公司不與勞動者簽訂書面勞動合同,會受到什么懲罰?

我(wo)是一名銷售(shou)員,最(zui)近找(zhao)了一份新(xin)工(gong)作,工(gong)作兩個月了公司(si)還沒(mei)和我(wo)們這(zhe)批新(xin)員工(gong)簽合(he)(he)同(tong),單位不(bu)與(yu)勞動(dong)者簽訂(ding)書面勞動(dong)合(he)(he)同(tong),會受到什么懲(cheng)罰?

《勞(lao)動(dong)合(he)同(tong)法》規定,用人單位(wei)自用工(gong)(gong)之日起超過一個(ge)月(yue)不滿一年未(wei)與勞(lao)動(dong)者(zhe)訂立(li)書面勞(lao)動(dong)合(he)同(tong)的(de),應(ying)當向(xiang)勞(lao)動(dong)者(zhe)每(mei)月(yue)支(zhi)(zhi)付二倍的(de)工(gong)(gong)資;用人單位(wei)違反本法規定不與勞(lao)動(dong)者(zhe)訂立(li)無固定期限(xian)勞(lao)動(dong)合(he)同(tong)的(de),自應(ying)當訂立(li)無固定期限(xian)勞(lao)動(dong)合(he)同(tong)之日起向(xiang)勞(lao)動(dong)者(zhe)每(mei)月(yue)支(zhi)(zhi)付二倍的(de)工(gong)(gong)資。因此,單位(wei)如果未(wei)依法與勞(lao)動(dong)者(zhe)訂立(li)勞(lao)動(dong)合(he)同(tong),除應(ying)向(xiang)勞(lao)動(dong)者(zhe)支(zhi)(zhi)付其應(ying)得的(de)工(gong)(gong)資以外,還(huan)需(xu)再(zai)支(zhi)(zhi)付一倍的(de)工(gong)(gong)資作為對勞(lao)動(dong)者(zhe)的(de)補償。
