根據《勞(lao)動(dong)(dong)合同(tong)法(fa)》第23條第二(er)款規定(ding):單(dan)位(wei)(wei)與勞(lao)動(dong)(dong)者(zhe)簽訂“競業(ye)限(xian)(xian)制”條款的(de)同(tong)時,要約定(ding)在(zai)(zai)解除或(huo)者(zhe)終(zhong)止勞(lao)動(dong)(dong)合同(tong)后,在(zai)(zai)競業(ye)限(xian)(xian)制期限(xian)(xian)內按月給(gei)予勞(lao)動(dong)(dong)者(zhe)經(jing)濟(ji)補償。補償金(jin)的(de)數額由雙方約定(ding)。用人單(dan)位(wei)(wei)未按照(zhao)約定(ding)在(zai)(zai)勞(lao)動(dong)(dong)合同(tong)解除后向勞(lao)動(dong)(dong)者(zhe)支付競業(ye)限(xian)(xian)制經(jing)濟(ji)補償的(de),競業(ye)限(xian)(xian)制條款失效。
