1月(yue)20日(ri)上(shang)午,在濟南市歷下區歷山路(lu)上(shang),環衛工人張(zhang)大(da)姐正(zheng)在埋(mai)頭清(qing)掃(sao)馬路(lu)。張(zhang)大(da)姐告訴記者,她(ta)和(he)老(lao)公從(cong)事(shi)環衛工作已經(jing)10年了(le),近(jin)幾年感覺待遇比以前(qian)好了(le)很(hen)多,她(ta)和(he)企事(shi)業(ye)單位職工一樣,享(xiang)受老(lao)有(you)(you)所養、病(bing)有(you)(you)所醫(yi)的實惠。
1月20日上午,氣溫零下6℃,歷(li)下區城管局(ju)解放路環(huan)(huan)衛(wei)(wei)所的(de)工作人員為一線環(huan)(huan)衛(wei)(wei)工人劉大叔送(song)來姜(jiang)茶(cha)。“冬天(tian)太冷(leng),容(rong)易感冒,環(huan)(huan)衛(wei)(wei)所每(mei)天(tian)給我們送(song)一杯姜(jiang)茶(cha),喝(he)了暖和(he),防感冒。”從事9年環(huan)(huan)衛(wei)(wei)工作的(de)劉大叔笑著(zhu)說(shuo)。
臨時工(gong)、勞務(wu)派(pai)遣人(ren)員(yuan)、編(bian)外人(ren)員(yuan)……提起這些群體,人(ren)們最先想到的(de)常常是工(gong)資低、福利差、工(gong)作崗(gang)位“朝不保夕”等字眼。現實(shi)生(sheng)活中,確實(shi)有這么一(yi)群人(ren),他們或是從(cong)事(shi)體力勞動養家糊口,辛(xin)苦勞作一(yi)年,收入卻十分微薄;或是擠(ji)進了那(nei)些令人(ren)羨慕(mu)的(de)機關事(shi)業(ye)單位,可在單位內部卻始終(zhong)無法享受(shou)到與“編(bian)制內”人(ren)員(yuan)同等的(de)待(dai)遇(yu)。
不過,在濟南市歷下(xia)區,所有(you)“非正式”一(yi)線(xian)環(huan)衛工(gong)(gong)人不僅有(you)單位(wei)辦理(li)的五險一(yi)金,能享受(shou)月(yue)工(gong)(gong)資(zi)每年上漲100元的工(gong)(gong)資(zi)待遇(yu)自然增長機(ji)制,每年還能領(ling)到過節費、取暖費、高溫補助(zhu)等總計2600元左右的福利(li)。用歷下(xia)區環(huan)衛工(gong)(gong)老孔的話來說,“待遇(yu)越來越好,跟(gen)正式工(gong)(gong)之(zhi)間的差距也越來越小啦。”
勞(lao)(lao)(lao)動(dong)報(bao)酬權是勞(lao)(lao)(lao)動(dong)者(zhe)的基本勞(lao)(lao)(lao)動(dong)權利。《勞(lao)(lao)(lao)動(dong)法(fa)》第46條(tiao)明確(que)規定(ding):“工(gong)(gong)(gong)(gong)資(zi)分配(pei)應當遵循按勞(lao)(lao)(lao)分配(pei)原則,實(shi)行(xing)同(tong)工(gong)(gong)(gong)(gong)同(tong)酬。”想(xiang)要(yao)真(zhen)正(zheng)(zheng)將同(tong)工(gong)(gong)(gong)(gong)同(tong)酬落(luo)到實(shi)處,不(bu)僅要(yao)有(you)法(fa)律保障(zhang),更(geng)需要(yao)各省制定(ding)符合自身情況的好政策。近年來,在作為(wei)人(ren)口大省和(he)用(yong)工(gong)(gong)(gong)(gong)大省的山東(dong),“同(tong)工(gong)(gong)(gong)(gong)不(bu)同(tong)酬”現象(xiang)正(zheng)(zheng)伴(ban)隨著人(ren)社部門的改革(ge)步伐而逐漸改善。2012年以來,山東(dong)大力(li)推(tui)進規范勞(lao)(lao)(lao)務派(pai)(pai)遣(qian)(qian)和(he)同(tong)工(gong)(gong)(gong)(gong)同(tong)酬工(gong)(gong)(gong)(gong)作,省人(ren)社廳聯合有(you)關(guan)部門連續推(tui)出相關(guan)政策文件,針(zhen)對(dui)不(bu)同(tong)的用(yong)人(ren)單位(wei)和(he)不(bu)同(tong)的勞(lao)(lao)(lao)動(dong)者(zhe),分類施策,從規范企(qi)業(ye)勞(lao)(lao)(lao)務派(pai)(pai)遣(qian)(qian)用(yong)工(gong)(gong)(gong)(gong)行(xing)為(wei)、保護機關(guan)事業(ye)單位(wei)編(bian)外(wai)人(ren)員(yuan)(yuan)合法(fa)權益、保障(zhang)農民(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)支付等多個側(ce)面和(he)角度來推(tui)進同(tong)工(gong)(gong)(gong)(gong)同(tong)酬落(luo)實(shi)。