員工不簽合同單位需要支付補償嗎?
問 我是企業人事,上月招用了一位(wei)員(yuan)工(gong),幾次提供勞動合同文本(ben)給這位(wei)員(yuan)工(gong)簽訂都被拒絕,那么這種(zhong)情況下(xia),單位(wei)終止(zhi)用工(gong)需要支付經濟補償(chang)嗎?
答 根據《中華人民共和國勞(lao)(lao)動(dong)(dong)合(he)同(tong)法(fa)(fa)實施條(tiao)例》:自用(yong)(yong)工(gong)之日起一個月內,經用(yong)(yong)人單(dan)(dan)位書面(mian)(mian)通知后(hou),勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)不與用(yong)(yong)人單(dan)(dan)位訂(ding)立書面(mian)(mian)勞(lao)(lao)動(dong)(dong)合(he)同(tong)的(de),用(yong)(yong)人單(dan)(dan)位應當書面(mian)(mian)通知勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)終(zhong)止勞(lao)(lao)動(dong)(dong)關系,無需向勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)支(zhi)付經濟(ji)補償,但是應當依法(fa)(fa)向勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)支(zhi)付其實際(ji)工(gong)作時間(jian)的(de)勞(lao)(lao)動(dong)(dong)報酬(chou)。
