日前,山東省青(qing)島市(shi)人(ren)(ren)社局發(fa)布勞(lao)(lao)動者(zhe)患病或(huo)者(zhe)非(fei)因(yin)工(gong)負傷醫(yi)療(liao)(liao)期管理(li)規定(ding)(以下(xia)簡稱《醫(yi)療(liao)(liao)期規定(ding)》),擴大了(le)醫(yi)療(liao)(liao)期適用范圍,明確了(le)醫(yi)療(liao)(liao)期期限及累計計算辦法(fa)等問題,進一步規范青(qing)島市(shi)醫(yi)療(liao)(liao)期管理(li),維護勞(lao)(lao)動者(zhe)和用人(ren)(ren)單位合法(fa)權益。據悉,該規定(ding)將于3月1日起正式施行,
擴大了醫療期適用范圍
原(yuan)勞(lao)動部的(de)醫療期規定(ding)僅適(shi)用(yong)于企(qi)業(ye)職工。2008年勞(lao)動合同法頒(ban)布實施后,用(yong)人(ren)單位的(de)范圍進一步(bu)擴大,除企(qi)業(ye)外,一些(xie)民辦非(fei)企(qi)業(ye)單位、合伙組織等,其勞(lao)動者也應(ying)當享(xiang)有(you)醫療期的(de)相關權利。
為(wei)此,《醫療期規定》對(dui)用(yong)人(ren)(ren)單(dan)(dan)位范(fan)圍進行了適度擴大(da),除企業外,其(qi)他勞動(dong)(dong)關系主(zhu)體,如民(min)辦非企業單(dan)(dan)位、會(hui)計師事務所、律師事務所、基(ji)金會(hui)等組織也納入適用(yong)范(fan)圍,以更加契合(he)(he)勞動(dong)(dong)合(he)(he)同法(fa)及用(yong)人(ren)(ren)單(dan)(dan)位的(de)實際需求(qiu)。
明確醫療期期限及累計計算辦法
《醫(yi)療(liao)期(qi)(qi)規(gui)(gui)(gui)定(ding)》延續(xu)相關規(gui)(gui)(gui)定(ding),醫(yi)療(liao)期(qi)(qi)根據勞動者本(ben)(ben)人(ren)實際(ji)(ji)工(gong)(gong)作(zuo)年(nian)(nian)(nian)(nian)限(xian)和在本(ben)(ben)單(dan)位(wei)工(gong)(gong)作(zuo)年(nian)(nian)(nian)(nian)限(xian)確(que)定(ding),其(qi)中(zhong),實際(ji)(ji)工(gong)(gong)作(zuo)年(nian)(nian)(nian)(nian)限(xian)十(shi)年(nian)(nian)(nian)(nian)以(yi)(yi)下(xia)(xia)的(de)(de)(de),在本(ben)(ben)單(dan)位(wei)工(gong)(gong)作(zuo)年(nian)(nian)(nian)(nian)限(xian)五(wu)年(nian)(nian)(nian)(nian)以(yi)(yi)下(xia)(xia)的(de)(de)(de)為三個(ge)(ge)(ge)月(yue)(yue);五(wu)年(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)的(de)(de)(de)為六個(ge)(ge)(ge)月(yue)(yue);實際(ji)(ji)工(gong)(gong)作(zuo)年(nian)(nian)(nian)(nian)限(xian)十(shi)年(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)的(de)(de)(de),在本(ben)(ben)單(dan)位(wei)工(gong)(gong)作(zuo)年(nian)(nian)(nian)(nian)限(xian)五(wu)年(nian)(nian)(nian)(nian)以(yi)(yi)下(xia)(xia)的(de)(de)(de)為六個(ge)(ge)(ge)月(yue)(yue);五(wu)年(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)十(shi)年(nian)(nian)(nian)(nian)以(yi)(yi)下(xia)(xia)的(de)(de)(de)為九(jiu)個(ge)(ge)(ge)月(yue)(yue);十(shi)年(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)十(shi)五(wu)年(nian)(nian)(nian)(nian)以(yi)(yi)下(xia)(xia)的(de)(de)(de)為十(shi)二(er)個(ge)(ge)(ge)月(yue)(yue);十(shi)五(wu)年(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)二(er)十(shi)年(nian)(nian)(nian)(nian)以(yi)(yi)下(xia)(xia)的(de)(de)(de)為十(shi)八(ba)個(ge)(ge)(ge)月(yue)(yue);二(er)十(shi)年(nian)(nian)(nian)(nian)以(yi)(yi)上(shang)(shang)的(de)(de)(de)為二(er)十(shi)四個(ge)(ge)(ge)月(yue)(yue)。《醫(yi)療(liao)期(qi)(qi)規(gui)(gui)(gui)定(ding)》還規(gui)(gui)(gui)定(ding),集體合(he)同、勞動合(he)同、用(yong)人(ren)單(dan)位(wei)的(de)(de)(de)規(gui)(gui)(gui)章制度等約(yue)定(ding)醫(yi)療(liao)期(qi)(qi)長于(yu)規(gui)(gui)(gui)定(ding)醫(yi)療(liao)期(qi)(qi)的(de)(de)(de),從其(qi)約(yue)定(ding)。
