從市(shi)(shi)人(ren)(ren)社局獲悉,為貫(guan)徹執行《職工(gong)帶(dai)薪(xin)年(nian)休假(jia)(jia)條例》,根據上(shang)級有關(guan)文件精神,市(shi)(shi)政(zheng)府辦公室近日印發(fa)了《關(guan)于進一步落實機(ji)關(guan)事(shi)業單(dan)(dan)位工(gong)作人(ren)(ren)員(yuan)帶(dai)薪(xin)年(nian)休假(jia)(jia)制(zhi)度的(de)意見的(de)通知》,要(yao)(yao)求各級領導干部特別是主要(yao)(yao)負責同(tong)志要(yao)(yao)帶(dai)頭執行帶(dai)薪(xin)年(nian)休假(jia)(jia)制(zhi)度,我市(shi)(shi)機(ji)關(guan)事(shi)業單(dan)(dan)位工(gong)作人(ren)(ren)員(yuan)帶(dai)薪(xin)年(nian)休假(jia)(jia)制(zhi)度全面(mian)推行。
據了解,《通知》要求,全市各級機關事業(ye)單(dan)(dan)(dan)位(wei)(wei)(wei)(wei)在充分考慮干(gan)部(bu)職工(gong)(gong)意愿的(de)基(ji)礎(chu)上,結合單(dan)(dan)(dan)位(wei)(wei)(wei)(wei)工(gong)(gong)作(zuo)(zuo)(zuo)計(ji)劃(hua)統籌安排,于每年(nian)3月底(di)前(qian)制(zhi)定本單(dan)(dan)(dan)位(wei)(wei)(wei)(wei)全體工(gong)(gong)作(zuo)(zuo)(zuo)人員年(nian)休(xiu)假計(ji)劃(hua),報同(tong)級人力資源社會保障(zhang)、財(cai)政部(bu)門備案。要積極(ji)研究(jiu)推(tui)動年(nian)休(xiu)假計(ji)劃(hua)的(de)落實措施,全面推(tui)行“A、B角(jiao)”工(gong)(gong)作(zuo)(zuo)(zuo)制(zhi)度(A角(jiao)對某(mou)項工(gong)(gong)作(zuo)(zuo)(zuo)主要負責,B角(jiao)應主動熟悉并(bing)(bing)協助做好該項工(gong)(gong)作(zuo)(zuo)(zuo),當A角(jiao)出(chu)差或休(xiu)假等原(yuan)因不(bu)能承擔完成該項工(gong)(gong)作(zuo)(zuo)(zuo)時,由B角(jiao)接(jie)(jie)替完成該項工(gong)(gong)作(zuo)(zuo)(zuo),并(bing)(bing)切實負起責任(ren)(ren),反之亦然(ran);A、B兩個(ge)責任(ren)(ren)人不(bu)得(de)同(tong)時外(wai)出(chu)),完善(shan)考勤和請銷假制(zhi)度,定期公布本單(dan)(dan)(dan)位(wei)(wei)(wei)(wei)年(nian)休(xiu)假計(ji)劃(hua)執行和調休(xiu)情(qing)況,接(jie)(jie)受本單(dan)(dan)(dan)位(wei)(wei)(wei)(wei)干(gan)部(bu)職工(gong)(gong)和群眾監督。
《通(tong)知(zhi)》同(tong)時強調,各(ge)級各(ge)部門要(yao)建立涵蓋本(ben)單位(wei)全體人(ren)員的(de)年休(xiu)假計劃臺賬,對確(que)因工作(zuo)需(xu)要(yao)不能按計劃休(xiu)假的(de),要(yao)經(jing)本(ben)單位(wei)或主(zhu)管部門組織人(ren)事部門同(tong)意,經(jing)過2次(ci)調休(xiu)后仍無法在當年休(xiu)假的(de),方可認定為符合“確(que)因工作(zuo)需(xu)要(yao)不安排休(xiu)假”的(de)條件,可申請發放年休(xiu)假工資報酬(chou)。
