用工(gong)制(zhi)(zhi)度是指企業(ye)使用勞動(dong)力的(de)各項制(zhi)(zhi)度,那么什(shen)么是非全日制(zhi)(zhi)用工(gong)?

根據我國勞動(dong)(dong)合同法規定,非(fei)全日(ri)制(zhi)(zhi)用(yong)工,是指(zhi)以(yi)小(xiao)時(shi)(shi)(shi)計(ji)酬為(wei)主,勞動(dong)(dong)者(zhe)(zhe)在同一(yi)用(yong)人(ren)單位(wei)一(yi)般平均(jun)每日(ri)工作時(shi)(shi)(shi)間不超(chao)過四(si)小(xiao)時(shi)(shi)(shi),每周工作時(shi)(shi)(shi)間累計(ji)不超(chao)過二十四(si)小(xiao)時(shi)(shi)(shi)的用(yong)工形(xing)式(shi)。非(fei)全日(ri)制(zhi)(zhi)用(yong)工雙方(fang)當事(shi)人(ren)任何一(yi)方(fang)都可以(yi)隨時(shi)(shi)(shi)通(tong)知對(dui)方(fang)終止(zhi)用(yong)功。終止(zhi)用(yong)工,用(yong)人(ren)單位(wei)不向勞動(dong)(dong)者(zhe)(zhe)支付經濟(ji)賠償。但需注意一(yi)點就是勞務派(pai)遣單位(wei)不得以(yi)非(fei)全日(ri)制(zhi)(zhi)用(yong)工形(xing)式(shi)招(zhao)用(yong)被(bei)派(pai)遣勞動(dong)(dong)者(zhe)(zhe)。
