單位統一安排休年假是否合理?

我們公(gong)司老板和員工(gong)絕(jue)大多數都是(shi)(shi)外地戶籍,所以每年(nian)春(chun)節前后公(gong)司會多放幾天假。表面上(shang)是(shi)(shi)單(dan)位照顧員工(gong),實際上(shang)是(shi)(shi)讓(rang)我們把帶薪年(nian)休(xiu)假挪到春(chun)節前后統一休(xiu)了,而且不論入(ru)職時間(jian)長短,休(xiu)的時間(jian)都一樣(yang)多。請問:公(gong)司這樣(yang)安(an)排合法嗎?

根據(ju)《職(zhi)工(gong)(gong)(gong)帶薪(xin)年(nian)(nian)休假(jia)條例》第三(san)條規定:職(zhi)工(gong)(gong)(gong)累計工(gong)(gong)(gong)作已(yi)滿(man)(man)1年(nian)(nian)不滿(man)(man)10年(nian)(nian)的(de),年(nian)(nian)休假(jia)5天(tian);已(yi)滿(man)(man)10年(nian)(nian)不滿(man)(man)20年(nian)(nian)的(de),年(nian)(nian)休假(jia)10天(tian);已(yi)滿(man)(man)20年(nian)(nian)的(de),年(nian)(nian)休假(jia)15天(tian)。第五(wu)條規定:單位根據(ju)生產、工(gong)(gong)(gong)作的(de)具體情況,并考慮職(zhi)工(gong)(gong)(gong)本人意(yi)愿,統籌安(an)排(pai)職(zhi)工(gong)(gong)(gong)年(nian)(nian)休假(jia)。 所以(yi)公司是可以(yi)根據(ju)生產、工(gong)(gong)(gong)作情況安(an)排(pai)年(nian)(nian)假(jia)。