根據《職(zhi)工(gong)帶薪年休(xiu)(xiu)假(jia)(jia)條例(li)》,單位確(que)因(yin)工(gong)作需要(yao)不(bu)能安排(pai)職(zhi)工(gong)休(xiu)(xiu)年休(xiu)(xiu)假(jia)(jia)的,經職(zhi)工(gong)本人(ren)同意,可以不(bu)安排(pai)職(zhi)工(gong)休(xiu)(xiu)年休(xiu)(xiu)假(jia)(jia)。對職(zhi)工(gong)應休(xiu)(xiu)未(wei)休(xiu)(xiu)的年休(xiu)(xiu)假(jia)(jia)天(tian)數(shu),單位應當(dang)按(an)照該(gai)職(zhi)工(gong)日工(gong)資(zi)收(shou)入的300%支付(fu)年休(xiu)(xiu)假(jia)(jia)工(gong)資(zi)報酬。
單位不(bu)安排職(zhi)(zhi)(zhi)工(gong)(gong)休(xiu)年休(xiu)假(jia)又不(bu)依(yi)照《職(zhi)(zhi)(zhi)工(gong)(gong)帶(dai)薪(xin)年休(xiu)假(jia)條例(li)》規定給予年休(xiu)假(jia)工(gong)(gong)資(zi)報(bao)酬的(de)(de),由(you)(you)縣級以(yi)上地方人(ren)民(min)政府人(ren)事(shi)部(bu)(bu)(bu)(bu)門(men)(men)或(huo)(huo)者(zhe)勞動保(bao)障(zhang)部(bu)(bu)(bu)(bu)門(men)(men)依(yi)據職(zhi)(zhi)(zhi)權責令(ling)限期改正;對逾期不(bu)改正的(de)(de),除責令(ling)該(gai)單位支(zhi)付(fu)年休(xiu)假(jia)工(gong)(gong)資(zi)報(bao)酬外(wai),單位還應當(dang)按(an)照年休(xiu)假(jia)工(gong)(gong)資(zi)報(bao)酬的(de)(de)數額向職(zhi)(zhi)(zhi)工(gong)(gong)加(jia)付(fu)賠(pei)償金;對拒不(bu)支(zhi)付(fu)年休(xiu)假(jia)工(gong)(gong)資(zi)報(bao)酬、賠(pei)償金的(de)(de),屬(shu)于(yu)(yu)公務員(yuan)和參照公務員(yuan)法(fa)管理的(de)(de)人(ren)員(yuan)所在(zai)單位的(de)(de),對直(zhi)(zhi)接(jie)負責的(de)(de)主管人(ren)員(yuan)以(yi)及其他(ta)(ta)直(zhi)(zhi)接(jie)責任人(ren)員(yuan)依(yi)法(fa)給予處分;屬(shu)于(yu)(yu)其他(ta)(ta)單位的(de)(de),由(you)(you)勞動保(bao)障(zhang)部(bu)(bu)(bu)(bu)門(men)(men)、人(ren)事(shi)部(bu)(bu)(bu)(bu)門(men)(men)或(huo)(huo)者(zhe)職(zhi)(zhi)(zhi)工(gong)(gong)申請(qing)人(ren)民(min)法(fa)院強制(zhi)執行(xing)。
此外,職工(gong)(gong)(gong)具有依法享受寒暑假(jia)(jia),其休(xiu)假(jia)(jia)天(tian)數多于年休(xiu)假(jia)(jia)天(tian)數的;請事(shi)假(jia)(jia)累(lei)(lei)(lei)計(ji)20天(tian)以上(shang)(shang)(shang)且單位(wei)按照規定不扣工(gong)(gong)(gong)資的;累(lei)(lei)(lei)計(ji)工(gong)(gong)(gong)作(zuo)(zuo)滿1年不滿10年,請病(bing)假(jia)(jia)累(lei)(lei)(lei)計(ji)2個(ge)月(yue)(yue)(yue)以上(shang)(shang)(shang);累(lei)(lei)(lei)計(ji)工(gong)(gong)(gong)作(zuo)(zuo)滿10年不滿20年,請病(bing)假(jia)(jia)累(lei)(lei)(lei)計(ji)3個(ge)月(yue)(yue)(yue)以上(shang)(shang)(shang);累(lei)(lei)(lei)計(ji)工(gong)(gong)(gong)作(zuo)(zuo)滿20年以上(shang)(shang)(shang),請病(bing)假(jia)(jia)累(lei)(lei)(lei)計(ji)4個(ge)月(yue)(yue)(yue)以上(shang)(shang)(shang)等五個(ge)情形之一的,不享受當年的年休(xiu)假(jia)(jia)。
