我(wo)是(shi)一名工程師,最近(jin)要與公司簽(qian)合同,想了(le)解一下《勞(lao)動合同法》對競業(ye)限制(zhi)是(shi)如何(he)規定的?

根(gen)據我(wo)的(de)(de)了解(jie)(jie)《勞(lao)動(dong)(dong)(dong)合(he)同(tong)法》第(di)二十(shi)三條第(di)二款規定(ding):“對負有保密(mi)義務的(de)(de)勞(lao)動(dong)(dong)(dong)者,用人(ren)單位可以在(zai)勞(lao)動(dong)(dong)(dong)合(he)同(tong)或者保密(mi)協(xie)議(yi)中與勞(lao)動(dong)(dong)(dong)者約(yue)定(ding)競(jing)業限制(zhi)條款,并(bing)約(yue)定(ding)在(zai)解(jie)(jie)除或者終止勞(lao)動(dong)(dong)(dong)合(he)同(tong)后,在(zai)競(jing)業限制(zhi)期限內按月給(gei)予勞(lao)動(dong)(dong)(dong)者經濟補償。勞(lao)動(dong)(dong)(dong)者違反競(jing)業限制(zhi)約(yue)定(ding)的(de)(de),應當按照約(yue)定(ding)向用人(ren)單位支付(fu)違約(yue)金。”
