最近公司要派(pai)我到外省上班,說(shuo)不去就辭退,公司逼迫辭職怎么辦啊?

如果企業(ye)更(geng)(geng)(geng)換工(gong)(gong)作(zuo)地點,尤其(qi)是這樣跨省(sheng)市的(de)更(geng)(geng)(geng)換,單位(wei)應(ying)該(gai)(gai)盡(jin)量(liang)向員(yuan)工(gong)(gong)提(ti)供(gong)上(shang)下班(ban)條(tiao)(tiao)件(jian)。如果實在(zai)(zai)有(you)困(kun)難,《中(zhong)(zhong)華(hua)人民共(gong)和國(guo)勞動(dong)(dong)法(fa)(fa)》第(di)二十六條(tiao)(tiao)規(gui)定:“有(you)下列情(qing)(qing)(qing)(qing)形之一的(de),用人單位(wei)可(ke)以解除勞動(dong)(dong)合(he)同(tong),但是應(ying)當(dang)提(ti)前三(san)(san)十日以書面形式(shi)通知(zhi)勞動(dong)(dong)者(zhe)本(ben)人:……(三(san)(san))勞動(dong)(dong)合(he)同(tong)訂立時所依據的(de)客觀(guan)(guan)(guan)情(qing)(qing)(qing)(qing)況(kuang)(kuang)發生重(zhong)大變化(hua),致(zhi)使(shi)原勞動(dong)(dong)合(he)同(tong)無(wu)(wu)法(fa)(fa)履(lv)行(xing)(xing),經(jing)當(dang)事人協商(shang)不(bu)能就變更(geng)(geng)(geng)勞動(dong)(dong)合(he)同(tong)達成協議的(de)。”對于(yu)該(gai)(gai)條(tiao)(tiao)中(zhong)(zhong)的(de)“客觀(guan)(guan)(guan)情(qing)(qing)(qing)(qing)況(kuang)(kuang)發生重(zhong)大變化(hua)”, 勞動(dong)(dong)部(bu)(bu)《關于(yu)〈中(zhong)(zhong)華(hua)人民共(gong)和國(guo)勞動(dong)(dong)法(fa)(fa)〉若(ruo)干(gan)條(tiao)(tiao)文的(de)說明》中(zhong)(zhong)指出:“本(ben)條(tiao)(tiao)中(zhong)(zhong)的(de)‘客觀(guan)(guan)(guan)情(qing)(qing)(qing)(qing)況(kuang)(kuang)’指:發生不(bu)可(ke)抗力或出現致(zhi)使(shi)勞動(dong)(dong)合(he)同(tong)全部(bu)(bu)或部(bu)(bu)分條(tiao)(tiao)款無(wu)(wu)法(fa)(fa)履(lv)行(xing)(xing)的(de)其(qi)他情(qing)(qing)(qing)(qing)況(kuang)(kuang),如企業(ye)遷移(yi)、被兼(jian)并、企業(ye)資產轉(zhuan)移(yi)等,并且排除本(ben)法(fa)(fa)第(di)二十七條(tiao)(tiao)(經(jing)濟(ji)性裁(cai)員(yuan)——作(zuo)者(zhe)注)所列的(de)客觀(guan)(guan)(guan)情(qing)(qing)(qing)(qing)況(kuang)(kuang)。”因此,你公(gong)(gong)司(si)上(shang)海不(bu)在(zai)(zai)設(she)立辦事處之后(hou),應(ying)該(gai)(gai)有(you)一個協商(shang)的(de)過程(cheng),實在(zai)(zai)無(wu)(wu)法(fa)(fa)通過協商(shang)解決,公(gong)(gong)司(si)應(ying)該(gai)(gai)解除勞動(dong)(dong)合(he)同(tong),并支付經(jing)濟(ji)補(bu)償(chang)金,不(bu)能逼(bi)迫員(yuan)工(gong)(gong)自行(xing)(xing)辭(ci)職。
