山東落實同工同酬政策 編外人員月工資提高400元

1月(yue)20日(ri)上午,在濟南(nan)市歷(li)下(xia)區歷(li)山路(lu)上,環衛(wei)工(gong)人張大姐正在埋(mai)頭清掃馬路(lu)。張大姐告訴記者(zhe),她和老(lao)公從事(shi)環衛(wei)工(gong)作已經10年了(le),近幾年感覺待遇比以(yi)前好了(le)很多,她和企事(shi)業單位職工(gong)一(yi)樣,享受老(lao)有(you)所養、病有(you)所醫(yi)的實惠。

1月(yue)20日上午(wu),氣溫零下6℃,歷下區城(cheng)管局解(jie)放路環(huan)衛所的工(gong)作人員為(wei)一(yi)(yi)線環(huan)衛工(gong)人劉(liu)大(da)(da)叔(shu)送(song)來姜茶(cha)。“冬天太冷,容易感冒(mao),環(huan)衛所每天給我(wo)們送(song)一(yi)(yi)杯姜茶(cha),喝了暖和,防感冒(mao)。”從事9年環(huan)衛工(gong)作的劉(liu)大(da)(da)叔(shu)笑著說(shuo)。

臨時工、勞(lao)(lao)務派遣(qian)人(ren)(ren)員(yuan)、編外人(ren)(ren)員(yuan)……提起這些(xie)群(qun)體,人(ren)(ren)們最(zui)先想到的常常是工資(zi)低、福利差(cha)、工作(zuo)崗位“朝不保(bao)夕”等字眼。現(xian)實生(sheng)活中(zhong),確實有這么一群(qun)人(ren)(ren),他(ta)們或是從事(shi)體力勞(lao)(lao)動養家糊口,辛苦勞(lao)(lao)作(zuo)一年,收(shou)入卻(que)十分微薄;或是擠進了那(nei)些(xie)令人(ren)(ren)羨慕的機(ji)關事(shi)業單位,可在單位內部卻(que)始終無法享受到與“編制內”人(ren)(ren)員(yuan)同等的待遇。

不(bu)過,在濟南市(shi)歷下區,所(suo)有“非(fei)正式”一線環衛(wei)工(gong)(gong)人不(bu)僅有單位辦理的(de)五險一金,能享受月(yue)工(gong)(gong)資(zi)每年上漲100元(yuan)的(de)工(gong)(gong)資(zi)待(dai)遇自然增長機(ji)制,每年還(huan)能領(ling)到過節(jie)費、取暖費、高溫(wen)補助(zhu)等總計(ji)2600元(yuan)左(zuo)右的(de)福利。用歷下區環衛(wei)工(gong)(gong)老孔的(de)話來(lai)(lai)說,“待(dai)遇越(yue)來(lai)(lai)越(yue)好,跟正式工(gong)(gong)之間的(de)差距也越(yue)來(lai)(lai)越(yue)小(xiao)啦。”

