單位不給員工繳納保險,違法了嗎?

單(dan)位不(bu)給(gei)員(yuan)工(gong)繳納(na)保(bao)(bao)險(xian)(xian)肯定(ding)是違法了。據(ju)我所(suo)知,《社會保(bao)(bao)險(xian)(xian)法》第十(shi)條規定(ding):“職(zhi)工(gong)應當參加養(yang)(yang)老(lao)(lao)保(bao)(bao)險(xian)(xian),由用人單(dan)位和職(zhi)工(gong)共(gong)同繳納(na)基本養(yang)(yang)老(lao)(lao)保(bao)(bao)險(xian)(xian)費。”《勞(lao)動(dong)(dong)(dong)合(he)同法》第三十(shi)八條規定(ding):“用人單(dan)位未(wei)依(yi)法為勞(lao)動(dong)(dong)(dong)者繳納(na)社會保(bao)(bao)險(xian)(xian)費的,勞(lao)動(dong)(dong)(dong)者可以(yi)解除勞(lao)動(dong)(dong)(dong)合(he)同。”根據(ju)《勞(lao)動(dong)(dong)(dong)合(he)同法》第四十(shi)六條規定(ding),勞(lao)動(dong)(dong)(dong)者因用人單(dan)位未(wei)繳納(na)社會保(bao)(bao)險(xian)(xian)費而解除勞(lao)動(dong)(dong)(dong)合(he)同的,用人單(dan)位應當向勞(lao)動(dong)(dong)(dong)者支付經濟補償(chang)。
