  我(wo)畢(bi)業后休整一段時間(jian)就開始找工作。現在(zai),有家公司與我(wo)談過后,雙方(fang)都覺得(de)合適(shi),準備簽訂勞動(dong)合同。

  由于(yu)對勞動合同比(bi)較陌生,我想咨詢一下試用期有多久(jiu)?此外(wai),試用期的工資是如何規定的?

  答:根據《勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)法》第十九條的(de)(de)(de)規定,勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)期(qi)(qi)(qi)限(xian)(xian)(xian)三個(ge)(ge)月(yue)(yue)以(yi)(yi)上不滿(man)一(yi)(yi)年(nian)的(de)(de)(de),試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)不得(de)超(chao)過一(yi)(yi)個(ge)(ge)月(yue)(yue);勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)期(qi)(qi)(qi)限(xian)(xian)(xian)一(yi)(yi)年(nian)以(yi)(yi)上不滿(man)三年(nian)的(de)(de)(de),試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)不得(de)超(chao)過二個(ge)(ge)月(yue)(yue);三年(nian)以(yi)(yi)上固(gu)定期(qi)(qi)(qi)限(xian)(xian)(xian)和無固(gu)定期(qi)(qi)(qi)限(xian)(xian)(xian)的(de)(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong),試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)不得(de)超(chao)過六個(ge)(ge)月(yue)(yue)。同(tong)一(yi)(yi)用(yong)(yong)人單位與同(tong)一(yi)(yi)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者只能約(yue)定一(yi)(yi)次試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)。以(yi)(yi)完成一(yi)(yi)定工(gong)作任務(wu)為(wei)(wei)期(qi)(qi)(qi)限(xian)(xian)(xian)的(de)(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)或者勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)期(qi)(qi)(qi)限(xian)(xian)(xian)不滿(man)三個(ge)(ge)月(yue)(yue)的(de)(de)(de),不得(de)約(yue)定試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)。試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)包(bao)含在勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)期(qi)(qi)(qi)限(xian)(xian)(xian)內(nei)。勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)僅約(yue)定試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)的(de)(de)(de),試(shi)(shi)用(yong)(yong)期(qi)(qi)(qi)不成立(li),該期(qi)(qi)(qi)限(xian)(xian)(xian)為(wei)(wei)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)期(qi)(qi)(qi)限(xian)(xian)(xian)。

  《勞(lao)動合(he)同法》第二(er)十(shi)條規定,勞(lao)動者在試(shi)用期的工(gong)資不(bu)得低于本單(dan)位相(xiang)同崗位最(zui)低檔工(gong)資或者勞(lao)動合(he)同約定工(gong)資的百分(fen)之(zhi)八十(shi),并(bing)不(bu)得低于用人單(dan)位所在地的最(zui)低工(gong)資標準(zhun)。

  據(ju)此,根據(ju)《勞動合(he)同法(fa)》第(di)十九條(tiao)、二(er)十條(tiao),試(shi)用期(qi)的(de)長短應根據(ju)勞動合(he)同的(de)期(qi)限來具(ju)體規定,試(shi)用期(qi)的(de)工(gong)(gong)資(zi)不得低(di)于(yu)本單位相(xiang)同崗位最(zui)低(di)檔工(gong)(gong)資(zi)或(huo)者勞動合(he)同約定工(gong)(gong)資(zi)的(de)80%,并(bing)不得低(di)于(yu)用人(ren)單位所在地的(de)最(zui)低(di)工(gong)(gong)資(zi)標準。

  第(di)十九(jiu)條 勞動合(he)同期(qi)(qi)(qi)限(xian)三個(ge)月以(yi)(yi)上(shang)不(bu)滿一年的,試用期(qi)(qi)(qi)不(bu)得超過一個(ge)月;勞動合(he)同期(qi)(qi)(qi)限(xian)一年以(yi)(yi)上(shang)不(bu)滿三年的,試用期(qi)(qi)(qi)不(bu)得超過二個(ge)月;三年以(yi)(yi)上(shang)固定(ding)期(qi)(qi)(qi)限(xian)和無固定(ding)期(qi)(qi)(qi)限(xian)的勞動合(he)同,試用期(qi)(qi)(qi)不(bu)得超過六個(ge)月。

  同一用(yong)(yong)人單(dan)位與同一勞動者(zhe)只(zhi)能約(yue)定一次試(shi)用(yong)(yong)期。

  以完(wan)成一定(ding)(ding)工作任務為期(qi)限(xian)的(de)勞(lao)動合同(tong)或(huo)者勞(lao)動合同(tong)期(qi)限(xian)不滿三(san)個(ge)月的(de),不得約定(ding)(ding)試用期(qi)。

  試(shi)(shi)用期(qi)包含(han)在勞(lao)動合(he)同(tong)期(qi)限(xian)內(nei)。勞(lao)動合(he)同(tong)僅(jin)約定試(shi)(shi)用期(qi)的,試(shi)(shi)用期(qi)不成立(li),該期(qi)限(xian)為(wei)勞(lao)動合(he)同(tong)期(qi)限(xian)。

  第二十條(tiao) 勞動(dong)者在試用期的(de)工資(zi)(zi)不(bu)得(de)低(di)(di)于本單(dan)位相(xiang)同崗位最低(di)(di)檔工資(zi)(zi)或者勞動(dong)合同約定(ding)工資(zi)(zi)的(de)80%,并(bing)不(bu)得(de)低(di)(di)于用人單(dan)位所(suo)在地的(de)最低(di)(di)工資(zi)(zi)標準。