勞(lao)(lao)(lao)動(dong)報酬(chou)權是(shi)勞(lao)(lao)(lao)動(dong)者的(de)基(ji)本(ben)勞(lao)(lao)(lao)動(dong)權利(li)。《勞(lao)(lao)(lao)動(dong)法(fa)》第(di)46條明確規定:“工(gong)(gong)(gong)資分(fen)配應(ying)當(dang)遵循(xun)按勞(lao)(lao)(lao)分(fen)配原則,實(shi)行同(tong)(tong)工(gong)(gong)(gong)同(tong)(tong)酬(chou)。”想要真正(zheng)(zheng)將同(tong)(tong)工(gong)(gong)(gong)同(tong)(tong)酬(chou)落到實(shi)處,不僅要有法(fa)律保(bao)障,更需要各省(sheng)(sheng)制定符(fu)合自身情況的(de)好政(zheng)策(ce)。近年來(lai),在作(zuo)為(wei)人(ren)(ren)(ren)(ren)口大(da)省(sheng)(sheng)和用工(gong)(gong)(gong)大(da)省(sheng)(sheng)的(de)山(shan)東(dong),“同(tong)(tong)工(gong)(gong)(gong)不同(tong)(tong)酬(chou)”現象正(zheng)(zheng)伴隨著(zhu)人(ren)(ren)(ren)(ren)社部門的(de)改(gai)革步伐而逐漸(jian)改(gai)善。2012年以來(lai),山(shan)東(dong)大(da)力推(tui)進(jin)規范(fan)勞(lao)(lao)(lao)務派遣和同(tong)(tong)工(gong)(gong)(gong)同(tong)(tong)酬(chou)工(gong)(gong)(gong)作(zuo),省(sheng)(sheng)人(ren)(ren)(ren)(ren)社廳聯合有關(guan)部門連續推(tui)出相關(guan)政(zheng)策(ce)文件(jian),針(zhen)對不同(tong)(tong)的(de)用人(ren)(ren)(ren)(ren)單位(wei)和不同(tong)(tong)的(de)勞(lao)(lao)(lao)動(dong)者,分(fen)類施策(ce),從規范(fan)企(qi)(qi)業(ye)(ye)(ye)勞(lao)(lao)(lao)務派遣用工(gong)(gong)(gong)行為(wei)、保(bao)護機(ji)關(guan)事(shi)(shi)業(ye)(ye)(ye)單位(wei)編外人(ren)(ren)(ren)(ren)員(yuan)(yuan)合法(fa)權益、保(bao)障農民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資支付等多(duo)個側面和角度來(lai)推(tui)進(jin)同(tong)(tong)工(gong)(gong)(gong)同(tong)(tong)酬(chou)落實(shi)。目前(qian),全(quan)省(sheng)(sheng)企(qi)(qi)業(ye)(ye)(ye)已經基(ji)本(ben)落實(shi)同(tong)(tong)工(gong)(gong)(gong)同(tong)(tong)酬(chou),機(ji)關(guan)事(shi)(shi)業(ye)(ye)(ye)單位(wei)同(tong)(tong)工(gong)(gong)(gong)同(tong)(tong)酬(chou)工(gong)(gong)(gong)作(zuo)正(zheng)(zheng)式(shi)起(qi)步并在全(quan)國領先,對于勞(lao)(lao)(lao)務派遣人(ren)(ren)(ren)(ren)員(yuan)(yuan)、臨時工(gong)(gong)(gong)、編外人(ren)(ren)(ren)(ren)員(yuan)(yuan)來(lai)說,同(tong)(tong)工(gong)(gong)(gong)同(tong)(tong)酬(chou)已不再是(shi)個夢。

五險(xian)一(yi)金全(quan)覆蓋(gai),濟(ji)南(nan)歷下區環衛工幸福(fu)指(zhi)數(shu)直線(xian)上升。

“干了(le)16年(nian)(nian)環(huan)衛工(gong)(gong),最近這幾年(nian)(nian)明顯感覺到待遇比以(yi)前好多(duo)啦。”50歲的老(lao)孔(kong)是(shi)濟南市歷下區(qu)城管局解放路(lu)環(huan)衛所的一(yi)名環(huan)衛工(gong)(gong),常年(nian)(nian)負(fu)責歷山路(lu)沿線(xian)約500米的一(yi)段(duan)路(lu)面衛生工(gong)(gong)作(zuo)。老(lao)孔(kong)說,他所在的環(huan)衛所有一(yi)百多(duo)人(ren)(ren),絕(jue)大多(duo)數是(shi)在一(yi)線(xian)工(gong)(gong)作(zuo)的環(huan)衛工(gong)(gong)人(ren)(ren),大伙兒的一(yi)個共同特點就是(shi)“非正(zheng)式工(gong)(gong)”。以(yi)前,“非正(zheng)式工(gong)(gong)”的工(gong)(gong)資(zi)比正(zheng)式員(yuan)工(gong)(gong)低不(bu)少,更別提醫療、養老(lao)等(deng)方面的保(bao)障了(le)。