目前,全(quan)省企(qi)業(ye)已(yi)經基本落(luo)實(shi)同(tong)工(gong)(gong)(gong)(gong)同(tong)酬,機關(guan)事業(ye)單位(wei)同(tong)工(gong)(gong)(gong)(gong)同(tong)酬工(gong)(gong)(gong)(gong)作正(zheng)(zheng)式起(qi)步并在全(quan)國領先,對(dui)于勞(lao)(lao)(lao)務派(pai)(pai)遣(qian)(qian)人(ren)員(yuan)(yuan)、臨時工(gong)(gong)(gong)(gong)、編(bian)外(wai)人(ren)員(yuan)(yuan)來說(shuo),同(tong)工(gong)(gong)(gong)(gong)同(tong)酬已(yi)不(bu)再(zai)是個夢。
五險一金全覆(fu)蓋,濟南歷下區環衛工幸福(fu)指(zhi)數直線(xian)上升(sheng)。
“干了(le)16年(nian)環(huan)衛工(gong)(gong)(gong)(gong),最(zui)近(jin)這(zhe)幾年(nian)明顯感覺到待(dai)遇比以前(qian)好多(duo)啦。”50歲的老孔(kong)是(shi)(shi)濟南(nan)市歷(li)下區城管局解放路環(huan)衛所(suo)的一(yi)名環(huan)衛工(gong)(gong)(gong)(gong),常年(nian)負責歷(li)山路沿(yan)線約500米的一(yi)段路面(mian)衛生工(gong)(gong)(gong)(gong)作。老孔(kong)說,他所(suo)在的環(huan)衛所(suo)有一(yi)百(bai)多(duo)人(ren),絕(jue)大(da)(da)多(duo)數是(shi)(shi)在一(yi)線工(gong)(gong)(gong)(gong)作的環(huan)衛工(gong)(gong)(gong)(gong)人(ren),大(da)(da)伙兒(er)的一(yi)個共(gong)同特點就(jiu)是(shi)(shi)“非正式(shi)工(gong)(gong)(gong)(gong)”。以前(qian),“非正式(shi)工(gong)(gong)(gong)(gong)”的工(gong)(gong)(gong)(gong)資比正式(shi)員(yuan)工(gong)(gong)(gong)(gong)低不少(shao),更別(bie)提醫療、養(yang)老等方面(mian)的保障了(le)。
變化始于(yu)3年(nian)(nian)前。老(lao)孔告訴記(ji)者,2012年(nian)(nian)起,他和工(gong)友們陸續接到單位(wei)辦理(li)五險一(yi)金(jin)的通(tong)知,“剛(gang)開始咱(zan)根本弄(nong)不清這五險一(yi)金(jin)有啥好(hao)處,后來明白(bai)了,這可是咱(zan)后半輩子的保障。”老(lao)孔笑著說,除了五險一(yi)金(jin),每年(nian)(nian)的冬季(ji)取暖費、夏季(ji)高溫補助、過節(jie)慰問品、每月5斤雞蛋等福(fu)利(li)一(yi)樣不少(shao),而且不分正(zheng)式工(gong)和“非正(zheng)式工(gong)”,每個環衛工(gong)都有。
據(ju)歷(li)下區(qu)(qu)城市管(guan)理局相關負責人(ren)(ren)介(jie)紹,目前(qian),歷(li)下區(qu)(qu)城管(guan)局有16個環(huan)衛(wei)(wei)所,每(mei)(mei)個所有一百多名員(yuan)(yuan)工(gong)(gong)(gong)(gong),絕大多數(shu)都(dou)是(shi)勞務派遣人(ren)(ren)員(yuan)(yuan),光(guang)是(shi)一線環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)加起來(lai)就將近2000人(ren)(ren)。