單(dan)(dan)(dan)(dan)(dan)位(wei)不給職工(gong)(gong)繳保(bao)險,職工(gong)(gong)可(ke)以(yi)(yi)與(yu)單(dan)(dan)(dan)(dan)(dan)位(wei)解(jie)除合同(tong)(tong),并獲得(de)經濟(ji)補(bu)償。依據的法律主要(yao)有(you)以(yi)(yi)下幾條,《社(she)(she)會(hui)(hui)保(bao)險法》第(di)十(shi)(shi)條規(gui)定(ding)(ding):“職工(gong)(gong)應當(dang)參加(jia)養老(lao)保(bao)險,由用(yong)人(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)和職工(gong)(gong)共同(tong)(tong)繳納(na)基本養老(lao)保(bao)險費(fei)。”《勞(lao)(lao)動(dong)合同(tong)(tong)法》第(di)三十(shi)(shi)八條規(gui)定(ding)(ding):“用(yong)人(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)未依法為勞(lao)(lao)動(dong)者(zhe)(zhe)繳納(na)社(she)(she)會(hui)(hui)保(bao)險費(fei)的,勞(lao)(lao)動(dong)者(zhe)(zhe)可(ke)以(yi)(yi)解(jie)除勞(lao)(lao)動(dong)合同(tong)(tong)。”根據《勞(lao)(lao)動(dong)合同(tong)(tong)法》第(di)四十(shi)(shi)六條規(gui)定(ding)(ding),勞(lao)(lao)動(dong)者(zhe)(zhe)因用(yong)人(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)未繳納(na)社(she)(she)會(hui)(hui)保(bao)險費(fei)而解(jie)除勞(lao)(lao)動(dong)合同(tong)(tong)的,用(yong)人(ren)單(dan)(dan)(dan)(dan)(dan)位(wei)應當(dang)向勞(lao)(lao)動(dong)者(zhe)(zhe)支付經濟(ji)補(bu)償。
