該如何理解事實勞動關系呢?

我剛剛進入職(zhi)場是個新人,現在想(xiang)咨詢一下,請問該如何理解(jie)事實勞動關系呢?

首先沒(mei)有書面合(he)(he)(he)同(tong)(tong)形式,通過以口頭協議(yi)代替(ti)書面勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)而形成(cheng)(cheng)的勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關系(xi)(xi),應簽(qian)(qian)而未簽(qian)(qian)訂的勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)。用(yong)(yong)人單位(wei)招用(yong)(yong)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)后不按規(gui)定(ding)(ding)訂立勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)而形成(cheng)(cheng)的勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關系(xi)(xi)。其次用(yong)(yong)人單位(wei)與(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)以前簽(qian)(qian)訂過勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong),但是勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)到(dao)期后用(yong)(yong)人單位(wei)同(tong)(tong)意勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)(zhe)繼續在本單位(wei)工作(zuo)卻沒(mei)有與(yu)其及時續訂勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)而形成(cheng)(cheng)的事(shi)實延續的勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關系(xi)(xi)。最(zui)后以其他合(he)(he)(he)同(tong)(tong)形式代替(ti)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong),勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)構成(cheng)(cheng)要(yao)件或(huo)者(zhe)(zhe)相關條(tiao)款缺乏或(huo)者(zhe)(zhe)違法(fa),事(shi)實上成(cheng)(cheng)為(wei)無效(xiao)合(he)(he)(he)同(tong)(tong),但是雙方依照這一合(he)(he)(he)同(tong)(tong)規(gui)定(ding)(ding)已經建立的勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關系(xi)(xi)。
