答 實(shi)際上,依據勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同法第38條、第46條的(de)(de)(de)(de)(de)規定,如果公司(si)存在違(wei)法行(xing)為,勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)以下列(lie)理由(you)提出解除勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同的(de)(de)(de)(de)(de),公司(si)仍需按照勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)工作(zuo)年限支付經濟(ji)補償,即: (1)未按照勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同約定提供勞(lao)動(dong)(dong)(dong)(dong)(dong)保護(hu)或者(zhe)勞(lao)動(dong)(dong)(dong)(dong)(dong)條件的(de)(de)(de)(de)(de); (2)未及時(shi)足額支付勞(lao)動(dong)(dong)(dong)(dong)(dong)報酬的(de)(de)(de)(de)(de); (3)未依法為勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)繳納社會保險(xian)費的(de)(de)(de)(de)(de); (4)用(yong)人(ren)(ren)(ren)單位的(de)(de)(de)(de)(de)規章制度違(wei)反法律(lv)、法規的(de)(de)(de)(de)(de)規定,損(sun)害勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)權益的(de)(de)(de)(de)(de); (5)有欺詐、脅(xie)迫(po)、趁人(ren)(ren)(ren)之危等情形致(zhi)使勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同無效的(de)(de)(de)(de)(de); (6)用(yong)人(ren)(ren)(ren)單位以暴(bao)力、威脅(xie)或者(zhe)非法限制人(ren)(ren)(ren)身(shen)(shen)自(zi)由(you)的(de)(de)(de)(de)(de)手段強迫(po)勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)勞(lao)動(dong)(dong)(dong)(dong)(dong)的(de)(de)(de)(de)(de),或者(zhe)用(yong)人(ren)(ren)(ren)單位違(wei)章指揮、強令冒險(xian)作(zuo)業危及勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)人(ren)(ren)(ren)身(shen)(shen)安全的(de)(de)(de)(de)(de)。
