根據我的了(le)解(jie),《勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)法(fa)》中(zhong)關于(yu)競(jing)業(ye)協議相關司是這樣規定(ding):當事人在(zai)勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)或者保密協議中(zhong)約定(ding)了(le)競(jing)業(ye)限制(zhi),但(dan)未約定(ding)解(jie)除或者終止勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)后(hou)給予(yu)(yu)勞(lao)動(dong)(dong)者經濟補(bu)償,勞(lao)動(dong)(dong)者履行了(le)競(jing)業(ye)限制(zhi)義務(wu),要(yao)求用人單位按照勞(lao)動(dong)(dong)者在(zai)勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)解(jie)除或者終止前(qian)12個月平均工資的30%按月支付經濟補(bu)償的,人民(min)法(fa)院應予(yu)(yu)支持(chi)。前(qian)款規定(ding)的月平均工資的30%低于(yu)勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)履行地最(zui)低工資標準(zhun)的,按照勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)履行地最(zui)低工資標準(zhun)支付。
