山東青島醫療期管理規定3月起實施 明確病假工資

日前,山東(dong)省青島(dao)(dao)市(shi)人社局發布勞動者患病或者非因(yin)工負傷醫(yi)(yi)(yi)療(liao)(liao)期(qi)管理規定(以下簡稱《醫(yi)(yi)(yi)療(liao)(liao)期(qi)規定》),擴大了醫(yi)(yi)(yi)療(liao)(liao)期(qi)適用范圍(wei),明(ming)確了醫(yi)(yi)(yi)療(liao)(liao)期(qi)期(qi)限及累計計算辦法等(deng)問(wen)題,進一步規范青島(dao)(dao)市(shi)醫(yi)(yi)(yi)療(liao)(liao)期(qi)管理,維護勞動者和用人單位合(he)法權(quan)益。據悉,該規定將于3月1日起正式施行(xing),

擴大了醫療期適用范圍

原勞(lao)動(dong)部的醫療期(qi)規定僅適用于(yu)企(qi)(qi)業職工(gong)。2008年勞(lao)動(dong)合同法頒布實施后,用人單(dan)位(wei)的范圍進一(yi)步擴大(da),除企(qi)(qi)業外,一(yi)些民辦(ban)非企(qi)(qi)業單(dan)位(wei)、合伙組織等,其勞(lao)動(dong)者也應當享有醫療期(qi)的相關權利。

為此,《醫療期(qi)規(gui)定》對用(yong)人單位范(fan)圍(wei)(wei)進行了適(shi)度擴大,除企業外,其他(ta)勞動關系(xi)主(zhu)體,如民辦非企業單位、會(hui)(hui)計(ji)師事務(wu)(wu)所(suo)(suo)、律師事務(wu)(wu)所(suo)(suo)、基(ji)金會(hui)(hui)等組織也納入適(shi)用(yong)范(fan)圍(wei)(wei),以更加契(qi)合勞動合同(tong)法及用(yong)人單位的實際(ji)需(xu)求。

明確醫療期期限及累計計算辦法

《醫療(liao)(liao)(liao)期規(gui)(gui)定》延(yan)續相關規(gui)(gui)定,醫療(liao)(liao)(liao)期根據勞動者本(ben)(ben)人(ren)實際(ji)工(gong)(gong)作(zuo)(zuo)(zuo)年(nian)(nian)(nian)(nian)(nian)限(xian)(xian)(xian)(xian)和在本(ben)(ben)單(dan)(dan)位(wei)工(gong)(gong)作(zuo)(zuo)(zuo)年(nian)(nian)(nian)(nian)(nian)限(xian)(xian)(xian)(xian)確定,其(qi)中(zhong),實際(ji)工(gong)(gong)作(zuo)(zuo)(zuo)年(nian)(nian)(nian)(nian)(nian)限(xian)(xian)(xian)(xian)十(shi)(shi)年(nian)(nian)(nian)(nian)(nian)以(yi)(yi)下的(de)(de)(de),在本(ben)(ben)單(dan)(dan)位(wei)工(gong)(gong)作(zuo)(zuo)(zuo)年(nian)(nian)(nian)(nian)(nian)限(xian)(xian)(xian)(xian)五年(nian)(nian)(nian)(nian)(nian)以(yi)(yi)下的(de)(de)(de)為(wei)(wei)(wei)三(san)個月;五年(nian)(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)的(de)(de)(de)為(wei)(wei)(wei)六(liu)個月;實際(ji)工(gong)(gong)作(zuo)(zuo)(zuo)年(nian)(nian)(nian)(nian)(nian)限(xian)(xian)(xian)(xian)十(shi)(shi)年(nian)(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)的(de)(de)(de),在本(ben)(ben)單(dan)(dan)位(wei)工(gong)(gong)作(zuo)(zuo)(zuo)年(nian)(nian)(nian)(nian)(nian)限(xian)(xian)(xian)(xian)五年(nian)(nian)(nian)(nian)(nian)以(yi)(yi)下的(de)(de)(de)為(wei)(wei)(wei)六(liu)個月;五年(nian)(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)十(shi)(shi)年(nian)(nian)(nian)(nian)(nian)以(yi)(yi)下的(de)(de)(de)為(wei)(wei)(wei)九個月;十(shi)(shi)年(nian)(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)十(shi)(shi)五年(nian)(nian)(nian)(nian)(nian)以(yi)(yi)下的(de)(de)(de)為(wei)(wei)(wei)十(shi)(shi)二(er)個月;十(shi)(shi)五年(nian)(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)二(er)十(shi)(shi)年(nian)(nian)(nian)(nian)(nian)以(yi)(yi)下的(de)(de)(de)為(wei)(wei)(wei)十(shi)(shi)八個月;二(er)十(shi)(shi)年(nian)(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)的(de)(de)(de)為(wei)(wei)(wei)二(er)十(shi)(shi)四個月。《醫療(liao)(liao)(liao)期規(gui)(gui)定》還規(gui)(gui)定,集體合同(tong)、勞動合同(tong)、用(yong)人(ren)單(dan)(dan)位(wei)的(de)(de)(de)規(gui)(gui)章制(zhi)度等約定醫療(liao)(liao)(liao)期長于規(gui)(gui)定醫療(liao)(liao)(liao)期的(de)(de)(de),從(cong)其(qi)約定。