變化始(shi)(shi)于3年前。老(lao)孔告訴記者,2012年起,他(ta)和工(gong)(gong)友們(men)陸續接到單位辦理五(wu)(wu)險(xian)一金的通知,“剛開始(shi)(shi)咱(zan)根(gen)本弄不(bu)清這五(wu)(wu)險(xian)一金有(you)啥好處(chu),后來(lai)明白了,這可(ke)是(shi)咱(zan)后半輩子的保障。”老(lao)孔笑著(zhu)說,除了五(wu)(wu)險(xian)一金,每年的冬(dong)季取暖費、夏季高(gao)溫(wen)補助、過節慰問品、每月5斤雞蛋等福利一樣不(bu)少,而且不(bu)分正(zheng)式(shi)工(gong)(gong)和“非(fei)正(zheng)式(shi)工(gong)(gong)”,每個環衛工(gong)(gong)都有(you)。

據歷下(xia)區城(cheng)市管理(li)局相關負責人(ren)(ren)(ren)(ren)(ren)介紹,目前,歷下(xia)區城(cheng)管局有16個(ge)環(huan)(huan)(huan)(huan)衛(wei)所(suo),每(mei)個(ge)所(suo)有一百多(duo)名員工(gong)(gong)(gong)(gong),絕(jue)大多(duo)數(shu)(shu)都(dou)是勞務(wu)派遣人(ren)(ren)(ren)(ren)(ren)員,光是一線(xian)(xian)環(huan)(huan)(huan)(huan)衛(wei)工(gong)(gong)(gong)(gong)加起來就將(jiang)近(jin)2000人(ren)(ren)(ren)(ren)(ren)。2012年(nian)(nian)3月(yue),區里開始(shi)為(wei)一線(xian)(xian)環(huan)(huan)(huan)(huan)衛(wei)工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)(ren)(ren)辦(ban)理(li)五(wu)險一金,并對(dui)超齡(ling)人(ren)(ren)(ren)(ren)(ren)員設置專人(ren)(ren)(ren)(ren)(ren)專項賬戶,向(xiang)不符合入保條件的(de)一線(xian)(xian)環(huan)(huan)(huan)(huan)衛(wei)工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)(ren)(ren)發放補貼;為(wei)環(huan)(huan)(huan)(huan)衛(wei)工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)(ren)(ren)建立工(gong)(gong)(gong)(gong)資待遇自然(ran)增(zeng)長機制,每(mei)年(nian)(nian)為(wei)一線(xian)(xian)環(huan)(huan)(huan)(huan)衛(wei)工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)(ren)(ren)每(mei)人(ren)(ren)(ren)(ren)(ren)每(mei)月(yue)增(zeng)長工(gong)(gong)(gong)(gong)資100元;提供免費的(de)環(huan)(huan)(huan)(huan)衛(wei)工(gong)(gong)(gong)(gong)公寓,并對(dui)暫無住房(fang)的(de)外(wai)來環(huan)(huan)(huan)(huan)衛(wei)工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)(ren)(ren)提供住房(fang)補貼等。經過3年(nian)(nian)多(duo)的(de)不懈努力,如(ru)今,歷下(xia)區環(huan)(huan)(huan)(huan)衛(wei)工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)(ren)(ren)平均月(yue)工(gong)(gong)(gong)(gong)資達到2000余(yu)元,高于最(zui)低(di)工(gong)(gong)(gong)(gong)資標準25%,此外(wai),每(mei)人(ren)(ren)(ren)(ren)(ren)每(mei)年(nian)(nian)可領到2600元左(zuo)右(you)的(de)各(ge)項福(fu)利補貼。吃(chi)飯住房(fang)不用(yong)發愁,工(gong)(gong)(gong)(gong)資福(fu)利年(nian)(nian)年(nian)(nian)上漲,生病退休(xiu)有了(le)保障,全區環(huan)(huan)(huan)(huan)衛(wei)工(gong)(gong)(gong)(gong)人(ren)(ren)(ren)(ren)(ren)再也(ye)不用(yong)為(wei)了(le)“非正式工(gong)(gong)(gong)(gong)”的(de)身份發愁,幸福(fu)指數(shu)(shu)直線(xian)(xian)上升。