2012年(nian)(nian)(nian)3月(yue),區(qu)(qu)里開始為(wei)(wei)一線環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)(ren)辦理五(wu)險(xian)一金,并(bing)對超齡人(ren)(ren)員(yuan)(yuan)設(she)置專人(ren)(ren)專項(xiang)賬戶,向不(bu)符合(he)入保條件的(de)(de)一線環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)(ren)發(fa)放補(bu)貼(tie);為(wei)(wei)環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)(ren)建立工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)待遇自(zi)然增(zeng)長(chang)機(ji)制,每(mei)(mei)年(nian)(nian)(nian)為(wei)(wei)一線環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)(ren)每(mei)(mei)人(ren)(ren)每(mei)(mei)月(yue)增(zeng)長(chang)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)100元;提供免費的(de)(de)環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)公寓,并(bing)對暫無住(zhu)房(fang)的(de)(de)外(wai)來(lai)環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)(ren)提供住(zhu)房(fang)補(bu)貼(tie)等。經(jing)過3年(nian)(nian)(nian)多的(de)(de)不(bu)懈努力(li),如今(jin),歷(li)下區(qu)(qu)環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)(ren)平均月(yue)工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)達到(dao)2000余(yu)元,高于最低工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)標準(zhun)25%,此外(wai),每(mei)(mei)人(ren)(ren)每(mei)(mei)年(nian)(nian)(nian)可領到(dao)2600元左右的(de)(de)各項(xiang)福利補(bu)貼(tie)。吃飯住(zhu)房(fang)不(bu)用(yong)發(fa)愁(chou),工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)福利年(nian)(nian)(nian)年(nian)(nian)(nian)上漲,生病退休(xiu)有了保障,全(quan)區(qu)(qu)環(huan)衛(wei)(wei)工(gong)(gong)(gong)(gong)人(ren)(ren)再也不(bu)用(yong)為(wei)(wei)了“非正式工(gong)(gong)(gong)(gong)”的(de)(de)身份發(fa)愁(chou),幸福指數(shu)直線上升。
督促企(qi)業(ye)落實(shi)同工同酬,中行2960名派遣員工完成身(shen)份轉換。
勞務派遣(qian)(qian)用(yong)(yong)工(gong)(gong)(gong)(gong)是企(qi)業(ye)合同(tong)制(zhi)用(yong)(yong)工(gong)(gong)(gong)(gong)的(de)(de)補充(chong)形式,目的(de)(de)是解決(jue)企(qi)業(ye)臨(lin)時性(xing)用(yong)(yong)工(gong)(gong)(gong)(gong)和勞動者短期(qi)就業(ye)的(de)(de)問題。但在實踐中(zhong),這一(yi)補充(chong)性(xing)用(yong)(yong)工(gong)(gong)(gong)(gong)制(zhi)度被一(yi)些單(dan)位(wei)(wei)濫用(yong)(yong):一(yi)些用(yong)(yong)工(gong)(gong)(gong)(gong)單(dan)位(wei)(wei)在同(tong)一(yi)工(gong)(gong)(gong)(gong)作(zuo)崗(gang)位(wei)(wei)混崗(gang)使用(yong)(yong)派遣(qian)(qian)制(zhi)員工(gong)(gong)(gong)(gong)和本單(dan)位(wei)(wei)職(zhi)工(gong)(gong)(gong)(gong),實行(xing)不同(tong)的(de)(de)勞動報酬(chou)分配制(zhi)度和辦法,派遣(