我們公(gong)司最近(jin)要降薪,請(qing)問哪(na)些情(qing)況下(xia)用(yong)人單位減(jian)發員(yuan)工工資(zi)不屬于克扣(kou)工資(zi)行為?

用人(ren)單位必(bi)須按照勞(lao)(lao)(lao)動合(he)同約(yue)定(ding)的(de)(de)(de)(de)工(gong)(gong)資(zi)(zi)標準全額(e)向勞(lao)(lao)(lao)動者支(zhi)付(fu)工(gong)(gong)資(zi)(zi),否則,將構成克扣工(gong)(gong)資(zi)(zi)的(de)(de)(de)(de)行(xing)為(wei)(wei)。但(dan)在(zai)下(xia)列情況(kuang)下(xia),用人(ren)單位減發工(gong)(gong)資(zi)(zi),不屬于克扣工(gong)(gong)資(zi)(zi)的(de)(de)(de)(de)行(xing)為(wei)(wei): (1)國家的(de)(de)(de)(de)法律、法規中有明(ming)(ming)確規定(ding)的(de)(de)(de)(de); (2)依法簽訂(ding)的(de)(de)(de)(de)勞(lao)(lao)(lao)動合(he)同中有明(ming)(ming)確規定(ding)的(de)(de)(de)(de); (3)用人(ren)單位依法制定(ding)并經(jing)(jing)職代會批準的(de)(de)(de)(de)廠規、廠紀中有明(ming)(ming)確規定(ding)的(de)(de)(de)(de); (4)企(qi)業工(gong)(gong)資(zi)(zi)總額(e)與(yu)經(jing)(jing)濟效(xiao)益相聯系,經(jing)(jing)濟效(xiao)益下(xia)浮時,工(gong)(gong)資(zi)(zi)必(bi)須下(xia)浮的(de)(de)(de)(de)(但(dan)支(zhi)付(fu)給勞(lao)(lao)(lao)動的(de)(de)(de)(de)工(gong)(gong)資(zi)(zi)不得低(di)于當地的(de)(de)(de)(de)最低(di)工(gong)(gong)資(zi)(zi)標準); (5)因勞(lao)(lao)(lao)動者請事(shi)假等相應減發工(gong)(gong)資(zi)(zi)等。
