用人單(dan)位為(wei)勞(lao)動者(zhe)提供專(zhuan)項培訓(xun)費(fei)用,對其進(jin)行專(zhuan)業技(ji)術培訓(xun)的,可以與該勞(lao)動者(zhe)訂(ding)立協(xie)議(yi),約(yue)定服(fu)務(wu)期,那么約(yue)定服(fu)務(wu)期勞(lao)動者(zhe)需要注意什么?

答(da) 首(shou)先用(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)位對勞(lao)動(dong)(dong)(dong)者(zhe)的(de)(de)(de)(de)培(pei)訓義務(wu)(wu)和勞(lao)動(dong)(dong)(dong)者(zhe)為用(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)位履行的(de)(de)(de)(de)服務(wu)(wu)期(qi)義務(wu)(wu)是相對應的(de)(de)(de)(de),該(gai)規定同時考慮到(dao)用(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)位和勞(lao)動(dong)(dong)(dong)者(zhe)的(de)(de)(de)(de)利益,用(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)位必須(xu)按本單(dan)(dan)(dan)位工資總額的(de)(de)(de)(de)一定比例提(ti)取培(pei)訓費用(yong)(yong),用(yong)(yong)于對勞(lao)動(dong)(dong)(dong)者(zhe)的(de)(de)(de)(de)職業(ye)培(pei)訓。用(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)位使用(yong)(yong)法定培(pei)訓費用(yong)(yong)對勞(lao)動(dong)(dong)(dong)者(zhe)進行職業(ye)培(pei)訓,不能(neng)作(zuo)為與(yu)勞(lao)動(dong)(dong)(dong)者(zhe)約(yue)定服務(wu)(wu)期(qi)的(de)(de)(de)(de)條件(jian)。最后只有在用(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)位按國家規定必須(xu)按照本單(dan)(dan)(dan)位工資總額的(de)(de)(de)(de)一定比例提(ti)取培(pei)訓費用(yong)(yong),用(yong)(yong)于對勞(lao)動(dong)(dong)(dong)者(zhe)的(de)(de)(de)(de)職業(ye)培(pei)訓之外,又(you)專(zhuan)門撥出經費,為勞(lao)動(dong)(dong)(dong)者(zhe)提(ti)供特定項(xiang)目的(de)(de)(de)(de)專(zhuan)門培(pei)訓的(de)(de)(de)(de)情況下,用(yong)(yong)人(ren)(ren)單(dan)(dan)(dan)位才(cai)可以與(yu)勞(lao)動(dong)(dong)(dong)者(zhe)約(yue)定服務(wu)(wu)期(qi)。
