首先照(zhao)《中(zhong)華人民共和(he)國勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)爭(zheng)議仲(zhong)(zhong)(zhong)裁(cai)(cai)法(fa)》規(gui)定(ding)(ding),勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)爭(zheng)議仲(zhong)(zhong)(zhong)裁(cai)(cai)委員會(hui)受理下(xia)列勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)爭(zheng)議:因訂立(li)、履行、變更、解除和(he)終止(zhi)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合同(tong)發(fa)生(sheng)(sheng)的勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)爭(zheng)議;因除名(ming)、辭退和(he)辭職、離職發(fa)生(sheng)(sheng)的爭(zheng)議;因工作時(shi)(shi)間、休息(xi)休假、社會(hui)保(bao)險(xian)、福利、培訓以及勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)保(bao)護發(fa)生(sheng)(sheng)的勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)爭(zheng)議;因勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)報酬、工傷醫療(liao)費(fei)、經(jing)濟補償或(huo)者(zhe)賠償金及確認勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關系等發(fa)生(sheng)(sheng)的勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)爭(zheng)議及法(fa)律法(fa)規(gui)規(gui)定(ding)(ding)的其他勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)爭(zheng)議。其次(ci)申(shen)(shen)請勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)仲(zhong)(zhong)(zhong)裁(cai)(cai)的當(dang)(dang)事人應當(dang)(dang)在勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)爭(zheng)議仲(zhong)(zhong)(zhong)裁(cai)(cai)時(shi)(shi)效(xiao)范圍內申(shen)(shen)請勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)仲(zhong)(zhong)(zhong)裁(cai)(cai),如果過了(le)時(shi)(shi)效(xiao)申(shen)(shen)請,就喪失(shi)了(le)勝(sheng)訴(su)權(quan),即(ji)證據充分勝(sheng)訴(su)把握(wo)很(hen)大的一(yi)個案(an)子,因超過仲(zhong)(zhong)(zhong)裁(cai)(cai)時(shi)(shi)效(xiao),就喪失(shi)了(le)勝(sheng)訴(su)權(quan)。最后(hou)當(dang)(dang)事人應向有管轄權(quan)的勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)爭(zheng)議仲(zhong)(zhong)(zhong)裁(cai)(cai)委員會(hui)申(shen)(shen)請仲(zhong)(zhong)(zhong)裁(cai)(cai)。
