答 根據《勞動(dong)(dong)(dong)法》第四(si)十(shi)四(si)條已明(ming)確規定:“有(you)下(xia)列情形之一(yi)(yi)的(de)(de),用人單(dan)位應當按照下(xia)列標準支(zhi)(zhi)(zhi)付(fu)高(gao)于勞動(dong)(dong)(dong)者(zhe)正常(chang)工(gong)(gong)作時間(jian)工(gong)(gong)資的(de)(de)工(gong)(gong)資報(bao)酬:(一(yi)(yi))安排勞動(dong)(dong)(dong)者(zhe)延長(chang)時間(jian)的(de)(de),支(zhi)(zhi)(zhi)付(fu)不低(di)(di)于工(gong)(gong)資的(de)(de)百(bai)分之一(yi)(yi)百(bai)五十(shi)的(de)(de)工(gong)(gong)資報(bao)酬;(二)休息日安排勞動(dong)(dong)(dong)者(zhe)工(gong)(gong)作又不能安排補休的(de)(de),支(zhi)(zhi)(zhi)付(fu)不低(di)(di)于工(gong)(gong)資的(de)(de)百(bai)分之二百(bai)的(de)(de)工(gong)(gong)資報(bao)酬;(三)法定休假日安排勞動(dong)(dong)(dong)者(zhe)工(gong)(gong)作的(de)(de),支(zhi)(zhi)(zhi)付(fu)不低(di)(di)于工(gong)(gong)資的(de)(de)百(bai)分之三百(bai)的(de)(de)工(gong)(gong)資報(bao)酬。”