qian)(qian)制(zhi)員工(gong)(gong)(gong)(gong)相(xiang)(xiang)對于(yu)用(yong)(yong)工(gong)(gong)(gong)(gong)單(dan)位(wei)(wei)職(zhi)工(gong)(gong)(gong)(gong)勞動報酬(chou)明顯(xian)偏低,有的(de)(de)只相(xiang)(xiang)當于(yu)用(yong)(yong)工(gong)(gong)(gong)(gong)單(dan)位(wei)(wei)合同(tong)制(zhi)職(zhi)工(gong)(gong)(gong)(gong)的(de)(de)50%左(zuo)右,直接影響了勞務派遣(qian)(qian)職(zhi)工(gong)(gong)(gong)(gong)的(de)(de)工(gong)(gong)(gong)(gong)作(zuo)熱情和歸屬(shu)感。以規范勞務派遣(qian)(qian)用(yong)(yong)工(gong)(gong)(gong)(gong)為重點,督促企(qi)業(ye)落(luo)實同(tong)工(gong)(gong)(gong)(gong)同(tong)酬(chou),成為我省推進相(xiang)(xiang)關改革的(de)(de)又(you)一(yi)重要舉措(cuo)。
以中國銀(yin)行(xing)(xing)山東省(sheng)分行(xing)(xing)為例,到(dao)2013年(nian)末(mo),該(gai)行(xing)(xing)仍有(you)近3000名派遣員工(gong)(gong)(gong),占(zhan)全行(xing)(xing)員工(gong)(gong)(gong)總數的17.09%。在這(zhe)些派遣員工(gong)(gong)(gong)中,有(you)90%左右(you)都在各個(ge)營業(ye)網點工(gong)(gong)(gong)作(zuo),是(shi)銀(yin)行(xing)(xing)基層隊(dui)伍的重要組成部分,可(ke)由(you)于受到(dao)“勞務派遣”的身份(fen)限制(zhi),他(ta)們在工(gong)(gong)(gong)資待遇方面與正式員工(gong)(gong)(gong)仍有(you)一(yi)定差距。不(bu)過,這(zhe)一(yi)現象在近兩年(nian)得到(dao)了有(you)效改善(shan),通過制(zhi)定《中國銀(yin)行(xing)(xing)山東省(sheng)分行(xing)(xing)調整勞務派遣用(yong)(yong)工(gong)(gong)(gong)管(guan)理政策工(gong)(gong)(gong)作(zuo)方案》,中行(xing)(xing)山東省(sheng)分行(xing)(xing)明(ming)確了以勞動(dong)合同用(yong)(yong)工(gong)(gong)(gong)作(zuo)為基本用(yong)(yong)工(gong)(gong)(gong)形式,2014年(nian)以來,全轄2960名派遣員工(gong)(gong)(gong)已全部轉換為合同制(zhi)員工(gong)(gong)(gong),整個(ge)轉換過程(cheng)公開透明(ming),有(you)效保障了員工(gong)(gong)(gong)利益。
記(ji)者從省(sheng)人(ren)社廳了解(jie)到(dao),為促進勞(lao)動者短(duan)期就(jiu)業(ye),從源頭(tou)上(shang)解(jie)決和(he)減少同工同酬(chou)問題,山東在(zai)完善(shan)用工機制、規范勞(lao)務(wu)(wu)(wu)(wu)(wu)派(pai)遣(qian)方面(mian)采取(qu)了一(yi)系列措施(shi)。一(yi)方面(mian)嚴格執行人(ren)力資源社會保(bao)障部《勞(lao)務(wu)(wu)(wu)(wu)(wu)派(pai)遣(qian)行政(zheng)許(xu)(xu)可(ke)實施(shi)辦法》,自(zi)2013年7月1日起,對(dui)新設立的勞(lao)務(wu)(wu)(wu)(wu)(wu)派(pai)遣(qian)單位(wei)(wei)(wei)經(jing)營勞(lao)務(wu)(wu)(wu)(wu)(wu)派(pai)遣(qian)業(ye)務(wu)(wu)(wu)(wu)(wu)實行行政(zheng)許(xu)(xu)可(ke);對(dui)已經(jing)經(jing)營勞(lao)務(wu)(wu)(wu)(wu)(wu)派(pai)遣(qian)業(ye)務(wu)(wu)(wu)(wu)(wu)的勞(lao)務(wu)(wu)(wu)(wu)(wu)派(pai)遣(qian)單位(wei)(wei)(wei),要(yao)求其在(zai)一(yi)年內取(qu)得經(jing)營勞(lao)務(wu)(wu)(wu)(wu)(wu)派(pai)遣(qian)業(ye)務(wu)(wu)(wu)(wu)(wu)的行政(zheng)許(xu)(xu)可(ke);自(zi)2014年7月1日起,未(wei)取(qu)得行政(zheng)許(xu)(xu)可(ke)的,任何(he)單位(wei)(wei)(wei)和(he)個人(ren)不(bu)得經(jing)營勞(lao)務(wu)(wu)(wu)(wu)(wu)派(pai)遣(qian)業(ye)務(wu)(wu)(wu)(wu)(wu)。