山東省聊城將推農民工實名制工資卡管理

記者從11日召開的全市構建和諧勞動關系工作會議上了解到,為扎實做好構建和諧勞動關系的各項工作,聊城市將著力解決好當前勞動關系的三項重點工作。為及時處理拖欠農民工工資問題,將在建設領域和欠薪多發行業普遍建立用人單位繳納工作保證金制度,在欠薪多發的部分縣(市、區)建立完善欠薪應急周轉金制度。

市(shi)(shi)人(ren)社局(ju)相關(guan)(guan)負責人(ren)表示,今后將日常(chang)(chang)巡查(cha)和(he)(he)重(zhong)點(dian)檢(jian)(jian)查(cha)相結(jie)合,及時處理(li)拖(tuo)欠(qian)(qian)農(nong)(nong)民(min)(min)工(gong)工(gong)資問題(ti)。積(ji)極開展農(nong)(nong)民(min)(min)工(gong)工(gong)資支付(fu)、清理(li)整頓人(ren)力資源市(shi)(shi)場(chang)、勞(lao)動(dong)用(yong)工(gong)與社會保(bao)險(xian)等專項執法(fa)檢(jian)(jian)查(cha)。進一步擴大勞(lao)動(dong)保(bao)障年(nian)檢(jian)(jian)、日常(chang)(chang)巡查(cha)范圍,及時受理(li)勞(lao)動(dong)者投訴舉報,處理(li)好勞(lao)動(dong)者的(de)(de)利益(yi)訴求。妥善處理(li)拖(tuo)欠(qian)(qian)農(nong)(nong)民(min)(min)工(gong)工(gong)資問題(ti),在建(jian)設領域和(he)(he)欠(qian)(qian)薪(xin)多發行(xing)(xing)業普遍建(jian)立(li)用(yong)人(ren)單位繳納(na)工(gong)作保(bao)證(zheng)金制(zhi)度,在欠(qian)(qian)薪(xin)多發的(de)(de)部分縣(市(shi)(shi)、區)建(jian)立(li)完善欠(qian)(qian)薪(xin)應急周轉金制(zhi)度,全面推(tui)行(xing)(xing)農(nong)(nong)民(min)(min)工(gong)實名制(zhi)工(gong)資卡管理(li),督促(cu)企業落(luo)實按(an)月足(zu)額支付(fu)工(gong)資的(de)(de)有關(guan)(guan)法(fa)律規定(ding)。建(jian)立(li)勞(lao)動(dong)保(bao)障監察執法(fa)和(he)(he)刑(xing)事司法(fa)聯動(dong)機制(zhi),嚴厲打(da)擊惡意欠(qian)(qian)薪(xin)行(xing)(xing)為,切實解決拖(tuo)欠(qian)(qian)職(zhi)工(gong)特別是農(nong)(nong)民(min)(min)工(gong)工(gong)資問題(ti)。

其次,將抓好“兩(liang)網(wang)化(hua)(hua)(hua)”建(jian)設(she)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)。強化(hua)(hua)(hua)措施,通(tong)過調(diao)度(du)、考評等(deng)(deng)方(fang)式,確保市(shi)縣兩(liang)級實(shi)現“兩(liang)網(wang)化(hua)(hua)(hua)”100%全覆蓋。完善“兩(liang)網(wang)化(hua)(hua)(hua)”規(gui)范化(hua)(hua)(hua)建(jian)設(she),積(ji)極(ji)做(zuo)好全省聯網(wang)統一(yi)受(shou)理和查(cha)處投訴(su)舉報案件的(de)(de)相關工(gong)(gong)作(zuo)(zuo)(zuo)(zuo),建(jian)立協(xie)管員管理制度(du)、用工(gong)(gong)信息采集(ji)制度(du)、網(wang)格巡查(cha)等(deng)(deng)相關制度(du),明確工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)職責(ze),規(gui)范工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)程序,做(zuo)好系統更(geng)新(xin)維護,為(wei)實(shi)現全省統一(yi)聯網(wang)的(de)(de)有(you)效銜接打好基礎。

此外,將大(da)力推進同工(gong)同酬分配(pei)原(yuan)則落(luo)實(shi)(shi)(shi)。加大(da)工(gong)作(zuo)力度,規范勞(lao)務派(pai)(pai)遣(qian)經營(ying)行(xing)為,引導督促用(yong)人(ren)(ren)單(dan)位(wei)按(an)照法(fa)律要求(qiu)調整用(yong)工(gong)比例,依法(fa)及時繳(jiao)納社會保險,對只交一項工(gong)傷保險或侵(qin)犯派(pai)(pai)遣(qian)人(ren)(ren)員(yuan)權(quan)益(yi)的情(qing)況要嚴格管控和(he)檢(jian)查,維護好勞(lao)務派(pai)(pai)遣(qian)職(zhi)工(gong)的合(he)法(fa)權(quan)益(yi)。嚴格落(luo)實(shi)(shi)(shi)機關(guan)事業單(dan)位(wei)未納入正(zheng)式職(zhi)工(gong)管理人(ren)(ren)員(yuan)的有關(guan)規定,逐(zhu)步提高他們的收入水平(ping),全面落(luo)實(shi)(shi)(shi)這(zhe)部分人(ren)(ren)員(yuan)參加社會保險政策,切實(shi)(shi)(shi)維護其合(he)法(fa)權(quan)益(yi)。

