答(da) 實際上,依(yi)據勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)法第38條、第46條的(de)規(gui)定,如果公(gong)司(si)存在(zai)違法行為,勞(lao)動(dong)(dong)(dong)(dong)者以下(xia)列理由提出解除勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)的(de),公(gong)司(si)仍需按照(zhao)勞(lao)動(dong)(dong)(dong)(dong)者工(gong)作年(nian)限(xian)支付經濟補償,即(ji): (1)未(wei)按照(zhao)勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)約(yue)定提供勞(lao)動(dong)(dong)(dong)(dong)保護或(huo)者勞(lao)動(dong)(dong)(dong)(dong)條件的(de); (2)未(wei)及時足額(e)支付勞(lao)動(dong)(dong)(dong)(dong)報酬(chou)的(de); (3)未(wei)依(yi)法為勞(lao)動(dong)(dong)(dong)(dong)者繳納社會保險(xian)費的(de); (4)用(yong)人(ren)單位(wei)的(de)規(gui)章制度(du)違反法律、法規(gui)的(de)規(gui)定,損(sun)害勞(lao)動(dong)(dong)(dong)(dong)者權益的(de); (5)有欺詐、脅迫、趁人(ren)之危(wei)等情形致(zhi)使勞(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)無效的(de); (6)用(yong)人(ren)單位(wei)以暴力、威脅或(huo)者非法限(xian)制人(ren)身自由的(de)手段強迫勞(lao)動(dong)(dong)(dong)(dong)者勞(lao)動(dong)(dong)(dong)(dong)的(de),或(huo)者用(yong)人(ren)單位(wei)違章指揮、強令(ling)冒險(xian)作業危(wei)及勞(lao)動(dong)(dong)(dong)(dong)者人(ren)身安全的(de)。
