拿到的兩倍工資要不要繳稅呢?

答 兩(liang)(liang)倍工資(zi),依《勞(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)法(fa)》第八十二條規定應當按月(yue)支付,這(zhe)與(yu)解除勞(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)的(de)經濟(ji)補償(chang)金一次(ci)性支付的(de)性質完全不(bu)同(tong)(tong)(tong)。同(tong)(tong)(tong)時(shi),兩(liang)(liang)倍工資(zi)是(shi)針對未(wei)簽訂勞(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)的(de)懲罰,與(yu)離職(zhi)也沒有關系(xi)。至于現在為(wei)什么都在離職(zhi)時(shi)支付,是(shi)因(yin)為(wei)在職(zhi)時(shi)很少有勞(lao)(lao)動(dong)(dong)者提出勞(lao)(lao)動(dong)(dong)仲裁的(de)緣故,不(bu)能因(yin)此(ci)將其與(yu)離職(zhi)補償(chang)混為(wei)一談。因(yin)此(ci),兩(liang)(liang)倍工資(zi)應當依法(fa)繳納個人所(suo)得稅。