全面實行勞動合同制度 健全(quan)勞動關系協調機制(zhi)

今后,我市將全面實行(xing)勞(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)制(zhi)度(du)。繼續加(jia)大工作力度(du),在用工季節性強、職工流(liu)(liu)動(dong)(dong)性大的(de)行(xing)業(ye)推(tui)廣(guang)簡易勞(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)示(shi)范文(wen)本,規(gui)范勞(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)訂立、履(lv)行(xing)、變更、解除、終止等行(xing)為(wei),切(qie)實提高勞(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)簽(qian)訂率和履(lv)行(xing)質量。深入(ru)實施農民工權(quan)益保障3年行(xing)動(dong)(dong)計劃,確保在城鎮穩定(ding)就業(ye)的(de)農民工勞(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)簽(qian)訂率達到85%以(yi)上,建(jian)筑、餐飲、居(ju)民服務等流(liu)(liu)動(dong)(dong)性較強的(de)行(xing)業(ye)農民工勞(lao)(lao)動(dong)(dong)合(he)(he)(he)同(tong)簽(qian)訂率達到55%以(yi)上。

大(da)力推進集(ji)體(ti)(ti)合(he)同制度(du)(du)。著(zhu)力提升集(ji)體(ti)(ti)協(xie)商(shang)質量,增強集(ji)體(ti)(ti)合(he)同實效(xiao)(xiao),逐步形成規范有效(xiao)(xiao)的集(ji)體(ti)(ti)協(xie)商(shang)機制,暢通(tong)職(zhi)工(gong)利益(yi)訴求表達渠道。扎實推進集(ji)體(ti)(ti)合(he)同制度(du)(du)三年行動攻堅(jian)計劃,推動企業與(yu)職(zhi)工(gong)就工(gong)作(zuo)條(tiao)件、勞動定額、女職(zhi)工(gong)特殊保護等(deng)開(kai)展集(ji)體(ti)(ti)協(xie)商(shang),訂立集(ji)體(ti)(ti)合(he)同。加強對集(ji)體(ti)(ti)協(xie)商(shang)過(guo)程的指導(dao),督促企業和職(zhi)工(gong)認真履行集(ji)體(ti)(ti)合(he)同。

此外,將進一步健全協調(diao)(diao)(diao)勞動(dong)關(guan)系(xi)三方(fang)(fang)機(ji)(ji)制(zhi)(zhi)。在完善市(shi)、縣協調(diao)(diao)(diao)勞動(dong)關(guan)系(xi)三方(fang)(fang)機(ji)(ji)制(zhi)(zhi)基礎(chu)上,積極推動(dong)有(you)條件的(de)工(gong)業園區、鄉鎮(街道(dao))和產業系(xi)統建立三方(fang)(fang)機(ji)(ji)制(zhi)(zhi)。創新三方(fang)(fang)機(ji)(ji)制(zhi)(zhi)組織建設,建立協調(diao)(diao)(diao)勞動(dong)關(guan)系(xi)三方(fang)(fang)委員會,逐步做(zuo)實三方(fang)(fang)機(ji)(ji)制(zhi)(zhi)的(de)辦事機(ji)(ji)構(gou)。完善三方(fang)(fang)機(ji)(ji)制(zhi)(zhi)職能,加強工(gong)作制(zhi)(zhi)度建設,充(chong)分發揮(hui)政府(fu)、工(gong)會和企(qi)業代(dai)表組織共同研究解決有(you)關(guan)勞動(dong)關(guan)系(xi)重(zhong)大問題的(de)重(zhong)要作用。