截至(zhi)目前,全省(sheng)已對(dui)1067戶派(pai)遣(qian)單位(wei)(wei)(wei)實施(shi)許(xu)(xu)可(ke)。
另一方面則(ze)是從嚴控制(zhi)用(yong)(yong)工企(qi)業使用(yong)(yong)派遣(qian)制(zhi)員工的(de)(de)比(bi)例。以獨立法(fa)(fa)人單位的(de)(de)所(suo)有職(zhi)工為(wei)基數進行核算(suan),從使用(yong)(yong)勞(lao)務(wu)(wu)派遣(qian)工的(de)(de)比(bi)例上進行限制(zhi)。對超過規(gui)定(ding)比(bi)例使用(yong)(yong)勞(lao)務(wu)(wu)派遣(qian)工的(de)(de)用(yong)(yong)工單位,依照法(fa)(fa)律規(gui)定(ding)每超過1人處以5000元(yuan)(yuan)以上20000元(yuan)(yuan)以下的(de)(de)罰款。對個別國有企(qi)業的(de)(de)特殊情況,采(cai)取企(qi)業申請、報人力(li)資源社會保(bao)障(zhang)行政(zheng)部門備案的(de)(de)辦法(fa)(fa),在規(gui)定(ding)時間(jian)內實現過渡(du)。
省委(wei)省政府帶頭落實同(tong)工同(tong)酬,編外人員月工資提(ti)高400元。
近(jin)年(nian)來,隨著社會公共服務需求的(de)(de)不斷擴大,一些機關(guan)(guan)事業(ye)單(dan)(dan)位(wei)(wei)使用了大量(liang)的(de)(de)編外人(ren)員(yuan)。據省人(ren)社廳勞(lao)動關(guan)(guan)系處相關(guan)(guan)負責人(ren)介(jie)紹,機關(guan)(guan)事業(ye)單(dan)(dan)位(wei)(wei)未納(na)入正式職工管理人(ren)員(yuan)主要(yao)有(you)三種(zhong)形式:單(dan)(dan)位(wei)(wei)直接簽(qian)訂勞(lao)動合(he)同(tong)人(ren)員(yuan)、單(dan)(dan)位(wei)(wei)使用的(de)(de)勞(lao)務派遣人(ren)員(yuan)、單(dan)(dan)位(wei)(wei)按(an)照機關(guan)(guan)事業(ye)單(dan)(dan)位(wei)(wei)人(ren)員(yuan)管理方式聘用的(de)(de)人(ren)員(yuan)。他們中的(de)(de)不少人(ren)做著跟“編制內”人(ren)員(yuan)差(cha)不多的(de)(de)工作,可獲得(de)的(de)(de)報(bao)酬(chou)卻有(you)不小差(cha)距。
如今,編(bian)制(zhi)內外看似“鐵板一塊”的(de)(de)待遇差距正在逐步(bu)縮小(xiao)。全國人(ren)大(da)關(guan)于修(xiu)改勞動合(he)同法(fa)(fa)的(de)(de)決定公(gong)(gong)布后,山東加強對用工(gong)(gong)單位(wei)(wei)的(de)(de)執法(fa)(fa)檢查,召開了機(ji)關(guan)事業單位(wei)(wei)推(tui)進(jin)同工(gong)(gong)同酬工(gong)(gong)作(zuo)座談會,結合(he)全省(sheng)(sheng)(sheng)機(ji)關(guan)事業單位(wei)(wei)“吃空餉”專項整治工(gong)(gong)作(zuo),妥善處理機(ji)關(guan)事業單位(wei)(wei)歷史形(xing)成的(de)(de)編(bian)制(zhi)外人(ren)員(yuan)問題,積(ji)極推(tui)進(jin)機(ji)關(guan)事業單位(wei)(wei)同工(gong)(gong)同酬。據(ju)了解,2014年12月(yue)1日起,省(sheng)(sheng)(sheng)委(wei)、省(sheng)(sheng)(sheng)人(ren)大(da)、省(sheng)(sheng)(sheng)政府、省(sheng)(sheng)(sheng)政協辦(ban)公(gong)(gong)廳將編(bian)外人(ren)員(yuan)中(zhong)的(de)(de)汽(qi)車司機(ji)、廚師、水(shui)電維修(xiu)工(gong)(gong)等技能(neng)崗(gang)位(wei)(wei)和其他崗(gang)位(wei)(wei)人(ren)員(yuan)的(de)(de)月(yue)工(gong)(gong)資提(ti)高達(da)2100元(yuan)和2000元(yuan),較之前分(fen)別提(ti)高400元(yuan)和300元(yuan),工(gong)(gong)資水(shui)平超過(guo)了濟(ji)南市同類職業人(ren)員(yuan)工(gong)(gong)資指導(dao)價位(wei)(wei)低(di)位(wei)(wei)數。
