首先與(yu)勞(lao)動(dong)(dong)者(zhe)協商中止(zhi)履行勞(lao)動(dong)(dong)合同(tong),勞(lao)動(dong)(dong)者(zhe)在試(shi)(shi)用(yong)(yong)期間被(bei)證明不(bu)符合錄(lu)用(yong)(yong)條(tiao)件(jian)的(de)(de),用(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)(wei)可(ke)以(yi)解除(chu)勞(lao)動(dong)(dong)合同(tong)。用(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)(wei)在公司規(gui)章(zhang)制度中,明確約定(ding)錄(lu)用(yong)(yong)條(tiao)件(jian),表明勞(lao)動(dong)(dong)者(zhe)在試(shi)(shi)用(yong)(yong)期期間因病致使工作(zuo)無法(fa)進(jin)行的(de)(de),視為勞(lao)動(dong)(dong)者(zhe)的(de)(de)身(shen)體健康(kang)條(tiao)件(jian)不(bu)能(neng)達到崗位(wei)(wei)(wei)(wei)要(yao)求,不(bu)符合公司錄(lu)用(yong)(yong)條(tiao)件(jian)后,用(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)(wei)以(yi)此為由(you)解除(chu)勞(lao)動(dong)(dong)合同(tong),屬于合法(fa)行為。其次(ci)用(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)(wei)與(yu)勞(lao)動(dong)(dong)者(zhe)協商一致,可(ke)以(yi)變更勞(lao)動(dong)(dong)合同(tong)約定(ding)的(de)(de)內(nei)容。用(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)(wei)可(ke)以(yi)和勞(lao)動(dong)(dong)者(zhe)協商,在法(fa)律(lv)規(gui)定(ding)范圍內(nei),變更勞(lao)動(dong)(dong)合同(tong)中的(de)(de)試(shi)(shi)用(yong)(yong)期。但是必須注意(yi),延長試(shi)(shi)用(yong)(yong)期后,該勞(lao)動(dong)(dong)者(zhe)在該用(yong)(yong)人(ren)單(dan)位(wei)(wei)(wei)(wei)的(de)(de)總(zong)試(shi)(shi)用(yong)(yong)期不(bu)能(neng)超過(guo)法(fa)定(ding)的(de)(de)試(shi)(shi)用(yong)(yong)期標準。
