi)效(xiao),逐步形(xing)成規(gui)范有效(xiao)的集(ji)體(ti)協(xie)商機制(zhi),暢通職(zhi)工(gong)利益訴求表達渠(qu)道。扎實(shi)推進集(ji)體(ti)合(he)(he)同制(zhi)度三年行(xing)動攻堅計劃,推動企業與職(zhi)工(gong)就工(gong)作(zuo)條件(jian)、勞動定額(e)、女職(zhi)工(gong)特殊(shu)保護等開展集(ji)體(ti)協(xie)商,訂立集(ji)體(ti)合(he)(he)同。加強對集(ji)體(ti)協(xie)商過程的指(zhi)導,督促企業和職(zhi)工(gong)認真履行(xing)集(ji)體(ti)合(he)(he)同。

此外,將進(jin)一步健全協(xie)調(diao)勞(lao)動關(guan)(guan)(guan)(guan)系(xi)(xi)三(san)(san)方(fang)機制(zhi)。在完善(shan)(shan)市、縣協(xie)調(diao)勞(lao)動關(guan)(guan)(guan)(guan)系(xi)(xi)三(san)(san)方(fang)機制(zhi)基礎上,積極推(tui)動有條件的(de)工業園區、鄉鎮(zhen)(街道)和(he)產業系(xi)(xi)統(tong)建立(li)三(san)(san)方(fang)機制(zhi)。創新三(san)(san)方(fang)機制(zhi)組(zu)織建設,建立(li)協(xie)調(diao)勞(lao)動關(guan)(guan)(guan)(guan)系(xi)(xi)三(san)(san)方(fang)委員會,逐步做(zuo)實三(san)(san)方(fang)機制(zhi)的(de)辦(ban)事機構。完善(shan)(shan)三(san)(san)方(fang)機制(zhi)職能,加強工作制(zhi)度建設,充(chong)分發揮政府、工會和(he)企業代表組(zu)織共同研(yan)究解(jie)決有關(guan)(guan)(guan)(guan)勞(lao)動關(guan)(guan)(guan)(guan)系(xi)(xi)重(zhong)大問(wen)題的(de)重(zhong)要作用(yong)。

完善勞動關系矛盾調處機制

為(wei)了更進一步推進構建和諧(xie)勞(lao)動關系(xi)(xi)工作,我市將完善(shan)勞(lao)動關系(xi)(xi)矛盾調(diao)處機制。

健(jian)全勞動(dong)(dong)爭議(yi)(yi)調(diao)(diao)(diao)解(jie)(jie)仲(zhong)裁(cai)機制。堅(jian)持(chi)“鼓(gu)勵(li)和解(jie)(jie)、強化(hua)調(diao)(diao)(diao)解(jie)(jie)、加(jia)(jia)快仲(zhong)裁(cai)、銜接訴訟”原則(ze),大力(li)(li)加(jia)(jia)強勞動(dong)(dong)爭議(yi)(yi)調(diao)(diao)(diao)解(jie)(jie)工作(zuo),健(jian)全專業性調(diao)(diao)(diao)解(jie)(jie)與(yu)人民(min)調(diao)(diao)(diao)解(jie)(jie)、行政(zheng)調(diao)(diao)(diao)解(jie)(jie)、仲(zhong)裁(cai)調(diao)(diao)(diao)解(jie)(jie)、司法調(diao)(diao)(diao)解(jie)(jie)聯動(dong)(dong)工作(zuo)體系。深入推(tui)進示(shi)范(fan)仲(zhong)裁(cai)院創建(jian)活(huo)(huo)動(dong)(dong)和調(diao)(diao)(diao)解(jie)(jie)仲(zhong)裁(cai)效能(neng)建(jian)設督查(cha)活(huo)(huo)動(dong)(dong),提升仲(zhong)裁(cai)工作(zuo)標準化(hua)、規范(fan)化(hua)、專業化(hua)水平;加(jia)(jia)強基層調(diao)(diao)(diao)解(jie)(jie)規范(fan)化(hua)建(jian)設,完善區域性、行業性調(diao)(diao)(diao)解(jie)(jie)組(zu)織和工作(zuo)機制,提高企業自主解(jie)(jie)決爭議(yi)(yi)能(neng)力(li)(li);依法加(jia)(jia)大先行裁(cai)決、先予執行裁(cai)決、終(zhong)局(ju)裁(cai)決力(li)(li)度,不斷提高爭議(yi)(yi)處理效能(neng);加(jia)(jia)強裁(cai)審銜接與(yu)工作(zuo)協(xie)調(diao)(diao)(diao),切實提高仲(zhong)裁(cai)辦案效率和公信力(li)(li)。

