“十一”加班 先算算加班費

“十一”假期即將來臨。由于工作需要,不少職工仍需堅守在工作崗位上。用人單位安排勞動者假期上班,加班工資如何計算?國家對支付加班工資有哪些規定?

  問:國家對支付加班工資有哪些規定?

  主持人:根據《勞(lao)(lao)動合同法》規定(ding),用人單位應當嚴格(ge)執(zhi)行勞(lao)(lao)動定(ding)額標準,不(bu)得強迫或變(bian)相強迫勞(lao)(lao)動者(zhe)(zhe)加班(ban)。用人單位安排(pai)加班(ban)的(de)(de),應當按(an)照(zhao)國家(jia)有關規定(ding)向勞(lao)(lao)動者(zhe)(zhe)支付加班(ban)費。用人單位應當按(an)照(zhao)下列(lie)標準支付高于勞(lao)(lao)動者(zhe)(zhe)正常工(gong)作(zuo)(zuo)時(shi)間工(gong)資的(de)(de)工(gong)資報(bao)酬:一是(shi)安排(pai)勞(lao)(lao)動者(zhe)(zhe)延長工(gong)作(zuo)(zuo)時(shi)間的(de)(de),支付不(bu)低于工(gong)資150%的(de)(de)工(gong)資報(bao)酬;二是(shi)休(xiu)(xiu)息日安排(pai)勞(lao)(lao)動者(zhe)(zhe)工(gong)作(zuo)(zuo)又不(bu)能安排(pai)補休(xiu)(xiu)的(de)(de),支付不(bu)低于工(gong)資200%的(de)(de)工(gong)資報(bao)酬;三是(shi)法定(ding)休(xiu)(xiu)假(jia)日安排(pai)勞(lao)(lao)動者(zhe)(zhe)工(gong)作(zuo)(zuo)的(de)(de),支付不(bu)低于工(gong)資300%的(de)(de)工(gong)資報(bao)酬。

  問:“十一”期間加班費應該如何計算?

  主持人(ren)(ren):根據國務院(yuan)辦公廳《關于2018年(nian)部(bu)分節假(jia)日(ri)(ri)(ri)安(an)排(pai)(pai)的通(tong)知》,10月(yue)(yue)1日(ri)(ri)(ri)至10月(yue)(yue)7日(ri)(ri)(ri)放假(jia)調休,共7天。其中,10月(yue)(yue)1日(ri)(ri)(ri)至10月(yue)(yue)3日(ri)(ri)(ri)為(wei)法定(ding)休假(jia)日(ri)(ri)(ri)。按(an)照前述規定(ding),用(yong)人(ren)(ren)單位在這三天安(an)排(pai)(pai)勞動(dong)者(zhe)加班的,應按(an)照不(bu)低(di)于勞動(dong)者(zhe)本(ben)人(ren)(ren)上(shang)一(yi)個月(yue)(yue)平(ping)均日(ri)(ri)(ri)工(gong)資(zi)或小時工(gong)資(zi)的三倍(bei)另行(xing)支(zhi)付(fu)加班工(gong)資(zi);10月(yue)(yue)4日(ri)(ri)(ri)至7日(ri)(ri)(ri)為(wei)休息(xi)(xi)日(ri)(ri)(ri)放假(jia),如果用(yong)人(ren)(ren)單位在這四天休息(xi)(xi)日(ri)(ri)(ri)安(an)排(pai)(pai)勞動(dong)者(zhe)加班又不(bu)能安(an)排(pai)(pai)補休的,應支(zhi)付(fu)不(bu)低(di)于兩倍(bei)工(gong)資(zi)的工(gong)資(zi)報酬。

  在計算加班工(gong)資(zi)(zi)(zi)時(shi),日(ri)(ri)工(gong)資(zi)(zi)(zi)按平均(jun)每月(yue)計薪天(tian)數21.75天(tian)折算,小(xiao)時(shi)工(gong)資(zi)(zi)(zi)則在日(ri)(ri)工(gong)資(zi)(zi)(zi)的基礎上再除(chu)以8小(xiao)時(shi)。例如,在10月(yue)2日(ri)(ri)法定休假(jia)日(ri)(ri)加班,這一天(tian)的加班工(gong)資(zi)(zi)(zi)計算公式為(月(yue)工(gong)資(zi)(zi)(zi)÷21.75×300%)。

  問:用人單位可以強迫員工長時間加班嗎?

  主持(chi)人(ren):根據相關規定,用(yong)人(ren)單位(wei)未與(yu)工(gong)會(hui)和勞(lao)動者(zhe)協商,強迫勞(lao)動者(zhe)延長工(gong)作(zuo)時(shi)(shi)間的,應(ying)給予警告,責令改正,并可按每名勞(lao)動者(zhe)每延長工(gong)作(zuo)時(shi)(shi)間一小時(shi)(shi)罰款一百元以下(xia)的標準處(chu)罰。此(ci)外,用(yong)人(ren)單位(wei)安排(pai)懷孕(yun)七個月以上的女職工(gong)延長工(gong)作(zuo)時(shi)(shi)間和從事夜班勞(lao)動等行為也是不(bu)允許的。

  需要說(shuo)明(ming)的(de)(de)是,職工(gong)(gong)(gong)并非(fei)在任何情況(kuang)(kuang)(kuang)下都(dou)能拒絕加(jia)班。用(yong)人單位由于生產經(jing)營需要,經(jing)與工(gong)(gong)(gong)會(hui)和(he)勞(lao)動者協商后(hou)可以延(yan)長(chang)工(gong)(gong)(gong)作時(shi)間(jian)(jian),一(yi)般(ban)每日(ri)不得(de)超(chao)過1小(xiao)時(shi)。此外(wai),為(wei)保障公眾利益(yi)的(de)(de)需要,勞(lao)動法(fa)規定(ding)單位在某些特殊情況(kuang)(kuang)(kuang),如必(bi)須利用(yong)法(fa)定(ding)節假日(ri)或公休假日(ri)的(de)(de)停產期間(jian)(jian)檢修、保養(yang)設備等情況(kuang)(kuang)(kuang),延(yan)長(chang)工(gong)(gong)(gong)作時(shi)間(jian)(jian)可不受相(xiang)關(guan)限制。因特殊原因需要延(yan)長(chang)工(gong)(gong)(gong)作時(shi)間(jian)(jian)的(de)(de),在保障勞(lao)動者身體(ti)健(jian)康的(de)(de)條件下,延(yan)長(chang)工(gong)(gong)(gong)作時(shi)間(jian)(jian)每天不得(de)超(chao)過3小(xiao)時(shi)。
