答:根據《勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)法》第十九條的(de)(de)(de)規定(ding),勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)期(qi)(qi)(qi)(qi)(qi)(qi)限(xian)三(san)個月(yue)(yue)以(yi)(yi)上(shang)(shang)不滿(man)一(yi)(yi)年的(de)(de)(de),試(shi)(shi)用(yong)期(qi)(qi)(qi)(qi)(qi)(qi)不得超過一(yi)(yi)個月(yue)(yue);勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)期(qi)(qi)(qi)(qi)(qi)(qi)限(xian)一(yi)(yi)年以(yi)(yi)上(shang)(shang)不滿(man)三(san)年的(de)(de)(de),試(shi)(shi)用(yong)期(qi)(qi)(qi)(qi)(qi)(qi)不得超過二個月(yue)(yue);三(san)年以(yi)(yi)上(shang)(shang)固定(ding)期(qi)(qi)(qi)(qi)(qi)(qi)限(xian)和(he)無(wu)固定(ding)期(qi)(qi)(qi)(qi)(qi)(qi)限(xian)的(de)(de)(de)勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong),試(shi)(shi)用(yong)期(qi)(qi)(qi)(qi)(qi)(qi)不得超過六個月(yue)(yue)。同(tong)(tong)一(yi)(yi)用(yong)人(ren)單位與(yu)同(tong)(tong)一(yi)(yi)勞動(dong)(dong)(dong)者只能約定(ding)一(yi)(yi)次試(shi)(shi)用(yong)期(qi)(qi)(qi)(qi)(qi)(qi)。以(yi)(yi)完成一(yi)(yi)定(ding)工作任務為期(qi)(qi)(qi)(qi)(qi)(qi)限(xian)的(de)(de)(de)勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)或者勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)期(qi)(qi)(qi)(qi)(qi)(qi)限(xian)不滿(man)三(san)個月(yue)(yue)的(de)(de)(de),不得約定(ding)試(shi)(shi)用(yong)期(qi)(qi)(qi)(qi)(qi)(qi)。試(shi)(shi)用(yong)期(qi)(qi)(qi)(qi)(qi)(qi)包含(han)在勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)期(qi)(qi)(qi)(qi)(qi)(qi)限(xian)內。勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)僅約定(ding)試(shi)(shi)用(yong)期(qi)(qi)(qi)(qi)(qi)(qi)的(de)(de)(de),試(shi)(shi)用(yong)期(qi)(qi)(qi)(qi)(qi)(qi)不成立,該期(qi)(qi)(qi)(qi)(qi)(qi)限(xian)為勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)期(qi)(qi)(qi)(qi)(qi)(qi)限(xian)。
《勞(lao)(lao)動(dong)合同(tong)法》第二十條規(gui)定,勞(lao)(lao)動(dong)者在試用期的工(gong)(gong)資(zi)不得(de)低于本單位(wei)相同(tong)崗(gang)位(wei)最(zui)低檔工(gong)(gong)資(zi)或者勞(lao)(lao)動(dong)合同(tong)約定工(gong)(gong)資(zi)的百分之八十,并不得(de)低于用人單位(wei)所(suo)在地(di)的最(zui)低工(gong)(gong)資(zi)標準。
據此,根據《勞動合同(tong)法(fa)》第(di)十(shi)九條、二(er)十(shi)條,試用期(qi)(qi)的(de)長(chang)短應(ying)根據勞動合同(tong)的(de)期(qi)(qi)限來具體規定,試用期(qi)(qi)的(de)工資(zi)不得(de)低(di)于(yu)本單位相(xiang)同(tong)崗(gang)位最低(di)檔工資(zi)或者勞動合同(tong)約定工資(zi)的(de)80%,并不得(de)低(di)于(yu)用人單位所在地的(de)最低(di)工資(zi)標準(zhun)。

第(di)十九條 勞(lao)動(dong)合同(tong)期(qi)限(xian)三(san)個(ge)(ge)月(yue)以(yi)(yi)上(shang)不滿(man)一年的,試(shi)用(yong)期(qi)不得(de)(de)超(chao)過(guo)一個(ge)(ge)月(yue);勞(lao)動(dong)合同(tong)期(qi)限(xian)一年以(yi)(yi)上(shang)不滿(man)三(san)年的,試(shi)用(yong)期(qi)不得(de)(de)超(chao)過(guo)二個(ge)(ge)月(yue);三(san)年以(yi)(yi)上(shang)固定期(qi)限(xian)和無固定期(qi)限(xian)的勞(lao)動(dong)合同(tong),試(shi)用(yong)期(qi)不得(de)(de)超(chao)過(guo)六個(ge)(ge)月(yue)。
同(tong)一(yi)(yi)用人單位與同(tong)一(yi)(yi)勞(lao)動者只能約定一(yi)(yi)次試(shi)用期。
以完成一定工(gong)作任務(wu)為期限(xian)的(de)勞動合同或者勞動合同期限(xian)不(bu)滿三個月的(de),不(bu)得約定試用(yong)期。
試用期(qi)包含在勞動(dong)合同期(qi)限內(nei)。勞動(dong)合同僅約定試用期(qi)的,試用期(qi)不(bu)成立,該期(qi)限為(wei)勞動(dong)合同期(qi)限。
第二十條(tiao) 勞(lao)動者(zhe)在試(shi)用(yong)(yong)期的(de)工(gong)(gong)資(zi)不(bu)得(de)低(di)于本(ben)單(dan)位相同崗(gang)位最低(di)檔工(gong)(gong)資(zi)或者(zhe)勞(lao)動合同約定(ding)工(gong)(gong)資(zi)的(de)80%,并不(bu)得(de)低(di)于用(yong)(yong)人單(dan)位所在地的(de)最低(di)工(gong)(gong)資(zi)標準(zhun)。
