答 根據《勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)法》第23條第二(er)款(kuan)(kuan)規定:單(dan)位(wei)與勞(lao)(lao)(lao)動(dong)(dong)(dong)者簽訂“競業(ye)限(xian)制”條款(kuan)(kuan)的(de)同(tong)時(shi),要約(yue)定在解除(chu)或者終止勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)后,在競業(ye)限(xian)制期限(xian)內按月給予勞(lao)(lao)(lao)動(dong)(dong)(dong)者經濟補償。補償金(jin)的(de)數額(e)由雙方約(yue)定。用人(ren)單(dan)位(wei)未按照約(yue)定在勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)解除(chu)后向勞(lao)(lao)(lao)動(dong)(dong)(dong)者支付競業(ye)限(xian)制經濟補償的(de),競業(ye)限(xian)制條款(kuan)(kuan)失效。