督促企業落實同工同酬,中(zhong)行2960名派遣員工完成身份轉換。

勞(lao)務(wu)派(pai)遣用(yong)(yong)工(gong)(gong)(gong)是企(qi)業(ye)合(he)同(tong)制用(yong)(yong)工(gong)(gong)(gong)的(de)(de)(de)補(bu)充(chong)形式(shi),目的(de)(de)(de)是解決企(qi)業(ye)臨時性(xing)(xing)用(yong)(yong)工(gong)(gong)(gong)和(he)(he)勞(lao)動(dong)者短期就(jiu)業(ye)的(de)(de)(de)問(wen)題。但在實踐中,這(zhe)一(yi)(yi)(yi)補(bu)充(chong)性(xing)(xing)用(yong)(yong)工(gong)(gong)(gong)制度被一(yi)(yi)(yi)些(xie)單(dan)(dan)(dan)位(wei)濫用(yong)(yong):一(yi)(yi)(yi)些(xie)用(yong)(yong)工(gong)(gong)(gong)單(dan)(dan)(dan)位(wei)在同(tong)一(yi)(yi)(yi)工(gong)(gong)(gong)作崗(gang)位(wei)混崗(gang)使用(yong)(yong)派(pai)遣制員(yuan)工(gong)(gong)(gong)和(he)(he)本單(dan)(dan)(dan)位(wei)職工(gong)(gong)(gong),實行(xing)不同(tong)的(de)(de)(de)勞(lao)動(dong)報酬(chou)分配(pei)制度和(he)(he)辦法,派(pai)遣制員(yuan)工(gong)(gong)(gong)相對于用(yong)(yong)工(gong)(gong)(gong)單(dan)(dan)(dan)位(wei)職工(gong)(gong)(gong)勞(lao)動(dong)報酬(chou)明顯偏(pian)低(di),有(you)的(de)(de)(de)只(zhi)相當(dang)于用(yong)(yong)工(gong)(gong)(gong)單(dan)(dan)(dan)位(wei)合(he)同(tong)制職工(gong)(gong)(gong)的(de)(de)(de)50%左右,直接(jie)影響(xiang)了勞(lao)務(wu)派(pai)遣職工(gong)(gong)(gong)的(de)(de)(de)工(gong)(gong)(gong)作熱(re)情和(he)(he)歸屬(shu)感。以規范勞(lao)務(wu)派(pai)遣用(yong)(yong)工(gong)(gong)(gong)為重(zhong)(zhong)點,督促企(qi)業(ye)落(luo)實同(tong)工(gong)(gong)(gong)同(tong)酬(chou),成(cheng)為我省(sheng)推(tui)進相關改革的(de)(de)(de)又一(yi)(yi)(yi)重(zhong)(zhong)要舉措。

以中(zhong)(zhong)國銀(yin)行(xing)山東(dong)(dong)省分(fen)行(xing)為例,到2013年末(mo),該行(xing)仍有(you)(you)(you)近3000名派(pai)遣(qian)(qian)員(yuan)(yuan)(yuan)工(gong),占全(quan)行(xing)員(yuan)(yuan)(yuan)工(gong)總數的17.09%。在這(zhe)些派(pai)遣(qian)(qian)員(yuan)(yuan)(yuan)工(gong)中(zhong)(zhong),有(you)(you)(you)90%左右都在各個營(ying)業(ye)網點工(gong)作(zuo),是銀(yin)行(xing)基層隊伍(wu)的重(zhong)要組成部分(fen),可由于受(shou)到“勞務派(pai)遣(qian)(qian)”的身份限制(zhi),他們在工(gong)資待遇(yu)方面(mian)與正式員(yuan)(yuan)(yuan)工(gong)仍有(you)(you)(you)一定(ding)差距。不過(guo),這(zhe)一現象在近兩年得到了有(you)(you)(you)效改善,通過(guo)制(zhi)定(ding)《中(zhong)(zhong)國銀(yin)行(xing)山東(dong)(dong)省分(fen)行(xing)調(diao)整勞務派(pai)遣(qian)(qian)用(yong)工(gong)管理政(zheng)策工(gong)作(zuo)方案》,中(zhong)(zhong)行(xing)山東(dong)(dong)省分(fen)行(xing)明確了以勞動合(he)同用(yong)工(gong)作(zuo)為基本用(yong)工(gong)形(xing)式,2014年以來,全(quan)轄2960名派(pai)遣(qian)(qian)員(yuan)(yuan)(yuan)工(gong)已全(quan)部轉換(huan)為合(he)同制(zhi)員(yuan)(yuan)(yuan)工(gong),整個轉換(huan)過(guo)程(cheng)公開透明,有(you)(you)(you)效保障了員(yuan)(yuan)(yuan)工(gong)利益。