同時,《醫(yi)療(liao)(liao)期規定》對(dui)醫(yi)療(liao)(liao)期的(de)(de)(de)累計(ji)計(ji)算方法作(zuo)出規定,醫(yi)療(liao)(liao)期三個(ge)(ge)月(yue)(yue)的(de)(de)(de)按(an)(an)(an)(an)六個(ge)(ge)月(yue)(yue)內(nei)累計(ji)病(bing)(bing)休(xiu)(xiu)(xiu)(xiu)時間(jian)計(ji)算;六個(ge)(ge)月(yue)(yue)的(de)(de)(de)按(an)(an)(an)(an)十二(er)個(ge)(ge)月(yue)(yue)內(nei)累計(ji)病(bing)(bing)休(xiu)(xiu)(xiu)(xiu)時間(jian)計(ji)算;九個(ge)(ge)月(yue)(yue)的(de)(de)(de)按(an)(an)(an)(an)十五個(ge)(ge)月(yue)(yue)內(nei)累計(ji)病(bing)(bing)休(xiu)(xiu)(xiu)(xiu)時間(jian)計(ji)算;十二(er)個(ge)(ge)月(yue)(yue)的(de)(de)(de)按(an)(an)(an)(an)十八(ba)個(ge)(ge)月(yue)(yue)內(nei)累計(ji)病(bing)(bing)休(xiu)(xiu)(xiu)(xiu)時間(jian)計(ji)算;十八(ba)個(ge)(ge)月(yue)(yue)的(de)(de)(de)按(an)(an)(an)(an)二(er)十四(si)個(ge)(ge)月(yue)(yue)內(nei)累計(ji)病(bing)(bing)休(xiu)(xiu)(xiu)(xiu)時間(jian)計(ji)算;二(er)十四(si)個(ge)(ge)月(yue)(yue)的(de)(de)(de)按(an)(an)(an)(an)三十個(ge)(ge)月(yue)(yue)內(nei)累計(ji)病(bing)(bing)休(xiu)(xiu)(xiu)(xiu)時間(jian)計(ji)算。醫(yi)療(liao)(liao)期的(de)(de)(de)計(ji)算從勞(lao)動(dong)者停工(gong)(gong)治(zhi)療(liao)(liao)第一天(tian)起累計(ji),期間(jian)公休(xiu)(xiu)(xiu)(xiu)假日、法定節假日包(bao)括在(zai)內(nei)。確定勞(lao)動(dong)者醫(yi)療(liao)(liao)期期限(xian)、累計(ji)病(bing)(bing)休(xiu)(xiu)(xiu)(xiu)時間(jian)的(de)(de)(de)工(gong)(gong)作(zuo)年(nian)(nian)限(xian),以(yi)其停工(gong)(gong)治(zhi)療(liao)(liao)前一日的(de)(de)(de)實際(ji)工(gong)(gong)作(zuo)年(nian)(nian)限(xian)和在(zai)本單位(wei)工(gong)(gong)作(zuo)年(nian)(nian)限(xian)為準。

對醫療期內的工資待遇作出規定

《醫(yi)療(liao)期規定》規定,勞動者(zhe)患病或者(zhe)非因工負傷停(ting)止工作(zuo)治療(liao)休息,用人單位應當按照以下標準支付病假工資或者(zhe)疾病救濟(ji)費。

