無故拖欠工資應承擔什么法律后果呢?

最近遇到老板拖欠(qian)工資的情(qing)況,想咨詢一下,無(wu)故拖欠(qian)工資應承擔什么法律后果呢?

用人單位有下列侵害勞(lao)動者合(he)法(fa)(fa)權益(yi)情形(xing)之一的(de),由(you)勞(lao)動行政部門責(ze)令支(zhi)(zhi)(zhi)付(fu)勞(lao)動者的(de)工(gong)(gong)資(zi)(zi)(zi)報(bao)酬、經濟(ji)補償(chang),并可以(yi)責(ze)令支(zhi)(zhi)(zhi)付(fu)賠(pei)償(chang)金(jin): (1)克(ke)扣(kou)或(huo)者無(wu)故拖欠(qian)勞(lao)動者工(gong)(gong)資(zi)(zi)(zi)的(de); (2)拒不支(zhi)(zhi)(zhi)付(fu)勞(lao)動者延長工(gong)(gong)作時(shi)間工(gong)(gong)資(zi)(zi)(zi)報(bao)酬的(de); (3)低于當地最低工(gong)(gong)資(zi)(zi)(zi)標準(zhun)支(zhi)(zhi)(zhi)付(fu)勞(lao)動者工(gong)(gong)資(zi)(zi)(zi)的(de); (4)解除(chu)勞(lao)動合(he)同(tong)后,未依(yi)照本法(fa)(fa)規定給予(yu)勞(lao)動者經濟(ji)補償(chang)的(de)。” 可以(yi)看出對于無(wu)故拖欠(qian)職工(gong)(gong)工(gong)(gong)資(zi)(zi)(zi)的(de)行為(wei)應由(you)資(zi)(zi)(zi)方支(zhi)(zhi)(zhi)付(fu)拖欠(qian)工(gong)(gong)資(zi)(zi)(zi)、補償(chang)金(jin)(25%拖欠(qian)工(gong)(gong)資(zi)(zi)(zi)額),必(bi)要(yao)時(shi)還要(yao)支(zhi)(zhi)(zhi)付(fu)賠(pei)償(chang)金(jin)(但要(yao)以(yi)造成實際(ji)損害為(wei)前提)。
