根據《勞動(dong)法》第四(si)十(shi)四(si)條(tiao)已明確(que)規定(ding):“有下列(lie)情形之(zhi)一(yi)的(de),用人單位應(ying)當按照下列(lie)標(biao)準支(zhi)(zhi)付(fu)(fu)高于勞動(dong)者正常工(gong)(gong)(gong)作(zuo)時間工(gong)(gong)(gong)資(zi)(zi)的(de)工(gong)(gong)(gong)資(zi)(zi)報(bao)酬(chou)(chou):(一(yi))安(an)(an)排勞動(dong)者延長時間的(de),支(zhi)(zhi)付(fu)(fu)不低(di)于工(gong)(gong)(gong)資(zi)(zi)的(de)百(bai)(bai)分之(zhi)一(yi)百(bai)(bai)五十(shi)的(de)工(gong)(gong)(gong)資(zi)(zi)報(bao)酬(chou)(chou);(二(er))休息日安(an)(an)排勞動(dong)者工(gong)(gong)(gong)作(zuo)又不能安(an)(an)排補休的(de),支(zhi)(zhi)付(fu)(fu)不低(di)于工(gong)(gong)(gong)資(zi)(zi)的(de)百(bai)(bai)分之(zhi)二(er)百(bai)(bai)的(de)工(gong)(gong)(gong)資(zi)(zi)報(bao)酬(chou)(chou);(三)法定(ding)休假日安(an)(an)排勞動(dong)者工(gong)(gong)(gong)作(zuo)的(de),支(zhi)(zhi)付(fu)(fu)不低(di)于工(gong)(gong)(gong)資(zi)(zi)的(de)百(bai)(bai)分之(zhi)三百(bai)(bai)的(de)工(gong)(gong)(gong)資(zi)(zi)報(bao)酬(chou)(chou)。”