完善勞動關系矛盾調處機制

為了更(geng)進一步推進構建和諧(xie)勞動關(guan)系工作,我市將完善勞動關(guan)系矛盾調處機制。

健全勞動(dong)爭(zheng)議(yi)調(diao)(diao)解(jie)仲裁(cai)(cai)機制。堅持“鼓(gu)勵和解(jie)、強(qiang)化(hua)(hua)調(diao)(diao)解(jie)、加(jia)快仲裁(cai)(cai)、銜接(jie)訴訟(song)”原(yuan)則,大力(li)加(jia)強(qiang)勞動(dong)爭(zheng)議(yi)調(diao)(diao)解(jie)工(gong)(gong)作(zuo),健全專(zhuan)業(ye)性調(diao)(diao)解(jie)與人民調(diao)(diao)解(jie)、行政(zheng)調(diao)(diao)解(jie)、仲裁(cai)(cai)調(diao)(diao)解(jie)、司(si)法調(diao)(diao)解(jie)聯(lian)動(dong)工(gong)(gong)作(zuo)體系。深入推進(jin)示(shi)范仲裁(cai)(cai)院創建活動(dong)和調(diao)(diao)解(jie)仲裁(cai)(cai)效能(neng)建設(she)督(du)查活動(dong),提(ti)(ti)升仲裁(cai)(cai)工(gong)(gong)作(zuo)標準化(hua)(hua)、規范化(hua)(hua)、專(zhuan)業(ye)化(hua)(hua)水平;加(jia)強(qiang)基層調(diao)(diao)解(jie)規范化(hua)(hua)建設(she),完善區域性、行業(ye)性調(diao)(diao)解(jie)組織和工(gong)(gong)作(zuo)機制,提(ti)(ti)高(gao)企業(ye)自主解(jie)決爭(zheng)議(yi)能(neng)力(li);依法加(jia)大先(xian)行裁(cai)(cai)決、先(xian)予執行裁(cai)(cai)決、終局裁(cai)(cai)決力(li)度,不斷提(ti)(ti)高(gao)爭(zheng)議(yi)處(chu)理效能(neng);加(jia)強(qiang)裁(cai)(cai)審銜接(jie)與工(gong)(gong)作(zuo)協調(diao)(diao),切實提(ti)(ti)高(gao)仲裁(cai)(cai)辦案效率和公信力(li)。

健全(quan)勞動保(bao)(bao)障監(jian)察體(ti)制(zhi)(zhi)機制(zhi)(zhi)。改(gai)革勞動保(bao)(bao)障監(jian)察執(zhi)法(fa)(fa)體(ti)制(zhi)(zhi),加快推(tui)進(jin)綜合執(zhi)法(fa)(fa),理順不(bu)同層級執(zhi)法(fa)(fa)職能(neng)(neng),全(quan)力(li)推(tui)動監(jian)察執(zhi)法(fa)(fa)重心下移。強化縣以下勞動保(bao)(bao)障執(zhi)法(fa)(fa)能(neng)(neng)力(li)建設,實現監(jian)察執(zhi)法(fa)(fa)向主動預防和(he)統籌城鄉轉變(bian)。加大(da)對非法(fa)(fa)用工(gong)尤其(qi)是大(da)案(an)要案(an)的(de)查處力(li)度,嚴(yan)厲(li)打擊使用童工(gong)、拒不(bu)支付勞動報酬等違法(fa)(fa)犯罪行為(wei)。完善(shan)企(qi)業(ye)勞動保(bao)(bao)障誠(cheng)信評(ping)價制(zhi)(zhi)度,組織好誠(cheng)信企(qi)業(ye)評(ping)選活動,建立健全(quan)企(qi)業(ye)誠(cheng)信檔案(an)。

完善勞動關(guan)(guan)系群(qun)(qun)體(ti)性(xing)事件(jian)預(yu)防和(he)應急處(chu)(chu)(chu)置機(ji)制。依托(tuo)協調(diao)(diao)勞動關(guan)(guan)系三方機(ji)制,建立勞動關(guan)(guan)系群(qun)(qun)體(ti)性(xing)糾紛(fen)排(pai)查(cha)和(he)動態監測預(yu)警制度(du),完善協調(diao)(diao)處(chu)(chu)(chu)理集體(ti)協商爭(zheng)議辦法(fa),有(you)效調(diao)(diao)處(chu)(chu)(chu)因簽訂集體(ti)合同(tong)發生的(de)爭(zheng)議事件(jian)。健全(quan)多部門共(gong)同(tong)參與的(de)群(qun)(qun)體(ti)性(xing)事件(jian)應急聯(lian)動處(chu)(chu)(chu)置機(ji)制,督促指導(dao)企業落實主(zhu)體(ti)責任,及時妥善處(chu)(chu)(chu)置群(qun)(qun)體(ti)性(xing)事件(jian),維護社會和(he)諧穩定。

今年以來解決拖欠工資4410萬元

記(ji)者從(cong)11日(ri)召開(kai)的全市(shi)構建和(he)諧勞(lao)動(dong)關(guan)系(xi)工(gong)(gong)作會議(yi)(yi)上了(le)解到(dao),近年來,全市(shi)勞(lao)動(dong)關(guan)系(xi)工(gong)(gong)作逐步由注重(zhong)治標(biao)向(xiang)標(biao)本兼治轉變,勞(lao)動(dong)關(guan)系(xi)保(bao)(bao)持總(zong)體(ti)穩定。今年以(yi)來,全市(shi)各級勞(lao)動(dong)保(bao)(bao)障監(jian)察機構受理(li)投訴、舉(ju)報(bao)295起,督(du)促(cu)用人單位與6397名(ming)職(zhi)工(gong)(gong)簽訂勞(lao)動(dong)合(he)同,解決拖欠(qian)工(gong)(gong)資4410萬(wan)元(yuan),補(bu)繳社會保(bao)(bao)險費(fei)6623.66萬(wan)元(yuan);勞(lao)動(dong)人事調(diao)解仲(zhong)裁機構處(chu)理(li)爭(zheng)議(yi)(yi)案件464件,為勞(lao)動(dong)者挽回(hui)損(sun)失1533.97元(yuan),切實維護(hu)了(le)職(zhi)工(gong)(gong)的合(he)法權益。