同時(shi)(shi),《醫(yi)療(liao)(liao)(liao)(liao)期(qi)(qi)規(gui)定》對醫(yi)療(liao)(liao)(liao)(liao)期(qi)(qi)的(de)(de)累(lei)(lei)(lei)計(ji)(ji)計(ji)(ji)算(suan)方(fang)法作(zuo)(zuo)出規(gui)定,醫(yi)療(liao)(liao)(liao)(liao)期(qi)(qi)三個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)月(yue)的(de)(de)按(an)六(liu)個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)月(yue)內累(lei)(lei)(lei)計(ji)(ji)病休(xiu)時(shi)(shi)間(jian)計(ji)(ji)算(suan);六(liu)個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)月(yue)的(de)(de)按(an)十二個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)月(yue)內累(lei)(lei)(lei)計(ji)(ji)病休(xiu)時(shi)(shi)間(jian)計(ji)(ji)算(suan);九(jiu)個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)月(yue)的(de)(de)按(an)十五個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)月(yue)內累(lei)(lei)(lei)計(ji)(ji)病休(xiu)時(shi)(shi)間(jian)計(ji)(ji)算(suan);十二個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)月(yue)的(de)(de)按(an)十八(ba)個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)月(yue)內累(lei)(lei)(lei)計(ji)(ji)病休(xiu)時(shi)(shi)間(jian)計(ji)(ji)算(suan);十八(ba)個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)月(yue)的(de)(de)按(an)二十四(si)個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)月(yue)內累(lei)(lei)(lei)計(ji)(ji)病休(xiu)時(shi)(shi)間(jian)計(ji)(ji)算(suan);二十四(si)個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)月(yue)的(de)(de)按(an)三十個(ge)(ge)(ge)(ge)(ge)(ge)(ge)(ge)月(yue)內累(lei)(lei)(lei)計(ji)(ji)病休(xiu)時(shi)(shi)間(jian)計(ji)(ji)算(suan)。醫(yi)療(liao)(liao)(liao)(liao)期(qi)(qi)的(de)(de)計(ji)(ji)算(suan)從勞動者(zhe)停工(gong)(gong)治療(liao)(liao)(liao)(liao)第一(yi)天起累(lei)(lei)(lei)計(ji)(ji),期(qi)(qi)間(jian)公休(xiu)假(jia)日(ri)、法定節(jie)假(jia)日(ri)包括在內。確定勞動者(zhe)醫(yi)療(liao)(liao)(liao)(liao)期(qi)(qi)期(qi)(qi)限、累(lei)(lei)(lei)計(ji)(ji)病休(xiu)時(shi)(shi)間(jian)的(de)(de)工(gong)(gong)作(zuo)(zuo)年限,以其(qi)停工(gong)(gong)治療(liao)(liao)(liao)(liao)前一(yi)日(ri)的(de)(de)實(shi)際工(gong)(gong)作(zuo)(zuo)年限和(he)在本單位工(gong)(gong)作(zuo)(zuo)年限為準。
對醫療期內的工資待遇作出規定
《醫療期規定(ding)》規定(ding),勞動(dong)者患病或者非因工(gong)負傷停止工(gong)作治療休息,用人單位應當按照以(yi)下(xia)標準支付病假工(gong)資或者疾病救濟(ji)費。
醫療期(qi)內(nei),停工(gong)(gong)(gong)(gong)(gong)(gong)(gong)醫療累計不超過(guo)六個(ge)月(yue)(yue)(yue)(yue)(yue)的(de)(de),發給本(ben)人(ren)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)百(bai)分之(zhi)七十(shi)(shi)(shi)的(de)(de)病假工(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi);醫療期(qi)內(nei),停工(gong)(gong)(gong)(gong)(gong)(gong)(gong)醫療累計超過(guo)六個(ge)月(yue)(yue)(yue)(yue)(yue)的(de)(de),發給本(ben)人(ren)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)百(bai)分之(zhi)六十(shi)(shi)(shi)的(de)(de)疾病救濟(ji)費(fei)。