  我畢業后(hou)休整一段時間就開始(shi)找(zhao)工作(zuo)。現在,有家公司與(yu)我談(tan)過后(hou),雙方都覺得合適,準備簽訂勞動合同。

  由于對勞動合同比較陌生,我(wo)想咨詢一下試用(yong)期有多(duo)久(jiu)?此外,試用(yong)期的工資是如何規(gui)定的?

  答:根據《勞(lao)動(dong)(dong)(dong)合同(tong)(tong)法》第十九條(tiao)的(de)(de)(de)規(gui)定(ding),勞(lao)動(dong)(dong)(dong)合同(tong)(tong)期(qi)(qi)(qi)限三個(ge)月(yue)(yue)以(yi)(yi)上不(bu)(bu)滿一(yi)(yi)年(nian)的(de)(de)(de),試用(yong)(yong)期(qi)(qi)(qi)不(bu)(bu)得超(chao)過(guo)一(yi)(yi)個(ge)月(yue)(yue);勞(lao)動(dong)(dong)(dong)合同(tong)(tong)期(qi)(qi)(qi)限一(yi)(yi)年(nian)以(yi)(yi)上不(bu)(bu)滿三年(nian)的(de)(de)(de),試用(yong)(yong)期(qi)(qi)(qi)不(bu)(bu)得超(chao)過(guo)二個(ge)月(yue)(yue);三年(nian)以(yi)(yi)上固定(ding)期(qi)(qi)(qi)限和(he)無固定(ding)期(qi)(qi)(qi)限的(de)(de)(de)勞(lao)動(dong)(dong)(dong)合同(tong)(tong),試用(yong)(yong)期(qi)(qi)(qi)不(bu)(bu)得超(chao)過(guo)六個(ge)月(yue)(yue)。同(tong)(tong)一(yi)(yi)用(yong)(yong)人單(dan)位與同(tong)(tong)一(yi)(yi)勞(lao)動(dong)(dong)(dong)者只能約(yue)定(ding)一(yi)(yi)次試用(yong)(yong)期(qi)(qi)(qi)。以(yi)(yi)完(wan)成一(yi)(yi)定(ding)工作(zuo)任務為(wei)期(qi)(qi)(qi)限的(de)(de)(de)勞(lao)動(dong)(dong)(dong)合同(tong)(tong)或(huo)者勞(lao)動(dong)(dong)(dong)合同(tong)(tong)期(qi)(qi)(qi)限不(bu)(bu)滿三個(ge)月(yue)(yue)的(de)(de)(de),不(bu)(bu)得約(yue)定(ding)試用(yong)(yong)期(qi)(qi)(qi)。試用(yong)(yong)期(qi)(qi)(qi)包含(han)在(zai)勞(lao)動(dong)(dong)(dong)合同(tong)(tong)期(qi)(qi)(qi)限內。勞(lao)動(dong)(dong)(dong)合同(tong)(tong)僅約(yue)定(ding)試用(yong)(yong)期(qi)(qi)(qi)的(de)(de)(de),試用(yong)(yong)期(qi)(qi)(qi)不(bu)(bu)成立,該期(qi)(qi)(qi)限為(wei)勞(lao)動(dong)(dong)(dong)合同(tong)(tong)期(qi)(qi)(qi)限。

  《勞動合同(tong)法》第(di)二十條規定(ding),勞動者在試用期的(de)工資(zi)(zi)不得低(di)于(yu)本單位相同(tong)崗位最低(di)檔工資(zi)(zi)或者勞動合同(tong)約定(ding)工資(zi)(zi)的(de)百分之八十,并(bing)不得低(di)于(yu)用人單位所在地(di)的(de)最低(di)工資(zi)(zi)標準。

  據此,根(gen)據《勞動合同(tong)(tong)(tong)法》第(di)十(shi)(shi)九(jiu)條(tiao)、二十(shi)(shi)條(tiao),試(shi)用(yong)期(qi)的(de)長短應根(gen)據勞動合同(tong)(tong)(tong)的(de)期(qi)限來具(ju)體規定(ding),試(shi)用(yong)期(qi)的(de)工資不得低于本單位相同(tong)(tong)(tong)崗位最低檔工資或(huo)者勞動合同(tong)(tong)(tong)約定(ding)工資的(de)80%,并不得低于用(yong)人單位所在地的(de)最低工資標準(zhun)。

  第(di)十(shi)九條 勞(lao)動合同(tong)(tong)期(qi)(qi)限(xian)三個月(yue)以(yi)上(shang)不(bu)(bu)滿一年的,試用(yong)期(qi)(qi)不(bu)(bu)得(de)超(chao)過(guo)一個月(yue);勞(lao)動合同(tong)(tong)期(qi)(qi)限(xian)一年以(yi)上(shang)不(bu)(bu)滿三年的,試用(yong)期(qi)(qi)不(bu)(bu)得(de)超(chao)過(guo)二(er)個月(yue);三年以(yi)上(shang)固(gu)(gu)定期(qi)(qi)限(xian)和無固(gu)(gu)定期(qi)(qi)限(xian)的勞(lao)動合同(tong)(tong),試用(yong)期(qi)(qi)不(bu)(bu)得(de)超(chao)過(guo)六個月(yue)。

  同(tong)(tong)一用人單位與同(tong)(tong)一勞動者只(zhi)能約(yue)定一次試(shi)用期。

  以完成(cheng)一定工(gong)作任(ren)務為期(qi)限的(de)勞動合同或者勞動合同期(qi)限不滿(man)三個月的(de),不得約定試用期(qi)。

  試(shi)用期(qi)(qi)(qi)包(bao)含在勞(lao)動合同期(qi)(qi)(qi)限內。勞(lao)動合同僅約定(ding)試(shi)用期(qi)(qi)(qi)的(de),試(shi)用期(qi)(qi)(qi)不成立,該(gai)期(qi)(qi)(qi)限為勞(lao)動合同期(qi)(qi)(qi)限。

  第(di)二十條 勞動者在試(shi)用期的工資不得低于本單位相同崗位最低檔工資或者勞動合(he)同約定工資的80%,并不得低于用人單位所(suo)在地的最低工資標準。