記者從省(sheng)人(ren)社廳了(le)解(jie)到(dao),為促(cu)進(jin)勞(lao)(lao)動(dong)者短期就(jiu)業(ye),從源頭上解(jie)決和減少同工同酬問(wen)題,山東在完善用工機制、規(gui)范勞(lao)(lao)務派(pai)(pai)(pai)遣(qian)(qian)(qian)方面(mian)采取(qu)了(le)一系(xi)列措施。一方面(mian)嚴格執行人(ren)力資源社會保障部《勞(lao)(lao)務派(pai)(pai)(pai)遣(qian)(qian)(qian)行政許(xu)可(ke)實施辦法》,自(zi)2013年7月1日起,對(dui)新設立的(de)勞(lao)(lao)務派(pai)(pai)(pai)遣(qian)(qian)(qian)單位(wei)經(jing)(jing)(jing)營(ying)勞(lao)(lao)務派(pai)(pai)(pai)遣(qian)(qian)(qian)業(ye)務實行行政許(xu)可(ke);對(dui)已經(jing)(jing)(jing)經(jing)(jing)(jing)營(ying)勞(lao)(lao)務派(pai)(pai)(pai)遣(qian)(qian)(qian)業(ye)務的(de)勞(lao)(lao)務派(pai)(pai)(pai)遣(qian)(qian)(qian)單位(wei),要求其在一年內取(qu)得經(jing)(jing)(jing)營(ying)勞(lao)(lao)務派(pai)(pai)(pai)遣(qian)(qian)(qian)業(ye)務的(de)行政許(xu)可(ke);自(zi)2014年7月1日起,未取(qu)得行政許(xu)可(ke)的(de),任何單位(wei)和個人(ren)不(bu)得經(jing)(jing)(jing)營(ying)勞(lao)(lao)務派(pai)(pai)(pai)遣(qian)(qian)(qian)業(ye)務。截至目(mu)前,全省(sheng)已對(dui)1067戶派(pai)(pai)(pai)遣(qian)(qian)(qian)單位(wei)實施許(xu)可(ke)。

另一(yi)方面則是從(cong)(cong)嚴控制用(yong)(yong)工(gong)(gong)企業(ye)使用(yong)(yong)派遣(qian)制員工(gong)(gong)的(de)(de)比(bi)例(li)。以(yi)獨(du)立法(fa)人(ren)(ren)單位(wei)的(de)(de)所有職工(gong)(gong)為基(ji)數進(jin)行(xing)核(he)算,從(cong)(cong)使用(yong)(yong)勞(lao)務派遣(qian)工(gong)(gong)的(de)(de)比(bi)例(li)上進(jin)行(xing)限制。對(dui)超過規定(ding)比(bi)例(li)使用(yong)(yong)勞(lao)務派遣(qian)工(gong)(gong)的(de)(de)用(yong)(yong)工(gong)(gong)單位(wei),依照法(fa)律(lv)規定(ding)每(mei)超過1人(ren)(ren)處以(yi)5000元以(yi)上20000元以(yi)下的(de)(de)罰(fa)款。對(dui)個別(bie)國(guo)有企業(ye)的(de)(de)特殊情(qing)況,采取企業(ye)申請(qing)、報(bao)人(ren)(ren)力資源社會保(bao)障行(xing)政(zheng)部門(men)備案(an)的(de)(de)辦法(fa),在規定(ding)時間(jian)內實現(xian)過渡(du)。

