答 勞(lao)(lao)動(dong)(dong)合同法(fa)規定,勞(lao)(lao)動(dong)(dong)者(zhe)不能(neng)勝任工(gong)作,經過培訓或者(zhe)調整工(gong)作崗位(wei),仍不能(neng)勝任工(gong)作的,用(yong)人單位(wei)提前三十日以書面形式通(tong)知(zhi)勞(lao)(lao)動(dong)(dong)者(zhe)本人或者(zhe)額外支付勞(lao)(lao)動(dong)(dong)者(zhe)一個月工(gong)資后,可以解除(chu)勞(lao)(lao)動(dong)(dong)合同。
