哪些情形下解除約定服務期的勞動合同,勞動者需支付違約金?

哪些情形(xing)下(xia)用(yong)人單位與勞動者解除約定(ding)(ding)服務期(qi)的勞動合(he)同的,勞動者應當按照勞動合(he)同的約定(ding)(ding)向用(yong)人單位支(zhi)付違約金?

有下列情形之一(yi),用(yong)(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)與(yu)勞(lao)動者解除約定服務(wu)期的(de)勞(lao)動合同(tong)的(de),勞(lao)動者應當按照勞(lao)動合同(tong)的(de)約定向用(yong)(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)支付違(wei)約金: (一(yi))勞(lao)動者嚴(yan)(yan)重違(wei)反用(yong)(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)的(de)規章制度的(de); (二(er))勞(lao)動者嚴(yan)(yan)重失職,營私舞弊,給用(yong)(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)造成重大損害的(de); (三)勞(lao)動者同(tong)時與(yu)其他用(yong)(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)建立勞(lao)動關系,對完成本單(dan)(dan)位(wei)(wei)(wei)的(de)工作(zuo)任務(wu)造成嚴(yan)(yan)重影響,或(huo)(huo)者經(jing)用(yong)(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)提出,拒不改(gai)正(zheng)的(de); (四(si))勞(lao)動者以(yi)欺詐、脅迫(po)的(de)手段(duan)或(huo)(huo)者乘人(ren)之危,使(shi)用(yong)(yong)(yong)(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)在違(wei)背真實意思的(de)情況下訂立或(huo)(huo)者變更勞(lao)動合同(tong)的(de); (五)勞(lao)動者被(bei)依法追(zhui)究(jiu)刑(xing)事責任的(de)。
