簽了合同但未上班,是否存在勞動關系?

問(wen) 我們公(gong)司有個員工,簽了(le)合同就沒來上(shang)過(guo)班,想咨詢一下(xia),簽了(le)合同但未上(shang)班,是否存在勞動關系?

存在勞(lao)動(dong)關系,主(zhu)要是(shi)(shi)看(kan)企業與用(yong)(yong)人(ren)單位(wei)(wei)之間是(shi)(shi)否(fou)有實(shi)際的用(yong)(yong)工(gong)關系,《中華人(ren)民(min)共和(he)國勞(lao)動(dong)合(he)同(tong)法》第七條的規定:用(yong)(yong)人(ren)單位(wei)(wei)自(zi)用(yong)(yong)工(gong)之日(ri)起(qi)即與勞(lao)動(dong)者(zhe)建(jian)立勞(lao)動(dong)關系。本案中的楊某與單位(wei)(wei)僅僅只(zhi)是(shi)(shi)簽訂了(le)勞(lao)動(dong)合(he)同(tong),填了(le)單位(wei)(wei)招工(gong)招聘登記表、報名(ming)表等錄用(yong)(yong)材(cai)料就(jiu)認為與該單位(wei)(wei)存在勞(lao)動(dong)關系顯然(ran)是(shi)(shi)有失偏頗的,還是(shi)(shi)要看(kan)其(qi)有沒(mei)有發(fa)生實(shi)際的勞(lao)動(dong)用(yong)(yong)工(gong)行為。
