哪些情形下用人單位辭退職工需要支付經濟補償?

我的(de)一個朋友被(bei)辭(ci)退(tui)(tui)了,單位說辭(ci)退(tui)(tui)的(de)情(qing)形(xing)不需(xu)要給她經濟補償,請問哪些情(qing)形(xing)下用人單位辭(ci)退(tui)(tui)職工需(xu)要支(zhi)付(fu)經濟補償?

在以下三種(zhong)情形(xing)下,用(yong)人(ren)單(dan)(dan)位(wei)(wei)向勞動(dong)(dong)(dong)者(zhe)提(ti)出解除勞動(dong)(dong)(dong)合(he)同時,應(ying)支付經濟補償金: (1)勞動(dong)(dong)(dong)者(zhe)患病或者(zhe)非因(yin)工(gong)(gong)負傷,在規定的(de)醫(yi)療期滿后不(bu)能(neng)從事原工(gong)(gong)作,也(ye)不(bu)能(neng)從事由用(yong)人(ren)單(dan)(dan)位(wei)(wei)另行安(an)排的(de)工(gong)(gong)作的(de); (2)勞動(dong)(dong)(dong)者(zhe)不(bu)能(neng)勝任工(gong)(gong)作,經過培(pei)訓或者(zhe)調整工(gong)(gong)作崗位(wei)(wei),仍(reng)不(bu)能(neng)勝任工(gong)(gong)作的(de); (3)勞動(dong)(dong)(dong)合(he)同訂立(li)時所依據的(de)客觀情況發生(sheng)重大變化,致使勞動(dong)(dong)(dong)合(he)同無法履(lv)行,經用(yong)人(ren)單(dan)(dan)位(wei)(wei)與勞動(dong)(dong)(dong)者(zhe)協商(shang),未能(neng)就(jiu)變更勞動(dong)(dong)(dong)合(he)同內容達成協議的(de)。