病假工(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)和疾病救濟(ji)費(fei)最低不得低于當地最低工(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)標準(zhun)的(de)(de)百(bai)分之(zhi)八十(shi)(shi)(shi),最高不超過(guo)用(yong)人(ren)單位上年度勞(lao)(lao)動者(zhe)月(yue)(yue)(yue)(yue)(yue)平(ping)均工(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)。本(ben)人(ren)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi),是指勞(lao)(lao)動者(zhe)本(ben)人(ren)患病前十(shi)(shi)(shi)二(er)(er)個(ge)月(yue)(yue)(yue)(yue)(yue)的(de)(de)月(yue)(yue)(yue)(yue)(yue)平(ping)均工(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)。勞(lao)(lao)動者(zhe)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)不滿十(shi)(shi)(shi)二(er)(er)個(ge)月(yue)(yue)(yue)(yue)(yue)的(de)(de),按(an)實際工(gong)(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)月(yue)(yue)(yue)(yue)(yue)數(shu)的(de)(de)月(yue)(yue)(yue)(yue)(yue)平(ping)均工(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)(zi)計算。
對醫療期滿勞動關系處理問題作出規定
《醫(yi)(yi)療期(qi)規(gui)定》梳理了醫(yi)(yi)療期(qi)滿用(yong)人(ren)(ren)單(dan)位(wei)(wei)處理勞動(dong)關系的(de)(de)各(ge)種(zhong)情(qing)形(xing),第(di)一種(zhong)情(qing)形(xing),勞動(dong)者(zhe)(zhe)患(huan)病(bing)或者(zhe)(zhe)非(fei)因(yin)工(gong)負傷,醫(yi)(yi)療期(qi)滿后,用(yong)人(ren)(ren)單(dan)位(wei)(wei)應(ying)當(dang)根據(ju)勞動(dong)者(zhe)(zhe)的(de)(de)身(shen)體(ti)狀(zhuang)況(kuang)安排適當(dang)的(de)(de)工(gong)作;因(yin)勞動(dong)者(zhe)(zhe)不(bu)(bu)能從(cong)(cong)事(shi)原工(gong)作、也不(bu)(bu)能從(cong)(cong)事(shi)由用(yong)人(ren)(ren)單(dan)位(wei)(wei)另(ling)行安排的(de)(de)工(gong)作的(de)(de),用(yong)人(ren)(ren)單(dan)位(wei)(wei)可以依法解除(chu)勞動(dong)合(he)同。用(yong)人(ren)(ren)單(dan)位(wei)(wei)解除(chu)勞動(dong)合(he)同,除(chu)依法支(zhi)付經濟補(bu)(bu)償外(wai),還(huan)應(ying)當(dang)向勞動(dong)者(zhe)(zhe)支(zhi)付不(bu)(bu)低(di)于(yu)六個月工(gong)資的(de)(de)醫(yi)(yi)療補(bu)(bu)助費(fei)。患(huan)重病(bing)和絕(jue)癥(zheng)的(de)(de)還(huan)應(ying)增(zeng)加(jia)醫(yi)(yi)療補(bu)(bu)助費(fei),患(huan)重病(bing)的(de)(de)增(zeng)加(jia)部分不(bu)(bu)低(di)于(yu)醫(yi)(yi)療補(bu)(bu)助費(fei)的(de)(de)百(bai)分之(zhi)五十,患(huan)絕(jue)癥(zheng)的(de)(de)增(zeng)加(jia)部分不(bu)(bu)低(di)于(yu)醫(yi)(yi)療補(bu)(bu)助費(fei)的(de)(de)百(bai)分之(zhi)百(bai)。
第(di)二種情形,醫療(liao)期滿后,勞(lao)動(dong)者(zhe)不能(neng)從事(shi)(shi)原工作、也不能(neng)從事(shi)(shi)由(you)用人單位另行(xing)安排(pai)的(de)工作,但用人單位與勞(lao)動(dong)者(zhe)保留(liu)勞(lao)動(dong)關系的(de),應當按(an)照不低于當地最低工資(zi)標準的(de)百分之八十向勞(lao)動(dong)者(zhe)支付疾病救(jiu)濟費。第(di)三種情形,勞(lao)動(dong)者(zhe)患病或者(zhe)非因工負傷,經勞(lao)動(dong)能(neng)力鑒(jian)定(ding)委員(yuan)會鑒(jian)定(ding)為完全喪失勞(lao)動(dong)能(neng)力,且符合退(tui)休(xiu)、退(tui)職(zhi)(zhi)條件的(de),應當辦(ban)理(li)退(tui)休(xiu)、退(tui)職(zhi)(zhi)手(shou)續,享受退(tui)休(xiu)、退(tui)職(zhi)(zhi)待遇。
