停薪(xin)留職(zhi)(zhi)指(zhi)勞(lao)(lao)動關系不(bu)終止的情(qing)形下,用(yong)人單位允許生產(chan)或工(gong)(gong)作上不(bu)需要的多余人員離(li)職(zhi)(zhi),并(bing)停發(fa)工(gong)(gong)資的勞(lao)(lao)動法律行為。他(ta)一般由用(yong)人單位與職(zhi)(zhi)工(gong)(gong)簽定停薪(xin)留職(zhi)(zhi)合同,具體約(yue)定雙方的權利義(yi)務。《勞(lao)(lao)動人事部、國家經委關于企(qi)業職(zhi)(zhi)工(gong)(gong)要求“停薪(xin)留職(zhi)(zhi)”問(wen)題的通知》規定指(zhi)出(chu)“凡是(shi)企(qi)業不(bu)需要的富余職(zhi)(zhi)工(gong)(gong),可以允許‘停薪(xin)留職(zhi)(zhi)’”,“‘停薪(xin)留職(zhi)(zhi)’期間(jian),不(bu)升(sheng)級,不(bu)享受各種津(jin)貼、補貼和勞(lao)(lao)保福利待遇。”