記(ji)者從省(sheng)人(ren)社廳了解(jie)到,截至(zhi)2014年底,全省(sheng)多(duo)數省(sheng)直機關事業單(dan)位(wei)(wei)已(yi)經按照(zhao)要(yao)求對編(bian)(bian)外人(ren)員(yuan)管理進(jin)行(xing)了規(gui)范(fan),一(yi)部分單(dan)位(wei)(wei)將“臨時人(ren)員(yuan)”改(gai)(gai)為(wei)規(gui)范(fan)的勞務(wu)派遣(qian)用工,一(yi)部分單(dan)位(wei)(wei)改(gai)(gai)為(wei)直接(jie)簽訂勞動合同,按照(zhao)社會保(bao)險(xian)法(fa)規(gui)定(ding)參加(jia)社會保(bao)險(xian),工資(zi)水平也有了一(yi)定(ding)程(cheng)度提高,部分編(bian)(bian)外人(ren)員(yuan)的工資(zi)收(shou)入(ru)(ru)已(yi)經達到或接(jie)近同崗位(wei)(wei)、同等資(zi)歷人(ren)員(yuan)的收(shou)入(ru)(ru)水平。
2015年3月,山東省在深入(ru)(ru)調(diao)研基礎上,以保障(zhang)勞動者合法權益為切入(ru)(ru)點(dian),出臺了(le)《關于(yu)維護機(ji)關事業(ye)單(dan)(dan)位(wei)(wei)未納(na)入(ru)(ru)正(zheng)式(shi)職(zhi)工(gong)管(guan)(guan)理(li)人員勞動保障(zhang)權益的(de)(de)(de)通知》:明確了(le)機(ji)關事業(ye)單(dan)(dan)位(wei)(wei)未納(na)入(ru)(ru)正(zheng)式(shi)職(zhi)工(gong)管(guan)(guan)理(li)的(de)(de)(de)人員的(de)(de)(de)管(guan)(guan)理(li)方式(shi);規定(ding)了(le)機(ji)關事業(ye)單(dan)(dan)位(wei)(wei)使用未納(na)入(ru)(ru)正(zheng)式(shi)職(zhi)工(gong)管(guan)(guan)理(li)的(de)(de)(de)人員,應當為其(qi)繳納(na)相應的(de)(de)(de)“五險一金”;明確要求機(ji)關事業(ye)單(dan)(dan)位(wei)(wei)要制定(ding)符合同(tong)工(gong)同(tong)酬分配(pei)原則(ze)的(de)(de)(de)勞動報(bao)酬分配(pei)辦法……對于(yu)多數身(shen)在機(ji)關事業(ye)單(dan)(dan)位(wei)(wei)的(de)(de)(de)編外人員來(lai)說,這無疑將帶來(lai)真(zhen)正(zheng)的(de)(de)(de)福音。

為便于各地(di)準確掌握同(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)酬的(de)(de)(de)(de)內(nei)(nei)涵,便于實際操作,省人(ren)社廳召(zhao)開(kai)不(bu)同(tong)(tong)(tong)(tong)類型、不(bu)同(tong)(tong)(tong)(tong)層次的(de)(de)(de)(de)研(yan)討會,反復征(zheng)求地(di)方(fang)主管部(bu)門、用(yong)人(ren)單(dan)位(wei)(wei)(wei)意見(jian),并商人(ren)力(li)資(zi)(zi)(zi)源社會保(bao)障部(bu)同(tong)(tong)(tong)(tong)意后,形成了對同(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)酬進(jin)行界(jie)定的(de)(de)(de)(de)初步意見(jian):一是(shi)用(yong)工(gong)(gong)(gong)(gong)單(dan)位(wei)(wei)(wei)使用(yong)勞(lao)(lao)(lao)務派遣工(gong)(gong)(gong)(gong)應嚴格限定在臨時性、輔助性或者替代性工(gong)(gong)(gong)(gong)作崗位(wei)(wei)(wei)的(de)(de)(de)(de)范圍(wei)之內(nei)(nei),不(bu)得超過國家規定的(de)(de)(de)(de)比例。