日照全面推行機關事業單位帶薪年休假制度

從市(shi)人(ren)社局獲(huo)悉(xi),為貫徹(che)執行《職工帶(dai)(dai)薪(xin)年(nian)休假條(tiao)例》,根據上級有(you)關(guan)文件精神,市(shi)政(zheng)府辦公室近日印(yin)發(fa)了《關(guan)于進一(yi)步落實機(ji)關(guan)事業(ye)單位工作人(ren)員帶(dai)(dai)薪(xin)年(nian)休假制(zhi)度(du)(du)的意見的通知》,要求各級領導(dao)干部(bu)特別(bie)是主(zhu)要負責同志(zhi)要帶(dai)(dai)頭執行帶(dai)(dai)薪(xin)年(nian)休假制(zhi)度(du)(du),我市(shi)機(ji)關(guan)事業(ye)單位工作人(ren)員帶(dai)(dai)薪(xin)年(nian)休假制(zhi)度(du)(du)全面(mian)推行。

據了(le)解(jie),《通知》要求(qiu),全(quan)(quan)市各級機關(guan)事業單(dan)(dan)位(wei)(wei)在充分考慮干(gan)部(bu)職工(gong)(gong)(gong)(gong)意(yi)愿的基礎(chu)上,結合單(dan)(dan)位(wei)(wei)工(gong)(gong)(gong)(gong)作(zuo)(zuo)計(ji)劃(hua)(hua)統籌安排(pai),于每年(nian)3月底前制(zhi)定(ding)本(ben)單(dan)(dan)位(wei)(wei)全(quan)(quan)體工(gong)(gong)(gong)(gong)作(zuo)(zuo)人員年(nian)休(xiu)假(jia)計(ji)劃(hua)(hua),報(bao)同級人力資(zi)源社會保障(zhang)、財政部(bu)門(men)備案(an)。要積極研(yan)究推動年(nian)休(xiu)假(jia)計(ji)劃(hua)(hua)的落實(shi)(shi)措施,全(quan)(quan)面推行“A、B角”工(gong)(gong)(gong)(gong)作(zuo)(zuo)制(zhi)度(A角對(dui)某項(xiang)工(gong)(gong)(gong)(gong)作(zuo)(zuo)主要負(fu)(fu)責(ze),B角應(ying)主動熟悉并(bing)(bing)協助做好該(gai)項(xiang)工(gong)(gong)(gong)(gong)作(zuo)(zuo),當A角出(chu)差或休(xiu)假(jia)等(deng)原(yuan)因(yin)不(bu)能承(cheng)擔(dan)完成該(gai)項(xiang)工(gong)(gong)(gong)(gong)作(zuo)(zuo)時,由B角接(jie)替(ti)完成該(gai)項(xiang)工(gong)(gong)(gong)(gong)作(zuo)(zuo),并(bing)(bing)切實(shi)(shi)負(fu)(fu)起(qi)責(ze)任(ren)(ren),反之亦然;A、B兩個責(ze)任(ren)(ren)人不(bu)得同時外出(chu)),完善考勤和(he)請銷假(jia)制(zhi)度,定(ding)期公(gong)布本(ben)單(dan)(dan)位(wei)(wei)年(nian)休(xiu)假(jia)計(ji)劃(hua)(hua)執行和(he)調休(xiu)情(qing)況(kuang),接(jie)受本(ben)單(dan)(dan)位(wei)(wei)干(gan)部(bu)職工(gong)(gong)(gong)(gong)和(he)群眾監督。

《通知》同時強調(diao),各(ge)級各(ge)部(bu)(bu)門(men)要(yao)(yao)建立涵蓋本單位(wei)全體人員(yuan)的(de)(de)(de)年(nian)(nian)休(xiu)(xiu)假計(ji)劃臺賬,對(dui)確因工作(zuo)需要(yao)(yao)不能(neng)按計(ji)劃休(xiu)(xiu)假的(de)(de)(de),要(yao)(yao)經本單位(wei)或主管部(bu)(bu)門(men)組(zu)織人事部(bu)(bu)門(men)同意,經過2次調(diao)休(xiu)(xiu)后仍無法(fa)在當年(nian)(nian)休(xiu)(xiu)假的(de)(de)(de),方可認定為(wei)符合“確因工作(zuo)需要(yao)(yao)不安排休(xiu)(xiu)假”的(de)(de)(de)條件,可申請發放(fang)年(nian)(nian)休(xiu)(xiu)假工資報酬。