健(jian)全(quan)勞動(dong)(dong)(dong)保障監察(cha)體(ti)制機制。改(gai)革勞動(dong)(dong)(dong)保障監察(cha)執(zhi)(zhi)(zhi)法(fa)體(ti)制,加快推進(jin)綜合執(zhi)(zhi)(zhi)法(fa),理順(shun)不同層級執(zhi)(zhi)(zhi)法(fa)職能(neng),全(quan)力推動(dong)(dong)(dong)監察(cha)執(zhi)(zhi)(zhi)法(fa)重心下移。強化縣以下勞動(dong)(dong)(dong)保障執(zhi)(zhi)(zhi)法(fa)能(neng)力建(jian)設(she),實(shi)現監察(cha)執(zhi)(zhi)(zhi)法(fa)向主動(dong)(dong)(dong)預防(fang)和統籌城鄉轉變。加大對非法(fa)用工尤其是大案(an)(an)要(yao)案(an)(an)的查處(chu)力度,嚴厲打(da)擊(ji)使(shi)用童工、拒不支付勞動(dong)(dong)(dong)報酬等違法(fa)犯罪行(xing)為。完(wan)善企業(ye)(ye)勞動(dong)(dong)(dong)保障誠信評價(jia)制度,組織好誠信企業(ye)(ye)評選(xuan)活(huo)動(dong)(dong)(dong),建(jian)立健(jian)全(quan)企業(ye)(ye)誠信檔案(an)(an)。

完善勞動(dong)關(guan)系群(qun)體(ti)性(xing)事件預(yu)防和應(ying)急處(chu)置機(ji)制(zhi)(zhi)。依(yi)托(tuo)協(xie)調(diao)勞動(dong)關(guan)系三方機(ji)制(zhi)(zhi),建立勞動(dong)關(guan)系群(qun)體(ti)性(xing)糾(jiu)紛排(pai)查和動(dong)態監測預(yu)警制(zhi)(zhi)度,完善協(xie)調(diao)處(chu)理集(ji)體(ti)協(xie)商爭議(yi)辦法(fa),有效調(diao)處(chu)因簽訂集(ji)體(ti)合同發生(sheng)的爭議(yi)事件。健全多部門共(gong)同參與的群(qun)體(ti)性(xing)事件應(ying)急聯動(dong)處(chu)置機(ji)制(zhi)(zhi),督促指導企業落實主體(ti)責任,及時妥善處(chu)置群(qun)體(ti)性(xing)事件,維護社(she)會(hui)和諧穩定(ding)。

今年以來解決拖欠工資4410萬元

記者從11日召開的(de)全市構(gou)建和諧勞(lao)(lao)(lao)動關系(xi)(xi)工(gong)作(zuo)會(hui)議上了(le)解到(dao),近年(nian)來(lai),全市勞(lao)(lao)(lao)動關系(xi)(xi)工(gong)作(zuo)逐(zhu)步(bu)由(you)注重(zhong)治(zhi)標向標本(ben)兼治(zhi)轉變,勞(lao)(lao)(lao)動關系(xi)(xi)保持總(zong)體穩定。今年(nian)以來(lai),全市各級勞(lao)(lao)(lao)動保障(zhang)監(jian)察機構(gou)受理投訴(su)、舉(ju)報(bao)295起,督促用人(ren)單位與(yu)6397名職工(gong)簽訂勞(lao)(lao)(lao)動合同,解決拖欠(qian)工(gong)資4410萬元,補(bu)繳社會(hui)保險(xian)費6623.66萬元;勞(lao)(lao)(lao)動人(ren)事調解仲裁(cai)機構(gou)處理爭議案件464件,為勞(lao)(lao)(lao)動者挽回損(sun)失(shi)1533.97元,切實維護(hu)了(le)職工(gong)的(de)合法權益。
