“十一”假期即將來臨。由于工作需要,不少職工仍需堅守在工作崗位上。用人單位安排勞動者假期上班,加班工資如何計算?國家對支付加班工資有哪些規定?
問:國家對支付加班工資有哪些規定?
主持人:根(gen)據《勞(lao)(lao)(lao)(lao)動(dong)(dong)合同法(fa)》規定,用人單位(wei)(wei)應(ying)當嚴格執行勞(lao)(lao)(lao)(lao)動(dong)(dong)定額(e)標準,不(bu)得強(qiang)(qiang)迫或(huo)變相強(qiang)(qiang)迫勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)加(jia)班。用人單位(wei)(wei)安排(pai)(pai)加(jia)班的(de),應(ying)當按照國家有(you)關規定向勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)支付加(jia)班費。用人單位(wei)(wei)應(ying)當按照下(xia)列標準支付高于勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)正常工(gong)(gong)(gong)(gong)(gong)作時間(jian)工(gong)(gong)(gong)(gong)(gong)資的(de)工(gong)(gong)(gong)(gong)(gong)資報(bao)酬(chou):一是安排(pai)(pai)勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)延(yan)長工(gong)(gong)(gong)(gong)(gong)作時間(jian)的(de),支付不(bu)低(di)(di)于工(gong)(gong)(gong)(gong)(gong)資150%的(de)工(gong)(gong)(gong)(gong)(gong)資報(bao)酬(chou);二是休息日安排(pai)(pai)勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)工(gong)(gong)(gong)(gong)(gong)作又(you)不(bu)能安排(pai)(pai)補(bu)休的(de),支付不(bu)低(di)(di)于工(gong)(gong)(gong)(gong)(gong)資200%的(de)工(gong)(gong)(gong)(gong)(gong)資報(bao)酬(chou);三是法(fa)定休假(jia)日安排(pai)(pai)勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)工(gong)(gong)(gong)(gong)(gong)作的(de),支付不(bu)低(di)(di)于工(gong)(gong)(gong)(gong)(gong)資300%的(de)工(gong)(gong)(gong)(gong)(gong)資報(bao)酬(chou)。
問:“十一”期間加班費應該如何計算?
主(zhu)持人(ren):根據(ju)國務院(yuan)辦公廳《關于(yu)2018年部分節假(jia)日安(an)排的(de)(de)(de)通知》,10月(yue)(yue)1日至(zhi)10月(yue)(yue)7日放假(jia)調(diao)休,共7天。其中,10月(yue)(yue)1日至(zhi)10月(yue)(yue)3日為法定休假(jia)日。按照(zhao)前述規定,用人(ren)單位在(zai)這三(san)天安(an)排勞(lao)動(dong)者加(jia)班的(de)(de)(de),應(ying)按照(zhao)不低(di)(di)于(yu)勞(lao)動(dong)者本人(ren)上(shang)一(yi)個(ge)月(yue)(yue)平均(jun)日工(gong)資或小時工(gong)資的(de)(de)(de)三(san)倍另行支(zhi)付加(jia)班工(gong)資;10月(yue)(yue)4日至(zhi)7日為休息(xi)日放假(jia),如果用人(ren)單位在(zai)這四天休息(xi)日安(an)排勞(lao)動(dong)者加(jia)班又不能安(an)排補休的(de)(de)(de),應(ying)支(zhi)付不低(di)(di)于(yu)兩倍工(gong)資的(de)(de)(de)工(gong)資報酬。
在計算(suan)加(jia)班工(gong)資(zi)時,日(ri)工(gong)資(zi)按平均每月計薪天(tian)數21.75天(tian)折算(suan),小時工(gong)資(zi)則在日(ri)工(gong)資(zi)的(de)基礎上(shang)再除以(yi)8小時。例如,在10月2日(ri)法(fa)定(ding)休假日(ri)加(jia)班,這一天(tian)的(de)加(jia)班工(gong)資(zi)計算(suan)公(gong)式為(月工(gong)資(zi)÷21.75×300%)。
問:用人單位可以強迫員工長時間加班嗎?
主(zhu)持人:根據相關規定,用人單位未與工(gong)會和勞(lao)動者(zhe)(zhe)協商,強迫勞(lao)動者(zhe)(zhe)延長工(gong)作時間(jian)的,應給(gei)予警告(gao),責令改(gai)正,并(bing)可按每名勞(lao)動者(zhe)(zhe)每延長工(gong)作時間(jian)一(yi)小時罰款一(yi)百(bai)元以下(xia)的標準處罰。此外,用人單位安排懷(huai)孕七個月以上(shang)的女(nv)職工(gong)延長工(gong)作時間(jian)和從事夜班勞(lao)動等行為也是不允許的。
需(xu)(xu)(xu)要(yao)說明的(de)(de)是(shi),職工(gong)并(bing)非在任何(he)情況下(xia)都能拒絕加班。用人單位(wei)由于生(sheng)產(chan)經(jing)(jing)營需(xu)(xu)(xu)要(yao),經(jing)(jing)與工(gong)會和勞動者協(xie)商后可以(yi)延長工(gong)作(zuo)時(shi)間(jian)(jian),一(yi)般每日(ri)(ri)不得超(chao)過1小(xiao)時(shi)。此外,為(wei)保(bao)障公眾利(li)益的(de)(de)需(xu)(xu)(xu)要(yao),勞動法(fa)規(gui)定單位(wei)在某些特殊情況,如必須利(li)用法(fa)定節假日(ri)(ri)或公休(xiu)假日(ri)(ri)的(de)(de)停產(chan)期(qi)間(jian)(jian)檢修、保(bao)養設(she)備(bei)等情況,延長工(gong)作(zuo)時(shi)間(jian)(jian)可不受相關限制。因特殊原因需(xu)(xu)(xu)要(yao)延長工(gong)作(zuo)時(shi)間(jian)(jian)的(de)(de),在保(bao)障勞動者身體健康的(de)(de)條件下(xia),延長工(gong)作(zuo)時(shi)間(jian)(jian)每天(tian)不得超(chao)過3小(xiao)時(shi)。
