最(zui)近剛應(ying)聘了一家新公(gong)司,想咨詢一下,對(dui)于(yu)競業(ye)禁止適(shi)用范圍有哪(na)些規(gui)定啊?

答(da) 《勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)法》對(dui)競(jing)(jing)業(ye)禁止(zhi)適用范圍、期限(xian)(xian)以(yi)(yi)及補償(chang)方式均(jun)作出了明(ming)確規定,第(di)23條規定:“用人單位與(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)者可以(yi)(yi)在(zai)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)中約(yue)(yue)定保守用人單位的商業(ye)秘(mi)密(mi) 和(he)與(yu)知(zhi)識產權相(xiang)關的保密(mi)事項。對(dui)負有(you)保密(mi)義務的勞(lao)(lao)(lao)動(dong)(dong)(dong)者,用人單位可以(yi)(yi)在(zai)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)或者保密(mi)協議中與(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)者約(yue)(yue)定競(jing)(jing)業(ye)限(xian)(xian)制(zhi)條款,并約(yue)(yue)定在(zai)解除(chu)或者終止(zhi)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)后,在(zai)競(jing)(jing)業(ye)限(xian)(xian)制(zhi)期限(xian)(xian)內按(an)月(yue)給予(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)者經濟補償(chang)。勞(lao)(lao)(lao)動(dong)(dong)(dong)者違反競(jing)(jing)業(ye)限(xian)(xian)制(zhi)約(yue)(yue)定的,應當按(an)照約(yue)(yue)定向(xiang)用人單位支付違約(yue)(yue)金。”