省委省政(zheng)府帶頭(tou)落(luo)實同(tong)(tong)工同(tong)(tong)酬,編外人員月(yue)工資提高400元(yuan)。

近(jin)年(nian)來,隨著社(she)(she)會公共(gong)服(fu)務(wu)需求(qiu)的(de)不(bu)斷擴大(da),一(yi)些機關(guan)(guan)事業單(dan)位(wei)使(shi)用了大(da)量(liang)的(de)編外人員(yuan)(yuan)。據省人社(she)(she)廳勞動(dong)關(guan)(guan)系處相關(guan)(guan)負責人介紹,機關(guan)(guan)事業單(dan)位(wei)未納(na)入(ru)正(zheng)式職(zhi)工管理(li)人員(yuan)(yuan)主要(yao)有三(san)種形式:單(dan)位(wei)直(zhi)接簽訂勞動(dong)合同人員(yuan)(yuan)、單(dan)位(wei)使(shi)用的(de)勞務(wu)派遣人員(yuan)(yuan)、單(dan)位(wei)按(an)照機關(guan)(guan)事業單(dan)位(wei)人員(yuan)(yuan)管理(li)方式聘用的(de)人員(yuan)(yuan)。他們中(zhong)的(de)不(bu)少人做(zuo)著跟(gen)“編制內”人員(yuan)(yuan)差不(bu)多(duo)的(de)工作,可獲得的(de)報酬卻有不(bu)小差距(ju)。

如今,編(bian)制(zhi)內外(wai)看似“鐵板一塊”的待遇差距正(zheng)在逐步(bu)縮小。全國人(ren)大關(guan)于修(xiu)改勞動合同(tong)法的決定公布后,山(shan)東(dong)加(jia)強對(dui)用工(gong)(gong)(gong)單位(wei)的執法檢(jian)查(cha),召開了機(ji)關(guan)事(shi)業單位(wei)推(tui)進同(tong)工(gong)(gong)(gong)同(tong)酬工(gong)(gong)(gong)作(zuo)座談會,結(jie)合全省(sheng)機(ji)關(guan)事(shi)業單位(wei)“吃空餉”專項整治(zhi)工(gong)(gong)(gong)作(zuo),妥善(shan)處理機(ji)關(guan)事(shi)業單位(wei)歷史(shi)形成的編(bian)制(zhi)外(wai)人(ren)員問題,積極推(tui)進機(ji)關(guan)事(shi)業單位(wei)同(tong)工(gong)(gong)(gong)同(tong)酬。據了解(jie),2014年12月(yue)1日(ri)起,省(sheng)委、省(sheng)人(ren)大、省(sheng)政府、省(sheng)政協辦(ban)公廳將編(bian)外(wai)人(ren)員中的汽車司機(ji)、廚師、水電維修(xiu)工(gong)(gong)(gong)等技能(neng)崗位(wei)和(he)其他崗位(wei)人(ren)員的月(yue)工(gong)(gong)(gong)資(zi)提(ti)高達2100元和(he)2000元,較之(zhi)前分別提(ti)高400元和(he)300元,工(gong)(gong)(gong)資(zi)水平超過了濟南市同(tong)類職(zhi)業人(ren)員工(gong)(gong)(gong)資(zi)指導價位(wei)低位(wei)數(shu)。

記(ji)者從(cong)省(sheng)人(ren)社廳了解到,截至2014年底,全(quan)省(sheng)多(duo)數(shu)省(sheng)直(zhi)機關事業(ye)單位(wei)已(yi)經(jing)按照(zhao)要求對編外人(ren)員管理進(jin)行了規范(fan),一(yi)部(bu)分單位(wei)將“臨時人(ren)員”改為規范(fan)的勞務派遣用(yong)工(gong)(gong),一(yi)部(bu)分單位(wei)改為直(zhi)接(jie)簽訂(ding)勞動合同,按照(zhao)社會保(bao)險(xian)法規定參(can)加社會保(bao)險(xian),工(gong)(gong)資水平也有了一(yi)定程(cheng)度提高,部(bu)分編外人(ren)員的工(gong)(gong)資收(shou)入(ru)已(yi)經(jing)達到或接(jie)近同崗位(wei)、同等資歷人(ren)員的收(shou)入(ru)水平。

