每月部分工資扣作違約保證金合法嗎?

問 最近應聘(pin)了一家公(gong)司(si),想咨詢(xun)一下,每月部(bu)分工資扣(kou)作違約保證(zheng)金合法(fa)嗎?
答 《中華人(ren)民共(gong)和國勞(lao)動(dong)(dong)合同(tong)法》第(di)九條(tiao)規(gui)定:“用(yong)人(ren)單位(wei)(wei)招用(yong)勞(lao)動(dong)(dong)者(zhe),不(bu)得(de)扣押勞(lao)動(dong)(dong)者(zhe)的居民身份證和其(qi)他證件,不(bu)得(de)要求勞(lao)動(dong)(dong)者(zhe)提供擔(dan)保或者(zhe)以(yi)其(qi)他名義向(xiang)勞(lao)動(dong)(dong)者(zhe)收取財(cai)物。”第(di)三十條(tiao)規(gui)定:“用(yong)人(ren)單位(wei)(wei)應當按照勞(lao)動(dong)(dong)合同(tong)約定和國家規(gui)定,向(xiang)勞(lao)動(dong)(dong)者(zhe)及時足額支付勞(lao)動(dong)(dong)報酬。”
