簽了合同但未上班,是否存在勞動關系?

問(wen) 我們公(gong)司有個員(yuan)工,簽了合(he)同(tong)就沒來上(shang)(shang)過班,想咨詢(xun)一(yi)下(xia),簽了合(he)同(tong)但未(wei)上(shang)(shang)班,是否存在勞(lao)動關系?

答(da) 存在勞(lao)(lao)(lao)動(dong)(dong)關系,主(zhu)要是(shi)(shi)(shi)看企業與(yu)(yu)用(yong)人單位(wei)之間是(shi)(shi)(shi)否有實際的用(yong)工關系,《中華人民共和國(guo)勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)法》第七(qi)條的規定(ding):用(yong)人單位(wei)自用(yong)工之日起即與(yu)(yu)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)建立勞(lao)(lao)(lao)動(dong)(dong)關系。本案中的楊某(mou)與(yu)(yu)單位(wei)僅(jin)僅(jin)只是(shi)(shi)(shi)簽訂(ding)了勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong),填了單位(wei)招(zhao)工招(zhao)聘登(deng)記表、報名表等錄用(yong)材(cai)料就認為與(yu)(yu)該單位(wei)存在勞(lao)(lao)(lao)動(dong)(dong)關系顯然是(shi)(shi)(shi)有失偏頗的,還是(shi)(shi)(shi)要看其有沒有發生實際的勞(lao)(lao)(lao)動(dong)(dong)用(yong)工行(xing)為。