2015年3月(yue),山東省(sheng)在深入(ru)調研基礎上,以保障勞動(dong)者(zhe)合法(fa)權益為切入(ru)點,出(chu)臺了(le)《關于(yu)維護(hu)機(ji)關事(shi)業(ye)(ye)(ye)單(dan)(dan)位未納入(ru)正(zheng)式職(zhi)工管(guan)(guan)理(li)人(ren)員(yuan)勞動(dong)保障權益的(de)通知》:明(ming)確(que)了(le)機(ji)關事(shi)業(ye)(ye)(ye)單(dan)(dan)位未納入(ru)正(zheng)式職(zhi)工管(guan)(guan)理(li)的(de)人(ren)員(yuan)的(de)管(guan)(guan)理(li)方式;規(gui)定(ding)(ding)了(le)機(ji)關事(shi)業(ye)(ye)(ye)單(dan)(dan)位使用未納入(ru)正(zheng)式職(zhi)工管(guan)(guan)理(li)的(de)人(ren)員(yuan),應當為其(qi)繳納相應的(de)“五(wu)險一金(jin)”;明(ming)確(que)要求機(ji)關事(shi)業(ye)(ye)(ye)單(dan)(dan)位要制(zhi)定(ding)(ding)符合同工同酬分配(pei)原則的(de)勞動(dong)報酬分配(pei)辦法(fa)……對于(yu)多數(shu)身在機(ji)關事(shi)業(ye)(ye)(ye)單(dan)(dan)位的(de)編(bian)外人(ren)員(yuan)來(lai)說,這無疑(yi)將帶來(lai)真正(zheng)的(de)福音(yin)。

同(tong)(tong)工(gong)同(tong)(tong)酬(chou)是(shi)指(zhi)同(tong)(tong)一個單位內(nei)同(tong)(tong)類崗位的勞(lao)動者實行相同(tong)(tong)的勞(lao)動報酬(chou)分配辦法(fa),通過各種制度、措施逐步減少收入差(cha)距,是(shi)現(xian)階段落實同(tong)(tong)工(gong)同(tong)(tong)酬(chou)的工(gong)作方向。2012年12月28日全國人大常委會決(jue)定修(xiu)改《勞(lao)動合(he)同(tong)(tong)法(fa)》后,山(shan)東省加快了《山(shan)東省勞(lao)動合(he)同(tong)(tong)條例(li)》的修(xiu)訂工(gong)作,針對勞(lao)務派遣、同(tong)(tong)工(gong)同(tong)(tong)酬(chou)問(wen)題開展專(zhuan)題調研,進(jin)一步完善勞(lao)務派遣的法(fa)律(lv)規(gui)定。

