答(da) 《勞(lao)動(dong)(dong)(dong)法》的(de)(de)適(shi)用(yong)范圍(wei)僅包括(kuo)3種類型(xing):(1)中國境內的(de)(de)企業;(2)個(ge)體(ti)經濟組織(zhi);(3)與勞(lao)動(dong)(dong)(dong)者(zhe)建(jian)立(li)勞(lao)動(dong)(dong)(dong)關系(xi)的(de)(de)國家(jia)機(ji)關、事業組織(zhi)、社會團(tuan)(tuan)體(ti)。可見(jian),在用(yong)人單位(wei)(wei)的(de)(de)適(shi)用(yong)范圍(wei)上,《勞(lao)動(dong)(dong)(dong)合(he)同法》比《勞(lao)動(dong)(dong)(dong)法》多了(le)一個(ge)“民(min)辦非(fei)企業單位(wei)(wei)”,顯然又比《勞(lao)動(dong)(dong)(dong)法》前進(jin)了(le)一步。因此,不(bu)管是(shi)(shi)(shi)國家(jia)機(ji)關還(huan)是(shi)(shi)(shi)事業單位(wei)(wei),不(bu)管是(shi)(shi)(shi)以(yi)營利(li)為目的(de)(de)的(de)(de)企業、個(ge)體(ti)經濟組織(zhi),還(huan)是(shi)(shi)(shi)以(yi)非(fei)營利(li)為目的(de)(de)的(de)(de)社會團(tuan)(tuan)體(ti)、民(min)辦非(fei)企業單位(wei)(wei),只(zhi)要與勞(lao)動(dong)(dong)(dong)者(zhe)建(jian)立(li)了(le)勞(lao)動(dong)(dong)(dong)關系(xi),就應當簽定勞(lao)動(dong)(dong)(dong)合(he)同。而只(zhi)要簽定勞(lao)動(dong)(dong)(dong)合(he)同,都要依照《勞(lao)動(dong)(dong)(dong)合(he)同法》執行。
