答(da) 依(yi)據《中華(hua)人(ren)民(min)共(gong)和國勞(lao)動(dong)(dong)合(he)同法》規定，對負有保密義務的勞(lao)動(dong)(dong)者，用(yong)人(ren)單位可以在(zai)勞(lao)動(dong)(dong)合(he)同或者保密協議中與勞(lao)動(dong)(dong)者約(yue)(yue)定競業(ye)限(xian)制條款，并約(yue)(yue)定在(zai)解除或者終(zhong)止(zhi)勞(lao)動(dong)(dong)合(he)同后，在(zai)競業(ye)限(xian)制期(qi)限(xian)內按(an)月給予勞(lao)動(dong)(dong)者經濟補(bu)償。勞(lao)動(dong)(dong)者違反競業(ye)限(xian)制約(yue)(yue)定的，應當按(an)照約(yue)(yue)定向(xiang)用(yong)人(ren)單位支付違約(yue)(yue)金。