根據《職(zhi)工(gong)(gong)(gong)(gong)帶薪年(nian)休(xiu)(xiu)(xiu)假(jia)(jia)條例》,單位確(que)因(yin)工(gong)(gong)(gong)(gong)作需要不能安排(pai)職(zhi)工(gong)(gong)(gong)(gong)休(xiu)(xiu)(xiu)年(nian)休(xiu)(xiu)(xiu)假(jia)(jia)的(de),經職(zhi)工(gong)(gong)(gong)(gong)本(ben)人同(tong)意,可以(yi)不安排(pai)職(zhi)工(gong)(gong)(gong)(gong)休(xiu)(xiu)(xiu)年(nian)休(xiu)(xiu)(xiu)假(jia)(jia)。對(dui)職(zhi)工(gong)(gong)(gong)(gong)應休(xiu)(xiu)(xiu)未(wei)休(xiu)(xiu)(xiu)的(de)年(nian)休(xiu)(xiu)(xiu)假(jia)(jia)天數,單位應當(dang)按照該職(zhi)工(gong)(gong)(gong)(gong)日工(gong)(gong)(gong)(gong)資收入的(de)300%支(zhi)付年(nian)休(xiu)(xiu)(xiu)假(jia)(jia)工(gong)(gong)(gong)(gong)資報酬。

單(dan)位(wei)(wei)不安排職工(gong)(gong)休(xiu)年(nian)休(xiu)假又不依照(zhao)《職工(gong)(gong)帶薪(xin)年(nian)休(xiu)假條例》規定給予(yu)年(nian)休(xiu)假工(gong)(gong)資(zi)報酬(chou)(chou)的(de),由(you)縣(xian)級以上地方人(ren)(ren)民(min)政府人(ren)(ren)事(shi)部(bu)門或者(zhe)勞動(dong)保(bao)障部(bu)門依據職權責(ze)令限期改正(zheng);對(dui)逾期不改正(zheng)的(de),除責(ze)令該單(dan)位(wei)(wei)支付(fu)年(nian)休(xiu)假工(gong)(gong)資(zi)報酬(chou)(chou)外,單(dan)位(wei)(wei)還應當按照(zhao)年(nian)休(xiu)假工(gong)(gong)資(zi)報酬(chou)(chou)的(de)數額(e)向(xiang)職工(gong)(gong)加付(fu)賠償金(jin);對(dui)拒不支付(fu)年(nian)休(xiu)假工(gong)(gong)資(zi)報酬(chou)(chou)、賠償金(jin)的(de),屬于(yu)公(gong)務員(yuan)(yuan)和參照(zhao)公(gong)務員(yuan)(yuan)法管理(li)的(de)人(ren)(ren)員(yuan)(yuan)所在單(dan)位(wei)(wei)的(de),對(dui)直接(jie)負責(ze)的(de)主管人(ren)(ren)員(yuan)(yuan)以及其他(ta)直接(jie)責(ze)任(ren)人(ren)(ren)員(yuan)(yuan)依法給予(yu)處分(fen);屬于(yu)其他(ta)單(dan)位(wei)(wei)的(de),由(you)勞動(dong)保(bao)障部(bu)門、人(ren)(ren)事(shi)部(bu)門或者(zhe)職工(gong)(gong)申請(qing)人(ren)(ren)民(min)法院強制(zhi)執行。

此外,職工(gong)具有依法享受(shou)寒暑假,其休(xiu)(xiu)假天(tian)數(shu)多于年(nian)休(xiu)(xiu)假天(tian)數(shu)的;請(qing)事假累(lei)(lei)(lei)計20天(tian)以(yi)上且單位按照規定不扣工(gong)資的;累(lei)(lei)(lei)計工(gong)作滿(man)1年(nian)不滿(man)10年(nian),請(qing)病假累(lei)(lei)(lei)計2個月以(yi)上;累(lei)(lei)(lei)計工(gong)作滿(man)10年(nian)不滿(man)20年(nian),請(qing)病假累(lei)(lei)(lei)計3個月以(yi)上;累(lei)(lei)(lei)計工(gong)作滿(man)20年(nian)以(yi)上,請(qing)病假累(lei)(lei)(lei)計4個月以(yi)上等五個情形之一的,不享受(shou)當年(nian)的年(nian)休(xiu)(xiu)假。
