答 《勞(lao)(lao)動(dong)合(he)同(tong)法》對競業禁(jin)止適用(yong)(yong)(yong)范圍、期限以(yi)及補償方式均作出(chu)了明確(que)規定(ding)(ding),第23條(tiao)規定(ding)(ding):“用(yong)(yong)(yong)人(ren)單位與(yu)勞(lao)(lao)動(dong)者(zhe)可以(yi)在(zai)勞(lao)(lao)動(dong)合(he)同(tong)中(zhong)約定(ding)(ding)保(bao)守用(yong)(yong)(yong)人(ren)單位的(de)商業秘密(mi) 和與(yu)知(zhi)識產權相(xiang)關的(de)保(bao)密(mi)事項(xiang)。對負有保(bao)密(mi)義務的(de)勞(lao)(lao)動(dong)者(zhe),用(yong)(yong)(yong)人(ren)單位可以(yi)在(zai)勞(lao)(lao)動(dong)合(he)同(tong)或(huo)(huo)者(zhe)保(bao)密(mi)協議中(zhong)與(yu)勞(lao)(lao)動(dong)者(zhe)約定(ding)(ding)競業限制(zhi)條(tiao)款(kuan),并(bing)約定(ding)(ding)在(zai)解除或(huo)(huo)者(zhe)終止勞(lao)(lao)動(dong)合(he)同(tong)后(hou),在(zai)競業限制(zhi)期限內按月給(gei)予勞(lao)(lao)動(dong)者(zhe)經濟補償。勞(lao)(lao)動(dong)者(zhe)違(wei)反競業限制(zhi)約定(ding)(ding)的(de),應當按照約定(ding)(ding)向用(yong)(yong)(yong)人(ren)單位支付違(wei)約金。”
