答 原勞(lao)(lao)(lao)動(dong)(dong)(dong)部1994年(nian)發(fa)布的(de)(de)《工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)支付(fu)暫行(xing)規(gui)定(ding)》中對企業停工(gong)(gong)(gong)(gong)(gong)、停產期(qi)間的(de)(de)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)發(fa)放原則作了(le)規(gui)定(ding):“非因勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)原因造(zao)成單位停工(gong)(gong)(gong)(gong)(gong)、停產在一個工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)支付(fu)周(zhou)(zhou)期(qi)內(nei)的(de)(de),用(yong)人單位應(ying)按勞(lao)(lao)(lao)動(dong)(dong)(dong)合同規(gui)定(ding)的(de)(de)標準支付(fu)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)。超(chao)過一個工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)支付(fu)周(zhou)(zhou)期(qi)的(de)(de),若(ruo)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)提供了(le)正(zheng)(zheng)常(chang)(chang)勞(lao)(lao)(lao)動(dong)(dong)(dong),則支付(fu)給(gei)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)的(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)報(bao)酬不得(de)低于當地的(de)(de)最低工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)標準;若(ruo)勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)沒有(you)提供正(zheng)(zheng)常(chang)(chang)勞(lao)(lao)(lao)動(dong)(dong)(dong),應(ying)按國家有(you)關規(gui)定(ding)辦(ban)理。”
