未簽訂勞動合同被迫解除勞動關系怎么辦?

答 建(jian)立(li)勞動(dong)(dong)(dong)關系,應當簽訂(ding)勞動(dong)(dong)(dong)合同(tong)。《勞動(dong)(dong)(dong)合同(tong)法》第(di)八十(shi)二(er)條規定:用(yong)人單位自用(yong)工之日起超過一個(ge)月不(bu)滿一年未與勞動(dong)(dong)(dong)者(zhe)訂(ding)立(li)書面勞動(dong)(dong)(dong)合同(tong)的(de),應當向勞動(dong)(dong)(dong)者(zhe)每月支(zhi)付(fu)2倍工資(zi)(zi)。用(yong)人單位違反本(ben)法規定不(bu)與勞動(dong)(dong)(dong)者(zhe)訂(ding)立(li)無固定期(qi)限勞動(dong)(dong)(dong)合同(tong)的(de),自應當訂(ding)立(li)無固定期(qi)限勞動(dong)(dong)(dong)合同(tong)之日起向勞動(dong)(dong)(dong)者(zhe)每月支(zhi)付(fu)二(er)倍的(de)工資(zi)(zi)。《勞動(dong)(dong)(dong)合同(tong)法》第(di)85條規定,未按照國家(jia)規定及(ji)時(shi)足額支(zhi)付(fu)勞動(dong)(dong)(dong)者(zhe)勞動(dong)(dong)(dong)報酬的(de),由(you)勞動(dong)(dong)(dong)行政部門責(ze)令限期(qi)支(zhi)付(fu)勞動(dong)(dong)(dong)報酬,逾期(qi)不(bu)支(zhi)付(fu)的(de),責(ze)令用(yong)人單位按應付(fu)金額50%以上100%以下的(de)標(biao)準向勞動(dong)(dong)(dong)者(zhe)加付(fu)賠償金。
