單位統一安排休年假是否合理?

我(wo)們公司老板和(he)員工(gong)(gong)絕(jue)大多數都(dou)是外地戶籍(ji),所以每年春節前(qian)后公司會多放幾天假(jia)。表(biao)面(mian)上是單(dan)位照顧員工(gong)(gong),實際上是讓我(wo)們把帶薪年休(xiu)(xiu)假(jia)挪到春節前(qian)后統(tong)一休(xiu)(xiu)了,而且(qie)不(bu)論入職時(shi)間(jian)長(chang)短,休(xiu)(xiu)的時(shi)間(jian)都(dou)一樣(yang)多。請問:公司這(zhe)樣(yang)安排合法嗎?

答(da) 根(gen)據《職(zhi)工帶薪年(nian)(nian)(nian)(nian)(nian)(nian)休假(jia)條(tiao)例》第三條(tiao)規定:職(zhi)工累計工作已滿(man)(man)1年(nian)(nian)(nian)(nian)(nian)(nian)不(bu)滿(man)(man)10年(nian)(nian)(nian)(nian)(nian)(nian)的(de)(de),年(nian)(nian)(nian)(nian)(nian)(nian)休假(jia)5天;已滿(man)(man)10年(nian)(nian)(nian)(nian)(nian)(nian)不(bu)滿(man)(man)20年(nian)(nian)(nian)(nian)(nian)(nian)的(de)(de),年(nian)(nian)(nian)(nian)(nian)(nian)休假(jia)10天;已滿(man)(man)20年(nian)(nian)(nian)(nian)(nian)(nian)的(de)(de),年(nian)(nian)(nian)(nian)(nian)(nian)休假(jia)15天。第五條(tiao)規定:單位(wei)根(gen)據生(sheng)產、工作的(de)(de)具體情況,并(bing)考慮職(zhi)工本人意愿,統籌安排職(zhi)工年(nian)(nian)(nian)(nian)(nian)(nian)休假(jia)。 所(suo)以公司是可以根(gen)據生(sheng)產、工作情況安排年(nian)(nian)(nian)(nian)(nian)(nian)假(jia)。