為便于(yu)各地(di)準(zhun)確掌握同(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)(chou)的(de)(de)(de)(de)(de)內(nei)涵(han),便于(yu)實際操(cao)作(zuo),省人(ren)社廳召開不同(tong)(tong)(tong)(tong)(tong)類(lei)(lei)型(xing)、不同(tong)(tong)(tong)(tong)(tong)層次的(de)(de)(de)(de)(de)研討會(hui),反復征求地(di)方主管(guan)部門、用(yong)(yong)人(ren)單位(wei)(wei)(wei)意見,并(bing)商人(ren)力(li)資源社會(hui)保障部同(tong)(tong)(tong)(tong)(tong)意后(hou),形成了對同(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)(chou)進行(xing)界(jie)定(ding)的(de)(de)(de)(de)(de)初(chu)步意見:一是(shi)用(yong)(yong)工(gong)(gong)(gong)單位(wei)(wei)(wei)使用(yong)(yong)勞(lao)務(wu)派(pai)(pai)遣工(gong)(gong)(gong)應(ying)嚴格限定(ding)在臨時性(xing)、輔(fu)助性(xing)或者替代性(xing)工(gong)(gong)(gong)作(zuo)崗(gang)位(wei)(wei)(wei)的(de)(de)(de)(de)(de)范圍之內(nei),不得(de)超過(guo)國家規定(ding)的(de)(de)(de)(de)(de)比例(li)。二是(shi)用(yong)(yong)工(gong)(gong)(gong)單位(wei)(wei)(wei)在2012年12月(yue)28日前與(yu)勞(lao)務(wu)派(pai)(pai)遣單位(wei)(wei)(wei)簽訂的(de)(de)(de)(de)(de)勞(lao)務(wu)派(pai)(pai)遣協議、勞(lao)務(wu)派(pai)(pai)遣單位(wei)(wei)(wei)簽訂的(de)(de)(de)(de)(de)勞(lao)動合同(tong)(tong)(tong)(tong)(tong),除違背同(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)(chou)原則的(de)(de)(de)(de)(de)內(nei)容外,應(ying)當繼續(xu)履行(xing)至期限屆滿。三是(shi)用(yong)(yong)工(gong)(gong)(gong)單位(wei)(wei)(wei)應(ying)當按照同(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)(chou)原則,對被派(pai)(pai)遣勞(lao)動者與(yu)本單位(wei)(wei)(wei)同(tong)(tong)(tong)(tong)(tong)類(lei)(lei)崗(gang)位(wei)(wei)(wei)的(de)(de)(de)(de)(de)勞(lao)動者實行(xing)相同(tong)(tong)(tong)(tong)(tong)的(de)(de)(de)(de)(de)勞(lao)動報酬(chou)(chou)(chou)分配辦法。用(yong)(yong)工(gong)(gong)(gong)單位(wei)(wei)(wei)無同(tong)(tong)(tong)(tong)(tong)類(lei)(lei)崗(gang)位(wei)(wei)(wei)勞(lao)動者的(de)(de)(de)(de)(de),應(ying)當參(can)照當地(di)人(ren)力(li)資源市場工(gong)(gong)(gong)資指導價(jia)位(wei)(wei)(wei),做(zuo)到同(tong)(tong)(tong)(tong)(tong)工(gong)(gong)(gong)同(tong)(tong)(tong)(tong)(tong)酬(chou)(chou)(chou)。

2013年8月1日(ri)修訂的(de)《山東省勞(lao)(lao)動合同條例》第四十(shi)(shi)八條規(gui)(gui)定,細化勞(lao)(lao)務派遣(qian)關于“臨時(shi)性、輔助性、替(ti)代(dai)性”崗(gang)位(wei)(wei)的(de)規(gui)(gui)定,明(ming)確(que)(que)“替(ti)代(dai)性工(gong)作(zuo)崗(gang)位(wei)(wei)是指(zhi)用(yong)(yong)工(gong)單位(wei)(wei)的(de)勞(lao)(lao)動者因(yin)脫產學習、休假等原因(yin)無(wu)法工(gong)作(zuo),一年之內可(ke)以由其他(ta)勞(lao)(lao)動者替(ti)代(dai)工(gong)作(zuo)的(de)崗(gang)位(wei)(wei)”,進一步明(ming)確(que)(que)了“替(ti)代(dai)性工(gong)作(zuo)崗(gang)位(wei)(wei)”的(de)適用(yong)(yong)范圍,有(you)效(xiao)壓縮了企業大規(gui)(gui)模使用(yong)(yong)勞(lao)(lao)務派遣(qian)工(gong)的(de)空間。《條例》還(huan)明(ming)確(que)(que)了同工(gong)同酬(chou)的(de)實質,第五(wu)十(shi)(shi)條明(ming)確(que)(que)要求,“用(yong)(yong)工(gong)單位(wei)(wei)應當保障被派遣(qian)勞(lao)(lao)動者與本單位(wei)(wei)職工(gong)享有(you)同工(gong)同酬(chou)的(de)權利,實行相同的(de)勞(lao)(lao)動報(bao)酬(chou)分配辦(ban)法。”