醫療(liao)(liao)期(qi)(qi)內,停工(gong)(gong)醫療(liao)(liao)累計不(bu)超過六個月的(de)(de),發給本人(ren)工(gong)(gong)資(zi)(zi)百(bai)分之七十的(de)(de)病(bing)(bing)假工(gong)(gong)資(zi)(zi);醫療(liao)(liao)期(qi)(qi)內,停工(gong)(gong)醫療(liao)(liao)累計超過六個月的(de)(de),發給本人(ren)工(gong)(gong)資(zi)(zi)百(bai)分之六十的(de)(de)疾病(bing)(bing)救濟費。病(bing)(bing)假工(gong)(gong)資(zi)(zi)和疾病(bing)(bing)救濟費最(zui)低不(bu)得低于(yu)當地最(zui)低工(gong)(gong)資(zi)(zi)標準的(de)(de)百(bai)分之八十,最(zui)高不(bu)超過用(yong)人(ren)單位(wei)上年(nian)度勞動(dong)(dong)者(zhe)月平均工(gong)(gong)資(zi)(zi)。本人(ren)工(gong)(gong)資(zi)(zi),是指勞動(dong)(dong)者(zhe)本人(ren)患病(bing)(bing)前十二(er)個月的(de)(de)月平均工(gong)(gong)資(zi)(zi)。勞動(dong)(dong)者(zhe)工(gong)(gong)作(zuo)不(bu)滿十二(er)個月的(de)(de),按實(shi)際(ji)工(gong)(gong)作(zuo)月數的(de)(de)月平均工(gong)(gong)資(zi)(zi)計算。

對醫療期滿勞動關系處理問題作出規定

《醫(yi)療(liao)(liao)期規定(ding)》梳理了(le)醫(yi)療(liao)(liao)期滿用人(ren)單(dan)(dan)(dan)位處理勞(lao)(lao)(lao)(lao)動(dong)(dong)關系的(de)(de)各種情形,第一種情形,勞(lao)(lao)(lao)(lao)動(dong)(dong)者患(huan)病(bing)或者非因工(gong)負(fu)傷(shang),醫(yi)療(liao)(liao)期滿后,用人(ren)單(dan)(dan)(dan)位應當根(gen)據勞(lao)(lao)(lao)(lao)動(dong)(dong)者的(de)(de)身體狀況安排適(shi)當的(de)(de)工(gong)作(zuo)(zuo);因勞(lao)(lao)(lao)(lao)動(dong)(dong)者不(bu)能從事原(yuan)工(gong)作(zuo)(zuo)、也不(bu)能從事由(you)用人(ren)單(dan)(dan)(dan)位另行(xing)安排的(de)(de)工(gong)作(zuo)(zuo)的(de)(de),用人(ren)單(dan)(dan)(dan)位可以(yi)依法解除勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong)。用人(ren)單(dan)(dan)(dan)位解除勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong),除依法支(zhi)付經濟補(bu)償外(wai),還(huan)應當向(xiang)勞(lao)(lao)(lao)(lao)動(dong)(dong)者支(zhi)付不(bu)低于六(liu)個月工(gong)資的(de)(de)醫(yi)療(liao)(liao)補(bu)助費(fei)。患(huan)重病(bing)和絕癥的(de)(de)還(huan)應增(zeng)加醫(yi)療(liao)(liao)補(bu)助費(fei),患(huan)重病(bing)的(de)(de)增(zeng)加部(bu)(bu)分不(bu)低于醫(yi)療(liao)(liao)補(bu)助費(fei)的(de)(de)百(bai)分之五十,患(huan)絕癥的(de)(de)增(zeng)加部(bu)(bu)分不(bu)低于醫(yi)療(liao)(liao)補(bu)助費(fei)的(de)(de)百(bai)分之百(bai)。

第二(er)種(zhong)情形,醫療期(qi)滿后,勞動者不(bu)能從(cong)事原(yuan)工作(zuo)、也(ye)不(bu)能從(cong)事由(you)用人單(dan)位另行安排的工作(zuo),但(dan)用人單(dan)位與勞動者保(bao)留勞動關(guan)系的,應當按照(zhao)不(bu)低于當地最低工資標(biao)準(zhun)的百分之八十向勞動者支(zhi)付疾病救濟費。第三種(zhong)情形,勞動者患病或者非(fei)因工負傷,經勞動能力鑒(jian)定(ding)委員(yuan)會鑒(jian)定(ding)為完全喪失(shi)勞動能力,且符合(he)退(tui)(tui)(tui)休(xiu)、退(tui)(tui)(tui)職(zhi)條件的,應當辦理退(tui)(tui)(tui)休(xiu)、退(tui)(tui)(tui)職(zhi)手(shou)續,享受退(tui)(tui)(tui)休(xiu)、退(tui)(tui)(tui)職(zhi)待遇。
