安排員工待崗可以么?

最(zui)近公司(si)因為經(jing)營不善(shan),想安排員工(gong)待(dai)崗(gang),想咨詢一下,現規定還(huan)有待(dai)崗(gang)規定么?

勞(lao)(lao)動(dong)(dong)(dong)法中并沒有(you)“待崗”的(de)(de)概(gai)念,所(suo)謂(wei)的(de)(de)待崗是(shi)單位(wei)停(ting)(ting)工(gong)停(ting)(ting)產,員工(gong)處于(yu)等待恢復(fu)生(sheng)產后上崗的(de)(de)意思。1994年(nian)勞(lao)(lao)動(dong)(dong)(dong)部《工(gong)資支(zhi)付暫行(xing)規(gui)(gui)定(ding)》第十二條規(gui)(gui)定(ding):“非因勞(lao)(lao)動(dong)(dong)(dong)者(zhe)原因造成單位(wei)停(ting)(ting)工(gong)、停(ting)(ting)產在一個工(gong)資支(zhi)付周期內的(de)(de),用(yong)人單位(wei)應按勞(lao)(lao)動(dong)(dong)(dong)合同規(gui)(gui)定(ding)的(de)(de)標準(zhun)支(zhi)付勞(lao)(lao)動(dong)(dong)(dong)者(zhe)工(gong)資。超過一個工(gong)資支(zhi)付周期的(de)(de),若勞(lao)(lao)動(dong)(dong)(dong)者(zhe)提(ti)供了正常勞(lao)(lao)動(dong)(dong)(dong),則支(zhi)付給勞(lao)(lao)動(dong)(dong)(dong)者(zhe)的(de)(de)勞(lao)(lao)動(dong)(dong)(dong)報酬不得(de)低于(yu)當(dang)地(di)的(de)(de)最低工(gong)資標準(zhun);若勞(lao)(lao)動(dong)(dong)(dong)者(zhe)沒有(you)提(ti)供正常勞(lao)(lao)動(dong)(dong)(dong),應按國家有(you)關規(gui)(gui)定(ding)辦理。”