二(er)是(shi)用(yong)工(gong)(gong)(gong)(gong)單(dan)位(wei)(wei)(wei)在2012年(nian)12月(yue)28日前與勞(lao)(lao)(lao)務派遣單(dan)位(wei)(wei)(wei)簽(qian)訂的(de)(de)(de)(de)勞(lao)(lao)(lao)務派遣協議、勞(lao)(lao)(lao)務派遣單(dan)位(wei)(wei)(wei)簽(qian)訂的(de)(de)(de)(de)勞(lao)(lao)(lao)動合(he)同(tong)(tong)(tong)(tong),除違(wei)背同(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)酬原則的(de)(de)(de)(de)內(nei)(nei)容外(wai),應當(dang)繼續履(lv)行至期限屆(jie)滿。三是(shi)用(yong)工(gong)(gong)(gong)(gong)單(dan)位(wei)(wei)(wei)應當(dang)按照(zhao)(zhao)同(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)酬原則,對被派遣勞(lao)(lao)(lao)動者與本單(dan)位(wei)(wei)(wei)同(tong)(tong)(tong)(tong)類崗位(wei)(wei)(wei)的(de)(de)(de)(de)勞(lao)(lao)(lao)動者實行相同(tong)(tong)(tong)(tong)的(de)(de)(de)(de)勞(lao)(lao)(lao)動報酬分配辦(ban)法。用(yong)工(gong)(gong)(gong)(gong)單(dan)位(wei)(wei)(wei)無同(tong)(tong)(tong)(tong)類崗位(wei)(wei)(wei)勞(lao)(lao)(lao)動者的(de)(de)(de)(de),應當(dang)參(can)照(zhao)(zhao)當(dang)地(di)人(ren)力(li)資(zi)(zi)(zi)源市場工(gong)(gong)(gong)(gong)資(zi)(zi)(zi)指導價位(wei)(wei)(wei),做到同(tong)(tong)(tong)(tong)工(gong)(gong)(gong)(gong)同(tong)(tong)(tong)(tong)酬。
2013年8月1日修訂的(de)《山東省勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)條例》第四十(shi)(shi)八(ba)條規(gui)定,細化(hua)勞(lao)務派遣關于“臨時性(xing)、輔助性(xing)、替代性(xing)”崗位(wei)(wei)(wei)的(de)規(gui)定,明(ming)(ming)確“替代性(xing)工(gong)作崗位(wei)(wei)(wei)是指用(yong)工(gong)單(dan)位(wei)(wei)(wei)的(de)勞(lao)動(dong)(dong)(dong)者因脫產學習、休假等(deng)原因無法工(gong)作,一(yi)年之內(nei)可以(yi)由(you)其(qi)他勞(lao)動(dong)(dong)(dong)者替代工(gong)作的(de)崗位(wei)(wei)(wei)”,進一(yi)步明(ming)(ming)確了(le)“替代性(xing)工(gong)作崗位(wei)(wei)(wei)”的(de)適用(yong)范(fan)圍(wei),有(you)效壓(ya)縮了(le)企業大規(gui)模(mo)使用(yong)勞(lao)務派遣工(gong)的(de)空間。《條例》還明(ming)(ming)確了(le)同(tong)(tong)工(gong)同(tong)(tong)酬的(de)實(shi)質,第五十(shi)(shi)條明(ming)(ming)確要求(qiu),“用(yong)工(gong)單(dan)位(wei)(wei)(wei)應(ying)當保(bao)障被派遣勞(lao)動(dong)(dong)(dong)者與本單(dan)位(wei)(wei)(wei)職工(gong)享有(you)同(tong)(tong)工(gong)同(tong)(tong)酬的(de)權(quan)利,實(shi)行(xing)相同(tong)(tong)的(de)勞(lao)動(dong)(dong)(dong)報酬分配(pei)辦法。”
